The Australian banking system was more sheltered than a number of other countries and weathered the Global Financial Crisis relatively well. This was in part due to relative concentration of the system on a well performing domestic economy, but also due to a material contribution from a well-developed regulatory and supervisory structure. Notable strengths of the Australian supervisory approach rest in its strong risk analysis and on the focus of the responsibility of the Board. The Australian banking system however, is still vulnerable to continuing aftershocks of the financial crisis not least as banks? funding profiles could be a conduit of instability.

Book excerpt: Since the last Financial Stability Assessment Program (FSAP), the Australian Prudential Regulation Authority (APRA) has kept an active pace in implementing reforms to enhance the resilience of the Australian financial system. APRA has implemented key elements of the international regulatory reform agenda, at times going beyond the agreed minimum standards to provide additional resilience. APRA has focused on strengthening the capital framework, implementing Basel III liquidity standards, reinforcing sound mortgage lending standards, improving governance and accountability, and strengthening crisis management and preparedness. Since some of these reforms have not been fully completed, they remain on APRA’s priority agenda. Other broad policy reforms have been also enacted, including: a cross-industry risk management standard, a governance and risk management framework for conglomerates, and a phased approach to licensing. In addition to these policy developments, APRA has also taken steps to align its resources to evolving market needs. It has restructured its specialist risk and supervision teams to develop a new risk and data analytics function, bringing together specialists in statistics, industry analysis, and risk, to best harness this collective expertise. In accordance with its risk-based approach, APRA has also focused its supervisory activities more on reviewing banks’ practices and underwriting standards in the area of residential mortgages and commercial real estate lending, in addition to other risk areas.

The assessment of observance of each of the core principles follows a qualitative approach and is based on the core principles methodology document (October 1999). The assessment method consisted of examining the degree of observance of each of a principle's essential criteria and, where the assessors judged necessary, of the additional criteria. The assessment included a review of the relevant, legally non-binding instruments of the National Bank of the Republic of Belarus (NBRB) under the form of recommendations, the internal provisions of the NBRB, the licensing documents and the bank examination reports prepared by the NBRB, annual reports, the NBRB website, and other relevant material. The assessment is also based on the self-assessment prepared by the NBRB and discussions with staff in the banking supervision area, and with banks.

Supervisory risk assessments and guidance to auditors, as the extended supervisory arm of the Swiss Financial Market Supervisory Authority (FINMA), need to be further materially improved, beyond what is now envisioned. Additional skilled resources within FINMA are necessary to meet these goals and to conduct more on-site supervisory work. The responsibilities and objectives of FINMA that emphasize protecting creditors, investors and insured persons, as well as ensuring proper functioning of the financial market, should be clearly stated in legislation as pre-eminent. It is recommended to increase FINMA resources, especially for on-site inspection and risk expertise. Clarify and limit the cases in which the Board can become involved in supervisory decisions and improve conflict code.

Book excerpt: This assessment of the current state of the implementation of the Basel core principles (BCP) for effective banking supervision in Bulgaria has been completed as a stand-alone report on the observance of standards and codes undertaken by the international monetary fund (IMF) and the World Bank during March of 2015 at the request of the Bulgarian authorities. It reflects the regulatory and supervisory framework in place as of the date of the completion of the assessment. The Bulgarian National Bank (BNB) has an internal governance structure which, by vesting the majority of the powers of supervision in the Deputy Governor for banking supervision, exposes the supervisory function to risks. Under the BNB's legal structure, supervision and enforcement is dissociated from the Governing Council, and the Governing Council has no right to compel transparency of decision making or to impose a framework to ensure consistency in the use of the enforcement regime. There are material concerns that the BNB is too resource constrained to deliver effective minimum levels of supervision. Despite a broad range of supervisory powers, there are some gaps in the legal framework that unduly restrict the BNB's locus. The BNB has a good understanding of risk and many strong practices, and also making good use of international standards and guidelines, but there are some important system wide vulnerabilities. The assessment team reviewed the framework of laws, rules, and guidance and held extensive meetings with officials of the BNB, and additional meetings with the Finance Ministry, auditing firms, professional bodies, and banking sector participants. The authorities provided a comprehensive self-assessment of the CPs, as well as detailed responses to additional questionnaires, and facilitated access to supervisory documents and files on a confidential basis as well as staff and systems.
