Corrupt practices, their causes, and effects vary from country to country. Similarly, the approaches to anti-corruption reforms, their design, and implementation practice differ in different country contexts. While the causes of corruption and their effect on the quality of governance are widely explored, the mechanisms that might influence and determine the functionality and effectiveness of anti-corruption reforms remain an underexplored subject in social sciences. As a consequence, this paper will test different branches of new institutionalist theory against the empirical evidence of the comparative qualitative case study of anti-corruption policies in Ukraine and Estonia. Given the institutional similarities at the beginning of both countries’ independent political trajectories, Ukraine and Estonia expose differences in how their anti-corruption policies are designed and how effective they are given their institutional context. By comparing the cases of anti-corruption reforms in Ukraine and Estonia, this thesis seeks to provide answers to the following research question: What factors explain the difference in the effectiveness and functionality of anti-corruption policies in Estonia and Ukraine? On 13 January 2021, a corruption scandal rattled Estonia. The Estonian prime minister, his center party, and the party’s secretary-general were named as suspects in a criminal investigation. The investigation revolved around property development in Estonia’s capital Tallinn. A development project in the city’s port district had received a state loan for enterprises hit by the Covid-19 pandemic. The investigation centered on whether people associated with the government used their political influence to help the developers to receive a large donation in party funds in return. The prime minister eventually resigned over the investigation.

These chapters provide empirical cases and critical analysis of a rich variety of norm-takers from EU member states, European and non-European states, including the rejection of EU norms in Russia and Africa as well as adaptation of EU practices in Australia and New Zealand. Chapters on China, ASEAN and the Czech Republic demonstrate resistance to EU norm export. This volume probes differences in willingness to adopt or adapt norms between various actors in the recipient state and explores such questions as: How do norm-takers perceive of the EU and its norms? Is there a 'normative fit' between EU norms and the local normative context? Similarly, how do EU norms impact recipients' interests and institutional arrangements? First, the authors map EU norm export strategies and approaches as they affect norm-takers. Second, the chapters recognize that norm adoption, adaption, resistance or rejection is a product of interaction and a relationship in which interdependence, asymmetry and power play a role. Third, we see that domestic circumstances within norm-takers condition the reception of norms. This book's focus on norm-takers highlights the reflexive nature of norm diffusion and that nature has implications for the EU itself as a norm exporter. On each of these topics, the book provides one chapter that focuses on Ukraine's own experience and one chapter that examines the issue in the broader context of international practice. Placing Ukraine in comparative perspective shows that many of the country's problems are not unique and that other countries have been able to address many of the issues currently confronting Ukraine. As with the constitution, there are no easy answers, but careful analysis shows that some solutions are better than others. Ultimately, the authors propose a series of reforms that can help Ukraine make the best of a bad situation. The book stresses the need to focus on reforms that might not have immediate effect, but that comparative experience shows can solve fundamental contextual challenges. The United States devoted greater attention to Ukraine than any other post-Soviet state (except Russia) after the breakup of the Soviet Union. Steven Pifer, a career Foreign Service officer, worked on U.S.-Ukraine relations at the State Department and the White House during that period and also served as ambassador to Ukraine. With this volume he has written the definitive narrative of the ups and downs in the relationship between Washington and newly independent Ukraine. The relationship between the two countries moved from heady days in the mid- 1990s, when they declared a strategic partnership, to troubled times after 2002. During the period covered by the book, the United States generally succeeded in its major goals in Ukraine, notably the safe transfer of nearly 2,000 strategic nuclear weapons left there after the Soviet collapse. Washington also provided robust support for Ukraine’s effort to develop into a modern, democratic, market-oriented state. But these efforts aimed at reforming the state proved only modestly successful, leaving a nation that was not resilient enough to stand up to Russian aggression in Crimea in 2014. The author reflects on what worked and what did not work in the various U.S. approaches toward Ukraine. He also offers a practitioner’s recommendations for current U.S. policies in the context of ongoing uncertainty about the political stability of Ukraine and Russia’s long-term intentions toward its smaller but important neighbor.

Book excerpt: Money laundering schemes are constantly evolving, which requires public authorities to constantly up-date their knowledge and implement state-of-the-art measures to combat corruption. The monograph demonstrates how the Ukraine can improve its implementation of FATF recommendations to fight money laundering and corruption and how it can better organize the mechanisms of state regulation and the monitoring of financial activities. This monograph offers a new approach to implementing an anti-corruption strategy in Ukraine and suggests how the fight against corruption within government can be streamlined using modern methods and a risk-based approach. Drawing on the experience of EU countries through a comparative analysis of the rules and procedures for structuring public administration policy, this work proposes developing recommendations to strengthen the Ukrainian anti-money laundering and corruption policy. Corruption remains a widespread problem at various levels within Ukrainian public administration and it has significantly weakened public confidence in government and in the judicial system. In an international comparison of corruption in 180 countries, Ukraine ranks 130th, making it one of the most corrupt countries in the world. At the same time, Ukraine has an AML/CTF legal administrative framework in place that largely meets the current formal requirements of the FATF. The Ukraine has implemented AML and anti-corruption measures under the Council of Europe's Moneyval monitoring mechanism. In addition, Moneyval has been an associate member of the FATF since 2006. The National Bank of Ukraine (NBU) practices risk-based banking supervision and has made significant progress in creating transparency regarding the beneficial ownership of banks. In recent years, Ukraine has consistently removed criminal owners from the banking sector and established an efficient sanction regime in response to breaches of legal obligations, including the withdrawal of banking licenses. Furthermore, the establishment of a unified state register for beneficial ownership allows authorities to identify banking clients. In terms of mutual legal assistance on money laundering and corruption, the Ukraine has also made significant progress. Ultimately, the Ukrainian AML/CTF framework has been refined significantly in recent years. Today, there is a clear understanding of money laundering and terrorist financing risks in Ukraine both at the administrative level and at the level of the supervisory authorities. As a result, far-reaching legislation has been established. Nevertheless, this development cannot hide the fact that money laundering via shell companies is still part of everyday life in Ukraine. The Ukrainian criminal justice system continues to be heavily influenced by corruption and has failed to effectively combat it. Ukrainian cross-border prosecution of money laundering offences, in particular the confiscation of proceeds of crime in other countries, is ineffective due to a lack of experience and the absence of legislation spelling out direct areas of responsibility and formal procedures. Finally, a central problem is the lack of confiscation orders which impedes the efficient prosecution of corruption and money laundering.
