Book excerpt: L'individuazione di settori del diritto che, per la loro autonomia, rilevanza quantitativa, chiara identificazione del loro contenuto sulla base dell'automatico collegamento con un concetto base ed interesse scientifico siano tali da tali da giustificarne la considerazione come branche specifiche, con ogni conseguenza, compete agli studiosi, ma, se concorde e consolidata, finisce per essere recepita dal legislatore. In passato, più che di diritto di famiglia, si è parlato di matrimonio e filiazione, riconoscendo implicitamente in essi un comune denominatore riconducibile alla famiglia, capace a sua volta di attrarre nella sua sfera altri argomenti, non sempre identificati con unanime giudizio. In ragione di ciò, il nostro codice non contiene un libro dedicato al diritto di famiglia, ma unisce, nel primo, materie genericamente collegate alla famiglia, con materie attinenti alla persona, sia fisica che giuridica, collegandosi poi, tramite il concetto di tutela dei minori, all'interdizione per infermità di mente. Attualmente sono maturate le condizioni perché il Diritto di famiglia sia pienamente riconosciuto, non solo come autonoma branca del diritto, ma come una delle più importanti, nella quale sono in atto percorsi evolutivi, in grado, attraverso l'interrelazione che esiste tra giuridico e sociale, di influire profondamente sulla società e sulla vita dei cittadini. Dopo la nascita, il diritto di famiglia «è cresciuto» non solo attraverso nuove tappe legislative, come la modifica delle disposizioni sul divorzio (1987), la modifica del Concordato (1984), le leggi di modifica dell'adozione internazionale e nazionale e la rivoluzionaria riforma dell'affido condiviso (2006), ma soprattutto attraverso le ulteriori evoluzioni sociali, culturali e giurisprudenziali. Numerosi problemi sono sorti nell'interpretazione delle nuove normative, dando luogo a studi ed elaborazioni che hanno arricchito il complessivo panorama del diritto e della giurisprudenza attuali, ma è anche la parte del diritto di famiglia ancora da scrivere (o da riscrivere) che ha suscitato le discussioni più accese ed è de iure condendo che la materia determina attualmente un particolare interesse, anche in ambito extragiuridico. È noto a tutti che il legislatore italiano non è ancora riuscito a sciogliere nodi quali, ad esempio, quelli relativi alla disciplina delle coppie di fatto (ivi comprese le coppie composte da persone dello stesso sesso), al completamento della tutela dei figli naturali, alla cosiddetta diaspora delle competenza in materia di minori, alla modernizzazione del procedimento di separazione e divorzio. In ragione di quanto si è detto, si può affermare che nel diritto di famiglia rientrano e vengono esaminati nell'opera: il matrimonio, con conseguenti sottoripartizioni relative alla formazione del vincolo ed alla disciplina dei rapporti tra i coniugi, di carattere personale e patrimoniale; la famiglia "di fatto", per la stretta analogia di contenuti con il rapporto matrimoniale; la filiazione, senza distinzione tra l'ambito legittimo e quello naturale di essa, perché il rapporto genitoriale è componente della branca in via diretta, e non perché collegato al matrimonio; la separazione tra i coniugi ed il divorzio, in quanto hanno ad oggetto il momento di affievolimento e cessazione dei rapporti matrimoniali, che non devono essere disciplinati solo nel loro essere, ma anche nel loro divenire; la disciplina giuridica della parentela, perché consiste nell'identificazione e qualificazione dei legami di famiglia; le successioni degli eredi legittimi e dei legittimari, perché trovano nel concetto di famiglia la loro giustificazione. Devono essere altresì considerati argomenti del diritto di famiglia la tutela dei minori, per il collegamento con il concetto di filiazione, di cui rappresentano una prosecuzione, e con il concetto di famiglia, perché determinata da una mancanza di essa; la potestà genitoriale, che generalmente si esplica ed è strettamente collegata alla filiazione; la disciplina degli alimenti, nella parte in cui ha fonte dai rapporti familiari; la disciplina dello stato civile, nella parte in cui si occupa dei predetti rapporti. Devono ancora identificarsi come parti del diritto di famiglia le normative relative alla maternità ed all'interruzione della gravidanza, strettamente collegate al capitolo filiazione ed al concetto di genitorialità, anche intesa come facoltà di negare la stessa, nonché le norme relative alla procreazione assistita, intesa come fattore generativo della filiazione. Altre parti del diritto di famiglia ampiamente inteso potrebbero essere individuate nel diritto penale, internazionale, ecclesiastico o amministrativo, in relazione alle parti che, in tali materie, si occupino di famiglia o per le quali siano applicabili i criteri di collegamento indicati.
