Book Apportionment of liabilities following maritime collision

Download or read book Apportionment of liabilities following maritime collision written by Akash Rana and published by GRIN Verlag. This book was released on 2015-06-29 with total page 53 pages. Available in PDF, EPUB and Kindle. Book excerpt: Master's Thesis from the year 2014 in the subject Law - Miscellaneous, grade: Merit, University of Southampton, course: Masters of Shipping & Maritime Law, language: English, abstract: The most distinguishing and important characteristic of sea transport is a great value possible to carry on-board each ship. Maritime commercial trade I believe is one of the most international industry in itself. A ship registered in one country; owner could be from another country; master and crew could be from third country, carrying cargo of the owners from fourth country, transiting different waters and carrying out commercial activity in other country's judicial boundaries. This makes it unarguably an industry that deals with legislation from so many different jurisdictions. And hence the uniformity in all these various legislation seeks a right balance. Which I feel that, unfortunately, the right balance between this various maritime legislation is still yet to be achieved.

Book Allocation of Liability for Dangerous Goods Under International Trade Law

Download or read book Allocation of Liability for Dangerous Goods Under International Trade Law written by Ahmet Gelgec and published by . This book was released on 2022 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book explores the allocation of risk and liability of dangerous goods between the seller and the buyer under CIF (Cost, Insurance and Freight) and FOB (Free on Board) contracts, providing an in-depth study of the issue of carriage of dangerous goods in the context of international trade law. In addition to offering specific solutions to issues arising in the context of the contract of sale, the book provides a non-contractual angle, putting forward suggestions under non-contractual mechanisms. Importantly, the book incorporates case law examples from the Commonwealth and the US. Dangerous goods that are carried by sea carry with them potential risks of losses and damages to the vessel, other cargoes and lives on board. The allocation of liability arising out of the carriage of dangerous goods has recently attracted unwelcome attention because of mis-declared cargoes leading to fires on board ships. Thus the book fills a gap in the literature by addressing the issue in detail with examples from multiple jurisdictions, and proposing solutions. In particular, the book analyses whether and to what extent the law of international sale of goods can provide any assistance in the re-allocation of liability between the buyer and the seller. This book will be of great interest to all those involved in the research as well as legal practice of international trade law and carriage of goods by sea law."--

Book Maritime Law and Practice in Nigeria

Download or read book Maritime Law and Practice in Nigeria written by Dr. Collins O. Chijioke and published by AuthorHouse. This book was released on 2016-08-05 with total page 565 pages. Available in PDF, EPUB and Kindle. Book excerpt: About the Book Paucity of literature in the area of maritime law in Nigeria was what motivated the author to embark on this project and as such this book is the authors attempt to contribute to the bridging of the gap in knowledge in this area of the law. This book is written in simple and understandable English to ensure fluidity of reading. It is presented in such a way as to provide information in the areas of commercial law, carriage of goods by sea, maritime law as well as practical steps in maritime law litigation and related actions. Particular consideration has been given to the study of carriage of dangerous goods by sea, a subject which existing legal literature in Nigeria merely mentioned in passing. Suffice it to say that this book is the first Nigerian legal literature that has explored that subject, taking into consideration our domestic laws and international treaties; most of which are yet to be ratified and domesticated in Nigeria. Though the work has Nigeria as its geographical location it has discussed the subject with comparative analysis of contemporary development in some areas of maritime law; with special reference to the United Kingdom and the United States. It is the authors belief that this book, apart from providing practical guide to maritime litigation in Nigeria, would also serve as veritable tool for teaching and studying of maritime law and related courses in Nigerian Universities and other territory institutions and would be immeasurably useful to legal practitioners, members of the bench an research fellows.
