These changes have degraded water quality and habitat in virtually every urban stream system. The Clean Water Act regulatory framework for addressing sewage and industrial wastes is not well suited to the more difficult problem of stormwater discharges. This book calls for an entirely new permitting structure that would put authority and accountability for stormwater discharges at the municipal level. A number of additional actions, such as conserving natural areas, reducing hard surface cover (e.g., roads and parking lots), and retrofitting urban areas with features that hold and treat stormwater, are recommended.

At times noise can be loud enough to damage hearing, and at lower levels it can disrupt normal living, affect sleep patterns, affect our ability to concentrate at work, interfere with outdoor recreational activities, and, in some cases, interfere with communications and even cause accidents. Clearly, exposure to excessive noise can affect our quality of life. As the population of the United States and, indeed, the world increases and developing countries become more industrialized, problems of noise are likely to become more pervasive and lower the quality of life for everyone. Efforts to manage noise exposures, to design quieter buildings, products, equipment, and transportation vehicles, and to provide a regulatory environment that facilitates adequate, cost-effective, sustainable noise controls require our immediate attention. The Eleventh Amendment to the United States Constitution codified this protection for states, protecting them from being sued in federal courts. While the basic principle remains today, it has been the subject of legislative enactments at the federal and state levels that circumscribe, limit, or otherwise waive sovereign immunity. Since local governmental entities are not recognized as sovereigns in their own right, they derive their sovereign immunity from state legislation and exercise only those sovereign powers delegated to them by the states. Most public airports are owned and operated by units of local government or regional governmental authorities. Therefore, the extent of sovereign immunity granted to airports varies from state to state. This digest provides an overview of sovereign immunity as it applies to airports and provides a state-by-state summary of each state's statutory authority and relevant case law.
