Book excerpt: Since the mid-nineteenth century, public officials, reformers, journalists, and other elites have referred to “the labour question.” The labour question was rooted in the system of wage labour that spread throughout much of Europe and its colonies and produced contending classes as industrialization unfolded. Answers to the Labour Question explores how the liberal state responded to workers’ demands that employers recognize trade unions as their legitimate representatives in their struggle for compensation and control over the workplace. Gary Mucciaroni examines five Anglophone nations – Australia, Canada, Great Britain, New Zealand, and the United States – whose differences are often overlooked in the literature on political economy, which lumps them together as liberal, “market-led” economies. Despite their many shared characteristics and common historical origins, these nations’ responses to the labour question diverged dramatically. Mucciaroni identifies the factors that explain why these nations developed such different industrial relations regimes and how the paths each nation took to the adoption of its regime reflected a different logic of institutional change. Drawing on newspaper accounts, parliamentary debates, and personal memoirs, among other sources, Answers to the Labour Question aims to understand the variety of state responses to industrial unrest and institutional change beyond the domain of industrial relations.

I have been to compile around 600 questions covering 22 labour legislations, including “Management of Discipline “. The answers cover under present labour legislations as well as under Four Labour Codes. I have tried to substantiate the answers based on judicial views/judgements wherever possible. I am sure this book – FAQs & ANSWERS covering the Labour Legislations, will be a handy reckoner, a handbook to the HR Fraternity, Faculty and Students of management schools, MBA, MSW & Law. Book excerpt: By exploring different approaches to the study of labour law, this book re-evaluates how it is conceived, analysed, and criticized in current legislation and policy. In particular, it assesses whether so-called 'old ways' of thinking about the subject, such as the idea of the labour constitution, developed by Hugo Sinzheimer in the early years of the Weimar Republic, and the principle of collective laissez-faire, elaborated by Otto Kahn-Freund in the 1950s, are in fact outdated. It asks whether, and how, these ideas could be abstracted from the political, economic, and social contexts within which they were developed so that they might still usefully be applied to the study of labour law. Dukes argues that the labour constitution can provide an 'enduring idea of labour law', and an alternative to modern arguments which favour reorienting labour law to align more closely with the functioning of labour markets. Unlike the 'law of the labour market', the labour constitution highlights the inherently political nature of labour laws and institutions, as well as their economic functions. It constructs a framework for analysing labour laws, labour markets, and institutions, to allow scholars to critique the current policy climate and, in light of the ongoing expansion of the global labour market, assess the impact of the narrowing and disappearance of spaces for democratic deliberation and democratic decision-making on workers' rights.

Book excerpt: Lara Jüssen takes the case of Latin American household and construction workers in Madrid to show how ir/regular labour migrants make citizenship available for themselves through emplacements, embodiments and enactments of citizenship. After describing the sociopolitical context of crisis and resistance in Spain, citizenship is anthropologized in order to approach it through the workplace: the private household and the construction site. Based on empirical results from interviews, it is analyzed how citizenship is emplaced through ego-centered networks and assemblages that situate the migrants’ social belonging; how it is embodied through carving out of identities of the migrant workers, intersectionality of gender, ethnicity, and class, affects that imprint workers’ bodies, and experiences of violence at the workplace; then citizenships’ enactment is scrutinized through workers’ empowerment for rights, individually at the workplace and collectively through demonstrations and political theater performance in urban public space.
