It is alleged that they are usually abused by small group of producers to protect their monopoly or to protect their cartel prices. India after liberalisation of its economy has become one of the leading users of antidumping measures. Indian use of antidumping measures are being critcised on the same lines on which antidumping measures are generally criticised. Through the anaysis of 150 sample cases the author finds that the criticism is not justified. In addition to it antidumping measures have to be analysed in the general economic policy background of the country. The book attempts to do the same and concludes that although there are very few cases in which antidumping measrues were sought for protectionist purposes, in genreal Indian domestic industry has been vulnerable when it sought the protection of antidumping measures. Antidumping measrues in a way are a tool to regularly check market distortions before these distoritions become serious enough to attract the notice of the competition authority. These measures also help in maintenenace of trade on MFN basis as dumped products as much hurt imports from other sources as they hurt the domestic industry.

The Canadian legislation was soon followed by similar legislation in most of the major trading nations in the industrialised world prior to and after World War I. Anti-dumping provisions were later incorporated into the General Agreement on Tariffs and Trade (GATT) following World War II. Nowadays, virtually all of the industrialised and developing countries in the world economy have adopted anti-dumping legislation. In view of the long and increasingly widespread use of anti-dumping measures, we marked the centennial of Canada's 1904 legislation with a symposium at the University of Michigan on 12 March, 2004. The symposium papers document the experiences with anti-dumping and then ask whether and how anti-dumping can be reformed. Although we all would probably agree that the best solution would be to retract all anti-dumping legislation, this is unlikely to happen in the foreseeable future. Anti-dumping laws serve a variety of purposes, and powerful political forces stand in the way of eliminating these laws. Anti-dumping provides a stronger and more focused means of safeguards protection against surges of imports than GATT-legal safeguards laws permit. Anti-dumping also formalises a meaning for 'unfair trade' that, though essentially meaningless from an economic standpoint, strikes a chord in public perception. And finally, in spite of its appearance of being constrained by objective administrative rules, anti-dumping in practice is a potent political tool that governments are able to manipulate in order to satisfy powerful constituents. With all this going for it, anti-dumping is unlikely ever to be relinquished as an economic policy tool by governments.

Book excerpt: The U.S. antidumping law suffers from a series of defects in its implementation, resulting in the unwarranted finding of illegal predatory pricing by foreign companies. In light of the existing technical flaws outlined in this Article, it is clear that the U.S. antidumping law is merely a form of protectionism, designed to serve the interests of domestic industry at the expense of consumers.This article briefly profiles the U.S. antidumping law in light of the U.S.-Korean trade experience. Section 2 provides background information on the U.S. antidumping law. Section 3 discusses the current U.S.-Korean trade policy. Section 4 analyzes some of the shortcomings of the U.S. law, using the U.S. relationship with Korea as a model for understanding these problems. Section 5 discusses the threat that the existing antidumping law poses as a means of harassing foreign producers. Section 6 addresses the effects of antidumping that are often overlooked by policy makers. In light of both the protectionist nature of the statute as well as the defects in the implementation of the statute, this article concludes that a reexamination of the U.S. antidumping law is necessary, and that an outright repeal should be considered.
