Book excerpt: It is an unfortunate but unavoidable feature of even well-ordered democratic societies that governmental administrative agencies often create legitimate expectations (procedural or substantive) on the part of non-governmental agents (individual citizens, groups, businesses, organizations, institutions, and instrumentalities) but find themselves unable to fulfil those expectations for reasons of justice, the public interest, severe financial constraints, and sometimes harsh political realities. How governmental administrative agencies, operating on behalf of society, handle the creation and frustration of legitimate expectations implicates a whole host of values that we have reason to care about, including under non-ideal conditions-not least justice, fairness, autonomy, the rule of law, responsible uses of power, credible commitments, reliance interests, security of expectations, stability, democracy, parliamentary supremacy, and legitimate authority. This book develops a new theory of legitimate expectations for public administration drawing on normative arguments from political and legal theory. Brown begins by offering a new account of the legitimacy of legitimate expectations. He argues that it is the very responsibility of governmental administrative agencies for creating expectations that ought to ground legitimacy, as opposed to the justice or the legitimate authority of those agencies and expectations. He also clarifies some of the main ways in which agencies can be responsible for creating expectations. Moreover, he argues that governmental administrative agencies should be held liable for losses they directly cause by creating and then frustrating legitimate expectations on the part of non-governmental agents and, if liable, have an obligation to make adequate compensation payments in respect of those losses.

Rights and Demands provides the first full-length treatment of a central class of rights: demand-rights. To have such a right is to have the standing or authority to demand a particular action of another person. How are such rights possible? Everyday agreements are generally acknowledged to be sources of demand-rights, but what is it about an agreement that accounts for this? The central thesis of this book is that joint commitment is a ground of demand-rights, and that it may be the only ground. In developing this thesis Margaret Gilbert argues in detail for joint commitment accounts of both agreements and promises. The final chapter explains the relevance of its argument to our understanding of human rights. Engaging where appropriate with contemporary rights theory, Gilbert provides an accessible route into this area for those previously unfamiliar with it.

He defends the view that this type of speech act is answerable to a constitutive norm--the norm of assertion. The hypothesis that assertion is answerable to a robustly epistemic norm is uniquely suited to explain assertion's philosophical significance--its connections to other philosophically interesting topics. These include topics in epistemology (testimony and testimonial knowledge; epistemic authority; disagreement), the philosophy of mind (belief; the theory of mental content), the philosophy of language (norms of language; the method of interpretation; the theory of linguistic content), ethics (the ethics of belief; what we owe to each other as information-seeking creatures), and other matters which transcend any subcategory (anonymity; trust; the division of epistemic labor; Moorean paradoxicality). Goldberg aims to bring out these connections without assuming anything about the precise content of assertion's norm, beyond regarding it as robustly epistemic. In the last section of the book, however, he proposes that we do best to see the norm's epistemic standard as set in a context-sensitive fashion. After motivating this proposal by appeal to Grice's Cooperative Principle and spelling it out in terms of what is mutually believed in the speech context, Goldberg concludes by noting how this sort of context-sensitivity can be made to square with assertion's philosophical significance.
