Proof of its lasting importance is that it was the cities that carried out the deficit-based employment policies of the early 1930s also had to carry the burden of a democratic reconstitution of Germany in the postwar period. After the crushing defeat at Napoleon’s hands, likewise the reconstitution of Prussia fell to the cities. Today, the same constellation of problems can be found on different stages. Europe, as it is growing together, faces a democracy deficit which ultimately will have to be addressed by the cities. The countries in transition and undergoing transformation likewise will have to find arenas for democratic decision making, which likely will be at the municipal level. Finally, the United States of America also faces a quagmire at the federal level which ultimately will have to be resolved at the state or local level. Contributions to this book examine all of these issues, making it of interest to students in urban studies, public administration, history and political science as well as policy-makers concerned with local government and autonomy.

Despite being Hong Kong’s sister `Special Administrative Region’ (SAR) within the People’s Republic of China, Macau’s unique constitutional development under Portuguese and Chinese administration remains under-appreciated despite its potential contributions to local, national, and international constitutional discourse. Utilizing a multi-disciplinary approach including doctrinal, historical, and comparative methodologies, this work fills that gap. The research blends Portuguese, Chinese, and foreign-language sources in order to reconstruct a balanced constitutional narrative. The book focuses on a consequential effect of globalization – that is, the assimilation of a longstanding and unique constitutional order by a new hegemonic sovereign – including processes for internationalization as China opened up, legal harmonization of two distinct legal and socioeconomic orders, juridification of local affairs with the establishment of a new local court system in preparation for handover to the Chinese regime, and democratization (or the lack thereof) among the various communities comprising the Macanese polity before and since. Focusing on Macau’s unique development at the crux of European and Chinese empires, and the role it plays as a mirror for Chinese intentions vis-a-vis Hong Kong today, the book will be of interest to those working in Constitutional Law, Politics and History.

Book excerpt: In 2011, the Gauteng Provincial Government proposed that Sedibeng, a Category C district municipality located in the province, should be restructured. Although the original proposal had anticipated that this would happen after the 2016 local elections, the issue remains unresolved due largely to fierce party-political opposition and vociferous protests against it on the ground. This Occasional Paper examines the dynamics, particularities, peculiarities and challenges of re-demarcating the Gauteng City-Region. While informed by technical reasons, the arguments for and against the merger have tended to gravitate more towards party-political rationales for why the re-demarcation should or should not go ahead. Although these debates raise important merits and demerits for the proposal, they are difficult to disentangle from the interests of those whose fortunes would be changed by restructuring. In this environment, municipal demarcation risks being held hostage by party politics, with stakeholders such as political parties using any means at their disposal to have things go their way, including by scapegoating the Municipal Demarcation Board (MDB). The case of Sedibeng presents important lessons about attempts to make post-transition local government – and mechanisms for determining its configuration – work for Gauteng. It also highlights the need for strengthening and revising demarcation-related legislation. How can we make sure that the MDB functions effectively with respect to its primary goals?
