Book excerpt: Public Law 106-65, National Defense Authorization Act for Fiscal Year 2000, section 1402, "Annual Report on Transfers of Militarily Sensitive Technology to Countries and Entities of Concern," October 5, 1999, requires that the Inspectors General of the Departments of Commerce, Defense, Energy, and State, in consultation with the Director, Central Intelligence Agency, and the Director, Federal Bureau of Investigation, conduct annual interagency reviews of the transfer of militarily sensitive technologies to countries and entities of concern. The overall audit objective was to determine whether Federal automation programs supporting the export license and review process could be used to establish a common electronic interface creating an automated interagency export licensing system in accordance with Federal policies and regulations. This report addresses the DoD portion of automating the export license review process for dual-use items and munitions items. Specifically, we reviewed the export license application process; the review processes of the Military Departments and other DoD Component commands; and the functionality of existing DoD automated systems. We will address the DoD involvement in the overall automation effort and the effect of DoD involvement on other U.S. governmental agencies in a subsequent interagency report. We also reviewed the management control program as it related to the overall objective.

Specifically, defense industry officials have stated that extended reviews of export license applications by the State Department are resulting in lost sales and are adversely affecting the nation's defense industry. In the United States, the State Department's Office of Defense Trade Controls is the office responsible for licensing the export and temporary import of defense articles and services. In June 2001, we reported to you that the State Department completed over 46,000 license application reviews in fiscal year 2000. While the U.S. export licensing process can be lengthy because of foreign policy and national security considerations, other factors may also have an impact on processing times. Therefore, you asked us to determine whether elements of the process create delays in license application reviews.

Book excerpt: The Department of State (Department) has primary federal responsibility for reviewing and approving licenses for the export of munitions commodities from the United States. In the current information age, there are vast opportunities for applying technology to help streamline and improve the effectiveness of the licensing control process. Given increasing risks to information processing in today' s environment, ensuring security in the licensing control process is also essential. In response to requirements of the National Defense Authorization Act for FY 2000, the Office of Inspector General (OIG) conducted a review of automation in the Department's munitions export licensing process. Specific objectives of our review were to (1) evaluate the processes and information systems used by the Department for reviewing munitions export license applications, including an assessment of systems connectivity with relevant Department bureaus and other federal agencies, (2) determine whether the licensing systems comply with federal and Departmental security assurance requirements, and (3) assess whether the Department is carrying out ongoing and planned upgrades to the licensing systems in a cost-effective and efficient manner. The purpose, scope, and methodology for the review are outlined on page 23.

Book excerpt: In response to a congressional request, GAO reviewed the Department of State's Office of Munition Control's (OMC) arms export licensing activities and procedures and identified actions OMC took to cope with its increased work load. GAO found that OMC: (1) approved about 90 percent of the license applications it acted on; (2) acted on 80 percent in less than a month; and (3) did not routinely check export license application data for accuracy or veracity. GAO also found that OMC has: (1) insufficient facilities and automated capabilities to store and retrieve historical data which would be useful in license application reviews; and (2) inadequate systems and procedures to ensure compliance with some administrative and reporting requirements.
