Book Agencies Believe Strengthening International Agreements to Improve Collection of Antidumping and Countervailing Duties Would Be Difficult and Ineffective

Download or read book Agencies Believe Strengthening International Agreements to Improve Collection of Antidumping and Countervailing Duties Would Be Difficult and Ineffective written by Loren Yager and published by DIANE Publishing. This book was released on 2009-03 with total page 24 pages. Available in PDF, EPUB and Kindle. Book excerpt: The U.S. and its trading partners have enacted laws to remedy the unfair trade practices of other countries that cause injury to domestic industries. U.S. law authorizes the imposition of additional duties on importers to remedy these unfair trade practices. Antidumping (AD) duties are imposed on imports that are ¿dumped¿ in the U.S. and countervailing (CV) duties are imposed on imports that are subsidized by foreign governments. Over $600 million in AD/CV duties has been uncollected. This report describes agencies¿ views on: (1) obstacles (if any) to strengthening internat. agree. (IA) to help the U.S. collect AD/CV duties from importers without attachable assets in the U.S.; and (2) whether strengthened IA would improve duty collection. Illus.

Book Anti Dumping AD and Countervailing Duties CV

Download or read book Anti Dumping AD and Countervailing Duties CV written by Loren Yager and published by DIANE Publishing. This book was released on 2011-09 with total page 14 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since FY 2001, the fed. gov¿t. has been unable to collect over $1 billion in AD and CV imposed to remedy injurious, unfair foreign trade practices. These include AD duties imposed on products exported to the U.S. at unfairly low prices (i.e., dumped) and CV duties on products exported to the U.S. that were subsidized by foreign governments. These uncollected duties show that the U.S. gov¿t. has not fully remedied the unfair trade practices for U.S. industry and has lost out on a substantial amount of duty revenue to the U.S. Treasury. This statement summarizes key findings from prior reports on: (1) past initiatives to improve AD/CV duty collection; and (2) additional options for improving AD/CV duty collection. This is a print on demand report.

Available in PDF, EPUB and Kindle. Book excerpt: Opportunities and Obligations: New Perspectives on Global and U.S. Trade Policy, is an extraordinary collection of essays by leading trade officials, academic experts, and major stakeholders. The essays are divided into three topics: The global trading system and its future direction The range of views presented provides diverse perspectives on the future direction of the trading system, the challenges of the Doha Round, the aspirations of developing countries within the system, the future direction of rules, rights and obligations, the challenges faced by countries trying to join the WTO. Perspectives on the direction of US trade policy Leaders from the past Administration, both sides of the aisle in the U.S. House of Representatives, labor, business, a leading NGO as well as leading journalists and writers offer views about where U.S. trade policy should go to secure America’s economic future. The global food crisis and how the trading system can help be part of the solution The run up of food prices internationally in 2007-08 and the efforts by many countries to restrict exports in the name of providing for citizens at home created some severe challenges for the global institutions and raised, within trade circles, the question of how trade could make a contribution to the alleviation of hunger and not exacerbate the problems of hunger. Papers in part three of the book look at the issue from the perspective of the WTO, the European Commission, and the United Nation’s World Food Program.

Download or read book The WTO Case Law of 2008 written by Henrik Horn and published by Cambridge University Press. This book was released on 2010-04-15 with total page 281 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book brings together the 2008 output of the American Law Institute (ALI) project on World Trade Organization Law. Each chapter focuses on a different dispute from the adjudicating bodies of the WTO. Each case is jointly evaluated by well known experts in trade law and international economics. ALI reporters critically review the jurisprudence of WTO adjudicating bodies and evaluate whether the ruling 'makes sense' from an economic as well as a legal point of view, and, if not, whether the problem lies in the interpretation of the law or the law itself. The studies do not always cover all issues discussed in a case, but they seek to discuss both the procedural and the substantive issues that form, in the reporters' views, the 'core' of the dispute. This paperback will be an invaluable resource for students, lecturers and practitioners of international trade law.

Book Guide to International Anti Dumping Practice

Download or read book Guide to International Anti Dumping Practice written by Derk Bienen and published by Kluwer Law International B.V.. This book was released on 2013-09-01 with total page 704 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the first to bring together the actual practices and procedures in all the major users of anti-dumping. The countries surveyed include all the so-called ‘traditional’ users (Australia, Canada, the EU, New Zealand, South Africa, and the United States) as well as the leading ‘new’ users (Argentina, Brazil, China, India, Korea, Mexico, and Turkey). The book provides not only an overview of each of the systems considered but also a detailed reference to the way different jurisdictions have handled specific issues. In addition, the structure for each chapter is virtually identical, allowing for a ready comparative analysis of various topics. These topics include the following: ; applicable legislation, regulations, prescribed guidelines and procedures; decision-making process and time-line; the likelihood of an investigation leading to the imposition of measures; statistics 1995–2011 with details of actual investigations and duties imposed; threshold of injury and calculation of non-injurious price; establishment of causal link; verification reports, hearings, access to information, and other procedural issues; reviews and refunds; and anti-circumvention measures. An introductory chapter provides a comparative statistical analysis of the use of anti-dumping by the thirteen countries, highlighting key features of anti-dumping systems in a comparative way. The introduction also assesses the important impacts of China’s accession to the WTO in 2001 and of the economic and financial crisis of 2008–2009, discusses the treatment of non-market economies, and notes emerging tendencies in anti-dumping reform. This is an invaluable work on a key area in trade (and competition) law, written by a team of well-known experts. With its comprehensive and practical format, the book will be of great interest to practitioners dealing with anti-dumping cases, including trade law practitioners who may have to defend anti-dumping cases in different jurisdictions, attorneys in international trade law and competition law, government officials, academics, and researchers.

Book Antidumping and Countervailing Duties

Download or read book Antidumping and Countervailing Duties written by United States. Government Accountability Office and published by . This book was released on 2016 with total page 94 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United States assesses AD duties on products imported at unfairly low prices (i.e., dumped) and CV duties on products subsidized by foreign governments. Nonpayment of AD/CV duties means the U.S. government has not fully remedied unfair trade practices and results in lost revenue. GAO was asked to review CBP’s efforts to improve the collection of AD/CV duties. This report (1) examines the status and composition of uncollected AD/CV duties, (2) the extent to which CBP has taken steps to improve its collection of such duties, and (3) the extent to which CBP assesses and mitigates the risk to revenue from potentially uncollectible AD/CV duties. GAO recommends that CBP (1) issue guidance to collect and analyze data on a regular basis to find and address the causes of AD/CV duty liquidation errors and track progress; (2) regularly conduct a comprehensive risk analysis that considers likelihood as well as significance of risk factors related to duty nonpayment; and (3) take steps to use its data and risk assessment strategically to mitigate AD/CV duty nonpayment consistent with U.S. law and international trade obligations.
