Book excerpt: In May 1988, the Virginia Department of Transportation (VDOT) adopted regulations that govern the transportation of hazardous materials through seven highway tunnel facilities. Recently, the validity of these regulations have been called into question on two separate grounds. First, since the federal government has been active in regulating the transportation of hazardous materials, the Commerce and Supremacy Clauses of the U.S. Constitution may preclude states from adopting hazardous material transportation regulations. Second, regulations promulgated under the Hazardous Materials Transportation Act (HMTA) of 1975 may preclude state regulatory activity in the hazardous material transportation area. This study evaluates the legality of the VDOT tunnel regulations in light of the above challenges to their validity. As to the first challenge to the VDOT regulations, it is highly unlikely a court would find the regulations preempted. VDOT's regulations, however, are more problematic when tested against the preemption provisions outlined in the HMTA. The HMTA expressly preempts state regulations which: 1. make compliance with the federal regulations an impossibility; 2. are an obstacle to the accomplishment of the federal regulations; or 3. which are preempted under 49 App. U.S.C. 1804(a)(4) (which preempts state regulations that deal with a subject covered by the HMTA and which are not substantively identical to the HMTA provisions) or 49 App. U.S.C. 1804(b) (which excludes certain state regulations that deal with hazardous material routing). The analysis conducted in this study seems to indicate that the HMTA preempts VDOT's attempt to regulate hazardous material shipments through the state's tunnels. However, the HMTA also includes a number of exceptions to the general preemption rules. One of these regulations, 49 C.F.R. 177.810 (1992) provides that: nothing contained in [the regulations promulgated under the HMTA] shall be so construed as to nullify or supersede regulations established ... under authority of State statute ... regarding the kind, character, or quantity of any hazardous material permitted by such regulations to be transported through any urban vehicular tunnel used for mass transportation. In summary, the VDOT tunnel regulations are almost certainly preempted to the extent they apply to non-urban tunnels, and may further be preempted to the extent they reclassify hazardous materials. Consequently, it is recommended that VDOT submit its regulations to the Research and Special Programs Administration (RSPA) of the Department of Transportation for a preemption determination.

Book excerpt: In response to a request from the Director of the Virginia Department of Transportation Safety an evaluation of the state and federal regulations, inspection programs and enforcement activities regarding truck safety was carried out. The purpose of the study was to assess the nature and scope of current regulatory activities; to compare and contrast state and federal approaches; and to ascertain whether or not a problem exists with state regulations, inspections, and enforcement and, if so, to suggest remedial measures. The study was carried out with guidance provided by a project advisory group consisting of representatives of the Department of Highways and Transportation, Division of Motor Vehicles, Department of State Police, Department of Health, Office of Energy and Emergency Services, State Corporation Commission, Port Authority, Division of Legislative Services, Office of the Attorney General, U. S. Bureau of Motor Carrier Safety, National Transportation Safety Board, and the Virginia Highway Users Association. The evaluation included a review of relevant literature, a questionnaire survey of other states, site visits and observations of SCC and BMCS on-road safety inspections, a review and comparison of state and federal laws and regulations, and an analysis of available data concerning truck accidents. Analysis of the information obtained led to the. Conclusion that some revisions to the regulatory provisions governing the trucking industry and the transportation of hazardous materials are warranted. Recommendations for the revision of Virginia's regulations and administrative programs are offered.

Book excerpt: This study addressed the conditions on federal highway funding imposed by the federal government in the Transportation Equity Act for the 21st Century (TEA-21) and its successor Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) relating to a state's implementation of a compliant open-container law. Although SAFETEA-LU amended TEA-21 in a number of ways, it did not change the statutory standard for open-container laws established by TEA-21. Non-compliant states have a percentage of their highway construction funds diverted to a safety fund. In this study, the constitutionality of such restrictions was explored and found to be acceptable given similar Supreme Court precedent. Second, the responses of other states to the federal initiatives were determined and assessed for compliance. Third, the efficacy of the federal guidelines in terms of their impact on highway safety was explored. Fourth, Virginia's current open-container law was analyzed with regard to its compliance with the federal mandate. Virginia's open-container law does not comply with the provisions of TEA-21. As a result, 3 percent of Virginia's highway construction funds are diverted from highway construction to safety programs. If Virginia passed a law that satisfied the federal conditions, this transfer would stop. If Virginia does not pass such a law, it cannot avoid the transfer of more than $16 million pursuant to 23 U.S.C.154 for fiscal year 2006. An additional benefit of enacting a stricter open-container statute is that such a law could potentially function as a "back up" charge that might be pressed if a driver was suspected to be driving under the influence of alcohol but the violation could not be substantiated in a traffic stop. However, there is much debate as to the actual effect of TEA-21-compliant open-container laws on reducing the frequency and severity of alcohol-related traffic crashes.
