Download or read book Soft Law and Public Authorities written by Greg Weeks and published by Bloomsbury Publishing. This book was released on 2016-02-25 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book considers the phenomenon of soft law employed by domestic public authorities. Lawyers have long understood that public authorities are able to issue certain communications in a way that causes them to be treated like law, even though these are neither legislation nor subordinate legislation. Importantly for soft law as a regulatory tool, people tend to treat soft law as binding even though public authorities know that it is not. It follows that soft law's 'binding' effects do not apply equally between the public authority and those to whom it is directed. Consequently, soft law is both highly effective as a means of regulation, and inherently risky for those who are regulated by it. Rather than considering soft law as a form of regulation, this book examines the possible remedies when a public authority breaches its own soft law upon which people have relied, thereby suffering loss. It considers judicial review remedies, modes of compensation which are not based upon a finding of invalidity, namely tort and equity, and 'soft' challenges outside the scope of the courts, such as through the Ombudsman or by seeking an ex gratia payment.
Download or read book Law Lawyering and Legal Education written by Charles Sampford and published by Routledge. This book was released on 2016-10-04 with total page 430 pages. Available in PDF, EPUB and Kindle. Book excerpt: Once a highly cosmopolitan profession, law was largely domesticated by the demands of the Westphalian state. But as the walls between sovereign states are lowered, law is globalizing in a way that is likely to change law, lawyering and legal education as much over the next 30 years – when the students entering law schools today reach the peak of their profession – as it has over the last 300. This book provides a sustained investigation of the theoretical and practical aspects of legal practice and education, synthesizing and developing nearly thirty years of Professor Sampford’s critical thought, analysis and academic leadership. The book features two major areas of investigation. First, it explains the significance of the ‘critical’, ‘theoretical’ and ‘ethical’ dimensions of legal education and legal practice in making more effective practitioners – placing ethics and values at the heart of the profession. Second, it explores the old/new challenges and opportunities for ethical lawyers. Challenges include those for lawyers working in large organisations dealing with issues from international tax minimisation to advising governments bent on war. Opportunities range from the capacity to give client’s ethical advice to playing a key role in the emergence of an international rule of law as they had to the ‘domestic’ rule of law. The book should stimulate great interest and occasional passion for legal practitioners, students, teachers and researchers of law, lawyering, legal practice and legal institutions. Its inter-disciplinary approaches should be of interest to those with interests in education theory, international relations, political science and government, professional ethics, sociology, public policy and governance studies.

Download or read book Government Accountability written by Judith Bannister and published by Cambridge University Press. This book was released on 2023-06-30 with total page 613 pages. Available in PDF, EPUB and Kindle. Book excerpt: Government Accountability: Australian Administrative Law presents a thorough account of the administrative state and the mechanisms that exist to bring it to account for its actions. It contextualises the theory and explanation of administrative law through carefully chosen case studies and events that offer practical examples of the principles discussed and how they are applied. The third edition has been thoroughly updated to incorporate recent legal developments and includes expanded discussion of 'materiality' in the context of jurisdictional error. The examples used illustrate the operation of legal principles and reflect contemporary social and political circumstances. Written by a team of experts, and known for its clear, consistent and straightforward narrative with logical progression, Government Accountability remains a student-friendly guide to complex administrative law concepts. Government Accountability: Australian Administrative Law is accompanied by a casebook, Government Accountability Sources and Materials: Australian Administrative Law, which provides curated cases and primary legal materials with helpful commentary.
