Book excerpt: In contrast to Japanese citizens today, villagers in the Tokugawa period (seventeenth through mid-nineteenth centuries) frequently resorted to lawsuits to settle conflicts, leaving a vast but hitherto untapped record of power struggles between villagers and the network of administrators above them. Through colorfully narrated and skillfully analyzed case studies of their lawsuits and petitions, Herman Ooms traces the evolution of class and status conflicts in villages during this feudal era. Inspired by the work of Max Weber and Pierre Bourdieu, the author links detailed village analysis to a broader discussion of societal power fields and juridical domains. Opening with an angry woman's lifelong struggle against village authority, Ooms's study examines how obscure historical actors, local elites, commoners, women, and outcastes manipulated the distinctions of class and status to their own advantage. The case studies offer a penetrating view of legal practice, including the position of women, inheritance customs, and particular forms of village justice. In a significant contribution to the legal history of outcaste populations, Ooms also studies the origins of discrimination against the ancestors of the burakumin population, a group that even now is struggling for equality in Japanese society.

The present Constitution of the Empire of Japan was promulgated by the Emperor on the nth of February 1889, that day being the National Festival of Kigensetsu or the anniversary of the foundation of the Empire by the First Emperor Jimmu Tenno (f1pK JiM.). In the framing of this Constitution, Marquis Ito with many high officials, had been sent to Europe with the Imperial Commission to examine the constitutions of Western Countries, and most of the principles which find a place in the component elements of constitutional governments have been adopted, so far as they are consistent with the fundamental principles of the form of Imperial Government which existed from the beginning of the Empire. That fundamental principle is clearly stated in the 1st Article of the Constitution: "The Empire of Japan shall be reigned over and governed by a line of Emperors unbroken for ages eternal." Marquis Ito, in his "Commentaries on the Constitution" (Siittl translated into English by Baron Miyoji Ito #JCcLfp), writes "The Sacred Throne of Japan is inherited from Imperial Ancestors, and is to be bequeathed to posterity; in it resides the power to reign over and govern the State." From this it will be seen that the foundation of the Constitution is the worship of Imperial Ancestors, a fact which is definitely set forth in the Preamble of the Constitution which runs thus: --"Having, by virtue of the glories of our Ancestors, ascended the throne of a lineal succession unbroken for ages eternal; remembering that Our beloved subjects are the very same that have been favoured with the benevolent care and affectionate vigilance of Our Ancestors, and desiring to promote their welfare and give development to their moral and intellectual...

The Japanese themselves are conscious of the lush green of their homeland, which they sometimes refer to as "the green archipelago." Yet, based on its fragile geography and centuries of extremely dense human occupation, Japan today should be an impoverished, slum-ridden, peasant society subsisting on a barren, eroded moonscape characterized by bald mountains and debris-strewn lowlands. In fact, as Conrad Totman argues in this pathbreaking work based on prodigious research, this lush verdue is not a monument to nature's benevolence and Japanese aesthetic sensibilities, but the hard-earned result of generations of human toil that have converted the archipelago into one great forest preserve. Indeed, the author shows that until the late 1600s Japan was well on her way to ecological disaster due to exploitative forestry. During the Tokugawa period, however, an extraordinary change took place resulting in a system of "regenerative forestry" that averted the devastation of Japan's forests. The Green Archipelago is the only major Western-language work on this subject and a landmark not only in Japanese history, but in the history of the environment.
