Over a period of almost fifty years, the United Nations Educational, Scientific and Cultural Organisation has adopted five international conventions that attempt to protect this cultural heritage. This book comprehensively and critically considers these five UNESCO cultural heritage conventions. The book looks at the conventions in the context of recent events that have exposed the dangers faced by cultural heritage, including the destruction of cultural heritage sites in Iraq and the looting of the Baghdad museum, the destruction the Buddhas of Bamiyan in Afghanistan, the salvage of artefacts from the RMS Titanic and the illicit excavation and trade in Chinese, Peruvian and Italian archaeological objects. As the only existing work to consider all five of the cultural heritage conventions adopted by UNESCO, the book acts as an introduction to this growing area of international law. However, the book does not merely describe the conventional principles and rules, but, critically evaluates the extent to which these international law principles and rules provide an effective and coherent international law framework for the protection of cultural heritage. While the role of foreign travellers and scholars dedicated to the study of South America's pre-Columbian past is well documented, historians have largely overlooked the knowledge gathered and the collections formed among collectors of antiquities, antiquaries, and archaeologists born or living in South America during this period. The landed gentry, the clergy, and an urban bourgeoisie of doctors, engineers, and military officials put antiquities on display in their private mansions or bestowed them upon the public museums that were being formed by municipalities and governments in Santiago de Chile, Cuzco, or Lima. Men, and some few women, gathered antiquities on their journeys 'inland' and during sociable weekend excursions, but also on quotidian commercial voyages or in military campaigns. They bartered antiquities with their fellow collectors or haggled about their price on the antiquities market. In their hours of leisure, they marvelled at them, wrote about them, and disputed over their meaning, age, and interest in learned societies, informal gatherings, and at meetings in universities and public museums. This volume unveils a hitherto largely unknown world of antiquarian and archaeological collecting and learning in Peru and Chile.

The Second International Conference on Facts and Evidence: A Dialogue between Law and History was jointly organized by the CICJC, the Institute of Evidence Law and Forensic Science (ELFS) at China University of Political Science and Law (CUPL), and Peking University School of Transnational Law (STL) in Shenzhen, China, on November 16–17, 2019. Historians, legal scholars and legal practitioners share the same interest in ascertaining the “truth” in their respective professional endeavors. It is generally recognized that any historical study without truthful narration of historical events is fiction and that any judicial trial without accurate fact-finding is a miscarriage of justice. In both historical research and the judicial process, practitioners are invariably called upon, before making any arguments, to prove the underlying facts using evidence, regardless of how the concept is defined or employed in different academic or practical contexts. Thus, historians and legal professionals have respectively developed theories and methodological tools to inform and explain the process of gathering evidentiary proof. When lawyers and judges reconsider the facts of cases, “questions of law” are actually a subset of “questions of fact,” and thus, the legal interpretation process also involves questions of “historical fact.” The book brings together more than twenty leading history and legal scholars from around the world to explore a range of issues concerning the role of facts as evidence in both disciplines. Case studies embrace not just archaeological finds, but also archival field notes, photographic media, archaeological samples, and replicas.
