L'ouvrage fait apparaître l'originalité des concepts juridiques employés pour définir les droits des autochtones au Canada. Les droits territoriaux des autochtones ne peuvent être assimilés à la propriété privée ; ce sont des droits " ancestraux " qui trouvent leur source dans l'occupation immémoriale du territoire et les systèmes juridiques proprement autochtones. La technique du traité, un instrument juridique original qui n'est ni un simple contrat ni un traité international, a été utilisée dès les premiers contacts entre Européens et autochtones et sert encore de nos jours à définir les conditions de la coexistence entre les deux groupes. Mais c'est l'évolution du statut politique des autochtones qui est la plus remarquable : considérés il y a un demi-siècle comme des pupilles de l'État, les autochtones jouissent maintenant d'un droit à l'autonomie gouvernementale dont on commence à peine à entrevoir la portée. On assiste donc à une transformation graduelle du fédéralisme canadien pour faire une place à ce " troisième ordre de gouvernement " que constituent les autochtones.
