Book excerpt: This book fills a significant lacuna in our understanding of the refugee crisis by analyzing the dynamics that lie behind fifteen years of asylum policies in the European Union. It sheds light on why cooperation has led to reinforced refugee protection on paper but has failed to provide it in practice. Offering innovative empirical, theoretical and methodological research on this crucial topic, it argues that the different asylum systems and priorities of the various Member States explain the EU's lack of initiative in responding to this humanitarian emergency. The author demonstrates that the strong regulators of North-Western Europe have used their powerful bargaining positions to shape EU asylum policies decisively, which has allowed them to impose their will on Member States in South-Eastern Europe. These latter countries, having barely made a mark on EU policies, are now facing significant difficulties in implementing them. The EU will only identify potential solutions to the crisis, the author concludes, when it takes these disparities into account and establishes a functioning common refugee policy. This novel work will appeal to students and scholars of politics, immigration and asylum in the EU.

In On the Doorstep of Europe, Heath Cabot presents an ethnographic study of the asylum system in Greece, tracing the ways asylum seekers, bureaucrats, and service providers attempt to navigate the dilemmas of governance, ethics, knowledge, and social relations that emerge through this legal process. Centering on the work of an asylum advocacy NGO in Athens, Cabot explores how workers and clients grapple with predicaments endemic to Europeanization and rights-based protection. Drawing inspiration from classical Greek tragedy to highlight both the transformative potential and violence of law, Cabot charts the structural violence effected through European governance, rights frameworks, and humanitarian intervention while also exploring how Greek society is being remade from the inside out. She shows how, in contemporary Greece, relationships between insiders and outsiders are radically reconfigured through legal, political, and economic crises. The analysis builds on the understanding of socio-cultural, institutional and legal factors as “barriers” or “enablers”; elements that may facilitate or obstruct the integration processes. The book examines the two dimensions of integration being access to the labour market (which, translated into a rights language means the right to work) with its corollaries (recognition of qualifications, vocational training, etc.), and non-discriminatory working conditions (which, translated into a rights language means right to both formal and substantial equality) and its corollaries of benefits and duties deriving from joining the labour market. It thereby offers a novel approach to labour market integration and migration/asylum issues given its focus on legal aspects, which includes most recent policy changes and legal decisions (including litigation cases). The robust, evidence-based and comparative research illustrated in the book provides academics and students, but also practitioners and policy makers, with up to date knowledge that will likely impact positively on policy changes needed to better address integration conundrums.

Unfortunately, few of these discussions and measures consider the structural root causes and dynamics of migration, the motives of migrants or societal challenges more thoroughly. This book seeks to address this deficit. Taking migration and asylum policies as a starting point, it analyses the various dimensions underpinning migration. In doing so, it identifies why receiving countries are in many ways part of the problem. In the last decade the European Union has increasingly engaged with children’s rights, with the entry into force of the Lisbon Treaty in December 2009, and a new Article 3(3) of the Treaty on European Union that commits the Union to promoting the ‘protection of the rights of the child.’ This book addresses the question of whether the Common European Asylum System (CEAS) complies with the rights of the child. It contrasts the normative standards of international child rights law with the treatment of child asylum seekers and refugees in the CEAS. Ciara Smyth identifies the attributes of the rights of the child that are most relevant to the asylum context and systematically examines whether and to what extent those attributes are reflected in the CEAS legislation. The book goes on to assess whether the CEAS instruments direct Member States to comply with the rights of the child, offering a comprehensive examination of the place of the child within European asylum law and policy.
