This study is the first comprehensive analysis of the extent of informality and its implications for a durable economic recovery and for long-term development. It finds that pervasive informality is associated with significantly weaker economic outcomes--including lower government resources to combat recessions, lower per capita incomes, greater poverty, less financial development, and weaker investment and productivity.

It also offers a unique analysis of the conditions under which these movements succeed or fail. Drawing from 300 interviews with informal workers, government officials and union leaders, Rina Agarwala argues that Indian informal workers are using their power as voters to demand welfare benefits from the state, rather than demanding traditional work benefits from employers. In addition, they are organizing at the neighborhood level, rather than the shop floor, and appealing to 'citizenship', rather than labor rights.

Such a call by the ILO is urgent in the context of countries such as India, where the majority of workers are engaged in informal economic activities, and where expansion of informal economic activities is coupled with deteriorating working conditions and living standards. This book explores the informal economic activity of India as a case study to examine typical requirements in the work-lives of informal workers, and to develop a means to institutionalise the promotion of these requirements through labour law. Drawing upon Amartya Sen’s theoretical outlook, the book considers whether a capability approach to human development may be able to promote recognition and work-life conditions of a specific category of informal workers in India by integrating specific informal workers within a social dialogue framework along with a range of other social partners including state and non-state institutions. While examining the viability of a human development based labour law in an Indian context, the book also indicates how the proposals put forth in the book may be relevant for informal workers in other developing countries. This research monograph will be of great interest to scholars of labour law, informal work and workers, law and development, social justice, and labour studies.

Several reports on the informal sector appeared during this period, and the status of the sector in India is positioned in the context of this international scenario. The major debate concerns the definition of this sector. While international labour statisticians had suggested a mechanism of definition and measurement of the sector, Indian official statistics took a different approach. The book analytically elaborates the different definitions and measurement controversies in different countries and contextualises the official Indian position. While deliberating on the size, contribution, productivity, and potential of the informal sector, the heterogeneity and decomposition of the sector with respect to these aspects are also suggested. The book develops a political economic interpretation of the historical transition of the informal sector in India, employing heterodox economics as a theoretical basis, with a critical note on standard neoclassical economic analysis. The final part of the book focuses on understanding the development of capitalism in the country under neoliberalism, as that development is crucial to understanding the informal sector in any country, and particularly in India. Informal employment in unregistered enterprises or of workers without employment contracts or social protection contributions constitutes 88 per cent of employment in India and is a ubiquitous feature of the economy. A large proportion of informal employment (86 per cent) is self-employment and this category of employment has been neglected in the literature on work and development which has focused instead on wage employment that is a contract for work with another person or enterprise. Another striking feature of such economies which the book engages with is that, as they have liberalized, informal employment in the registered enterprises or formal part of the economy has grown. The informal sector has been analyzed by recourse to two major approaches. One is a public economics framework that underlines how informal enterprises evolve as they trade-off reduced access to public services such as contract enforcement with the payment of taxes and regulatory compliances. This book extends this literature by focusing on the access to formal sector credit and its potential for financing productive enterprises as a factor that is considered when an enterprise contemplates whether to incorporate or not. The second leg of the literature takes a labour perspective and emphasizes mandated labour costs such as hiring and firing costs, benefits, and minimum wages as considerations when deciding on whether to engage labour on a formal or informal basis. The book broadens this literature by taking into account how the human capital of workers and the monitoring costs of ensuring that workers are adhering to the terms of negotiated contracts inform the decision with regard to informality. The book will resonate with those academics and policy makers who are engaged with the conundrums of development.

It looks at the growth of informal labour in Bangalore, Mumbai and New Delhi during an era of neoliberal economic policymaking. Going beyond mainstream accounts, it argues that India’s rapid economic development has been based upon the mass employment of workers on low wages who lack basic social protection and rights at work. It discusses how urban development in India is characterised by a combination of industrialisation, industrial relocation, restructuring and informalisation. Departing from some existing studies of de-industrialisation, it re-frames informalisation as a process that complements, rather than contradicts, contemporary industrialisation in rapidly-emerging economies. The book adopts a ‘classes of labour’ approach, classifying each case of informal labour as a specific ‘form of exploitation’: as a different way for employers to lower production costs, control workers and increase enterprise flexibility. Beginning his local-level research in two villages in south Gujarat, the author discusses the mobilisation of casual labour, which is hired and fired according to the need of the moment, and transferred for the duration of the job to destinations far away from the home area. His case-study reveals that the circulation of labour is indicative of an employment pattern which dominates both the rural and urban economy of large parts of South Asia. Elaborating on the social profile of the work migrants, the author argues that their identity is shaped by both class and caste relations and, despite action by state agencies, nothing of significance has been achieved to improve their quality of life.
