Book L autonomie juridique en proie l autonomie juridictionnelle en droit administratif fran ais

Download or read book L autonomie juridique en proie l autonomie juridictionnelle en droit administratif fran ais written by Valérie Blehaut-Dubois and published by . This book was released on 2003 with total page 962 pages. Available in PDF, EPUB and Kindle.

Book LA NOTION D INDEPENDANCE EN DROIT ADMINISTRATIF

Download or read book LA NOTION D INDEPENDANCE EN DROIT ADMINISTRATIF written by Stéphane Manson and published by . This book was released on 1995 with total page 507 pages. Available in PDF, EPUB and Kindle. Book excerpt: MENTIONNEE PAR LES TEXTES ET LE JURISPRUDENCE EN CERTAINS DOMAINES DU DROIT ADMINISTRATIF, LA NOTION D'INDEPENDANCE N'A JAMAIS ETE DEFINIE. L'OBJET DE LA PRESENTE RECHERCHE CONSISTE PRECISEMENT A PROPOSER UNE DEFINITION DE LA NOTION D'INDEPENDANCE EN DROIT ADMINISTRATIF GRACE A L'ETUDE JURIDIQUE DE SES MANIFESTATIONS DANS LES DOMAINES DE LA MAGISTRATURE JUDICIAIRE, DES JURIDICTIONS ADMINISTRATIVES, DES AUTORITES ADMINISTRATIVES INDEPENDANTES, DES ENSEIGNANTS UNIVERSITAIRES, DES JURYS D'EXAMENS ET DE CONCOURS AINSI QUE DES MEDECINS MILITAIRES. A CET EGARD, ON PEUT PROPOSER QUE LA NOTION D'INDEPENDANCE CONSISTE EN UNE EMANCIPATION DE CERTAINS AGENTS A L'EGARD DES REGLES DE SUBORDINATION, GARANTIE PAR UN DISPOSITIF STATUTAIRE. AINSI LA NOTION D'INDEPENDANCE RESULTE-T-ELLE DE LA CONJONCTION DE DEUX ASPECTS COMPLEMENTAIRES: UN ASPECT FONCTIONNEL ET UN ASPECT STATUTAIRE. L'EMANCIPATION A L'EGARD DES REGLES DE SUBORDINATION. ORGANISEE ET MISE EN OEUVRE PAR L'ETAT AFIN DE PROTEGER LES DROITS ET LIBERTES DES INDIVIDUS EN CERTAINS DOMAINES, L'INDEPENDANCE EST OBTENUE FONCTIONNELLEMENT PAR L'EMANCIPATION DES AGENTS CONSIDERES A L'EGARD DE TOUTE SUBORDINATION HIERARCHIQUE OU DE TUTELLE. CARACTERISEE ALORS PAR UNE LIBERTE DE FONCTION, L'INDEPENDANCE DEMEURE TOUTEFOIS LIMITEE PAR LE LEGISLATEUR, L'OPINION PUBLIQUE ET PAR LE CONTROLE JURIDICTIONNEL. LA GARANTIE STATUTAIRE DE L'EMANCIPATION. DESTINES A PROTEGER LA LIBERTE DE FONCTION DES AGENTS EN CAUSE, LES MECANISMES STATUTAIRES D'INDEPENDANCE SONT COMPOSES DE DEUX ENSEMBLES DE GARANTIES JURIDIQUES: LES UNES S'APPLIQUANT A L'OCCASION DE L'INVESTITURE DE L'AGENT; LES AUTRES PRODUISANT LEURS EFFETS LORS DE L'EXERCICE DES FONCTIONS. LA REALITE ET L'EFFICACITE DE CES STATUTS SONT CEPENDANT NUANCEES PAR DEUX CONSIDERATIONS: L'APPARTENANCE DE L'AGENT A UNE INSTITUTION AINSI QUE LA VALEUR JURIDIQUE DES GARANTIES APPLICABLES.

Book The Public Law Private Law Divide

Download or read book The Public Law Private Law Divide written by Mark R Freedland and published by Bloomsbury Publishing. This book was released on 2006-03-01 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: The contributions brought together in this book derive from joint seminars, held by scholars between colleagues from the University of Oxford and the University of Paris II. Their starting point is the original divergence between the two jurisdictions, with the initial rejection of the public-private divide in English Law, but on the other hand its total acceptance as natural in French Law. Then, they go on to demonstrate that the two systems have converged, the British one towards a certain degree of acceptance of the division, the French one towards a growing questioning of it. However this is not the only part of the story, since both visions are now commonly coloured and affected by European Law and by globalisation, which introduces new tensions into our legal understanding of what is "public" and what is "private".

During that time, the international community claimed some major achievements as reflected by the adoption of conventions and treaties. This publication presents a collection of essays from legal advisers of States and international organizations, all of whom are among those committed to promoting respect for international law. Their contribution provides a practical perspective on international law, viewed from the standpoint of those involved in its formation, application and administration.

Book Weak Courts Strong Rights

Download or read book Weak Courts Strong Rights written by Mark Tushnet and published by Princeton University Press. This book was released on 2009-07-20 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Unlike many other countries, the United States has few constitutional guarantees of social welfare rights such as income, housing, or healthcare. In part this is because many Americans believe that the courts cannot possibly enforce such guarantees. However, recent innovations in constitutional design in other countries suggest that such rights can be judicially enforced--not by increasing the power of the courts but by decreasing it. In Weak Courts, Strong Rights, Mark Tushnet uses a comparative legal perspective to show how creating weaker forms of judicial review may actually allow for stronger social welfare rights under American constitutional law. Under "strong-form" judicial review, as in the United States, judicial interpretations of the constitution are binding on other branches of government. In contrast, "weak-form" review allows the legislature and executive to reject constitutional rulings by the judiciary--as long as they do so publicly. Tushnet describes how weak-form review works in Great Britain and Canada and discusses the extent to which legislatures can be expected to enforce constitutional norms on their own. With that background, he turns to social welfare rights, explaining the connection between the "state action" or "horizontal effect" doctrine and the enforcement of social welfare rights. Tushnet then draws together the analysis of weak-form review and that of social welfare rights, explaining how weak-form review could be used to enforce those rights. He demonstrates that there is a clear judicial path--not an insurmountable judicial hurdle--to better enforcement of constitutional social welfare rights.

Book The Oxford Handbook of the Canadian Constitution

Download or read book The Oxford Handbook of the Canadian Constitution written by Peter Crawford Oliver and published by Oxford University Press. This book was released on 2017 with total page 1169 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of the Canadian Constitution provides an ideal first stop for Canadians and non-Canadians seeking a clear, concise, and authoritative account of Canadian constitutional law. The Handbook is divided into six parts: Constitutional History, Institutions and Constitutional Change, Aboriginal Peoples and the Canadian Constitution, Federalism, Rights and Freedoms, and Constitutional Theory. Readers of this Handbook will discover some of the distinctive features of the Canadian constitution: for example, the importance of Indigenous peoples and legal systems, the long-standing presence of a French-speaking population, French civil law and Quebec, the British constitutional heritage, the choice of federalism, as well as the newer features, most notably the Canadian Charter of Rights and Freedoms, Section Thirty-Five regarding Aboriginal rights and treaties, and the procedures for constitutional amendment. The Handbook provides a remarkable resource for comparativists at a time when the Canadian constitution is a frequent topic of constitutional commentary. The Handbook offers a vital account of constitutional challenges and opportunities at the time of the 150th anniversary of Confederation.

Book Governing Africa s Forests in a Globalized World

Download or read book Governing Africa s Forests in a Globalized World written by Laura Anne German and published by Routledge. This book was released on 2009-12-01 with total page 435 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many countries around the world are engaged in decentralization processes, and most African countries face serious problems with forest governance, from benefits sharing to illegality and sustainable forest management. This book summarizes experiences to date on the extent and nature of decentralization and its outcomes - most of which suggest an underperformance of governance reforms - and explores the viability of different governance instruments in the context of weak governance and expanding commercial pressures over forests. Findings are grouped into two thematic areas: decentralization, livelihoods and sustainable forest management; and international trade, finance and forest sector governance reforms. The authors examine diverse forces shaping the forest sector, including the theory and practice of decentralization, usurpation of authority, corruption and illegality, inequitable patterns of benefits capture and expansion of international trade in timber and carbon credits, and discuss related outcomes on livelihoods, forest condition and equity. The book builds on earlier volumes exploring different dimensions of decentralization and perspectives from other world regions, and distills dimensions of forest governance that are both unique to Africa and representative of broader global patterns. The authors ground their analysis in relevant theory while drawing out implications of their findings for policy and practice.
