Book The Court of Arbitration for Sport

Download or read book The Court of Arbitration for Sport written by I. S. Blackshaw and published by T.M.C. Asser Press. This book was released on 2006-03-02 with total page 610 pages. Available in PDF, EPUB and Kindle. Book excerpt: I am very pleased and proud to write the Foreword to this Book on the occasion of the Court of Arbitration for Sport (CAS) having completed its first twenty years of operations. And I warmly congratulate the ASSER International Sports Law Centre and the Editors, Ian Blackshaw, Rob Siekmann and Janwillem Soek – in cooperation with Andrew Gibson, Griffith University, Brisbane, Australia, and Steve Cornelius, University of Johannesburg, South Africa –, on their joint initiative in putting together and publishing this Book. The CAS has come a long way since the idea of establishing it was first mentioned by Juan Antonio Samaranch, the former IOC President. His vision and confidence in its future have been truly vindicated. Since its creation and up to 31 December 2003, 576 cases have been submitted, of which 550 were requests for arbitration and 26 for an advisory opinion. In 2004, there was a sharp rise in the number of cases handled by the CAS and this trend continues apace. Thus, the CAS goes from strength to strength and has a great future, having, in the words of the Swiss Federal Tribunal in its landmark judgement of 27 May 2003, “built up the trust of the sporting world [and] . . . now widely recognised . . . [as] . . . one of the principal mainstays of organised sport.

Book The New Turkey

Download or read book The New Turkey written by Chris Morris and published by Granta Books. This book was released on 2014-05-01 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: Updated since the decision to begin Turkey's admission to the European Union. Turkey is a country in a state of flux, swept along by an extraordinary process of change. In the last few years, a series of far-reaching political and economic reforms has swept away much of the old order which ruled the country for so long. Some people call it a second Turkish revolution. But resistance to reform remains strong. Pressure for change has come from ordinary people fed up with the old ways; it's also been motivated by the dominant issue of Turkish political life - the long pursuit of membership of the European Union. And yet Turkey remains a mystery to many outsiders; a complex country hard to understand. It's secular and Muslim, Western and Eastern, democratic and authoritarian, all at the same time. This book examines the potential and the problems of the new Turkey, and the expectations of the people who live there, drawing on first-hand interviews and observations gathered over several years.

Book Democracy Challenged

Download or read book Democracy Challenged written by Marina Ottaway and published by Carnegie Endowment. This book was released on 2013-01-25 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: During the 1990s, international democracy promotion efforts led to the establishment of numerous regimes that cannot be easily classified as either authoritarian or democratic. They display characteristics of each, in short they are semi-authoritarian regimes. These regimes pose a considerable challenge to U.S. policymakers because the superficial stability of many semi-authoritarian regimes usually masks severe problems that need to be solved lest they lead to a future crisis. Additionally, these regimes call into question some of the ideas about democratic transitions that underpin the democracy promotion strategies of the United States and other Western countries. Despite their growing importance, semi-authoritarian regimes have not received systematic attention. Marina Ottaway examines five countries (Egypt, Azerbaijan, Venezuela, Croatia, and Senegal) which highlight the distinctive features of semi-authoritarianism and the special challenge each poses to policymakers. She explains why the dominant approach to democracy promotion isn't effective in these countries and concludes by suggesting alternative policies. Marina Ottaway is senior associate and codirector of the Democracy and Rule of Law Project at the Carnegie Endowment.

Download or read book Sports Law written by Michael Beloff and published by Hart Publishing. This book was released on 1999-11-10 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sports law has been growing rapidly over the last few years, regularly making headlines as well as leading to a developing body of law practised by specialist lawyers. This new work, by leading practitioners in the field, is the first to provide a coherent framework for understanding the law in this area, as well as a deep analysis of its key features. The subject can be split into various areas of practice. For example regulatory rules, which cover what can be described as the constitutional aspect of organised sport (this includes the enforcing of regulatory codes and the disciplinary procedures of the various sport governing organisations). Second, broadcasting and marketing which covers the revenue generated by the commercial exploitation of sports clubs, sporting events and players. This area has grown rapidly following the huge infusion of finance from television and corporate sponsorship into a growing number of sports. A third area is player representation, which focuses on the players and includes a broad range of legal issues including club transfers and player contracts (including the famous Bosman ruling), employment advice, personal injury litigation, disciplinary tribunals, discrimination law and remedies in the courts. The audience is solicitors and barristers, legal advisers to sports organisations and clubs, legal advisers to corporations and media companies, academics teaching sports law, sports administrators and law libraries.

This book not only contains the worked out contributions of this Conference, but also other related chapters on the subject. The judgement of the European Court of Justice settled the European dimension of the dispute. The landmark decision made by the European Court applies to all professional players who are nationals of member states and active in the European Union, and also covers EFTA countries. Book Global Law Without a State

  • Publisher : Dartmouth Publishing Company
  • Release : 1997
  • ISBN :
  • Pages : 344 pages

Download or read book Global Law Without a State written by Gunther Teubner and published by Dartmouth Publishing Company. This book was released on 1997 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work deals with legal pluralism in an emerging world society. It central thesis is that globalization of law tends to create a decentred law-making process which occurs in multiple sectors of civil society, independently of nation states. Technical standardization, professional rule production, human rights, intra-organizational regulation in multinational enterprises, contracting, arbitration and other institutions of lex mercatoria are forms of rule by private governments, claiming world-wide validity independently of the law of the nation states. They have come into existence not by formal acts of nation states but by strange paradoxical acts of self-validation.

Available in PDF, EPUB and Kindle. Book excerpt: I am honoured to have been invited to write the foreword to this book. Since the publi- tion of Professional Sport in the EU: Regulation and Re-regulation (edited by Andrew Caiger and Simon Gardiner, T.M.C. Asser Press 2000), there have been a number of dev- opments in the European Union in sports law, both in the European Commission and the European Court of Justice. The most significant of these was probably the adoption by the Commission of the White Paper on Sport on 11 July 2007. The White Paper takes stock of the acquis communautaire – the rather prodigious body of European Law including judgements and preliminary rulings of the ECJ – in the sports field and sets out the position of the Commission on three significant aspects of European sport: its societal role, its economic dimension, and its governance. The White Paper also contains concrete proposals for further EU action as part of an Action Plan named after Pierre de Coubertin, the founder of the modern Olympic Games.

Download or read book The Law of the Olympic Games written by Alexandre Miguel Mestre and published by T.M.C. Asser Press. This book was released on 2009-12-17 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: I am deeply honoured and very pleased indeed to have been invited to write the Foreword to this book, especially as the great success of and excitement generated by the Beijing Olympics last Summer is still fresh in all our minds! This is the first work on this important subject – the Olympic Games having been well described as ‘the greatest sporting show on earth’ – and the author, Alexandre Miguel Mestre, a distinguished Portuguese international sports lawyer, is to be warmly congratulated on producing it. The book covers the historical development of ‘Olympic Law’ and the current legal status of the International Olympic Committee (IOC) as an NGO (non-g- ernmental organisation) under Public International Law, and its various constituent members and organs. The UN resolutions on the Olympic Truce of which the latest one is published in the book, are of a recommendatory nature (‘soft law’), but well illustrate the wide range of international legal instruments, which constitute the corpus of so-called ‘Olympic Law’, including the inter-State Nairobi Treaty on the Protection of the Olympic Symbol – the famous five interconnected rings. The book also addresses some contemporary legal issues affecting the Olympic Movement, including eligibility criteria, dual participation in the Olympics and the Paralympics as well as environmental concerns and the protection of the so-called ‘Olympic Properties’ – in other words the valuable intellectual property rights of the IOC including TV rights – without which the Olympic Games could not be financed and staged.
