Book excerpt: Airport sponsors who receive a grant from the Federal Aviation Administration for an airport project are obligated to agree to a number of assurances. One of those assurances provides that the airport sponsor will make the airport available for public use on reasonable conditions and without undue discrimination. The intent of this assurance is to ensure that aeronautical users will have reasonable access to the airport. Airport sponsors can encounter issues under this grant assurance by limiting access to the airport, directly or indirectly, ranging from adopting express restrictions on particular aeronautical activities to less obvious actions to ensure safety, security, and economic sustainability, such as enforcing airport rules and regulations and negotiating and enforcing lease and rental agreements, airport fees, and local laws. This digest describes the sponsor assurances and how they limit the airport sponsor from unreasonably restricting access for aeronautical activity at general aviation airports. Although focused on general aviation airports, all airport sponsors will benefit from this guide. In Appendix A, readers will find fact sheets that summarize the law on access issues as applied to specific activities. Appendix B is a practical Guide to Leasing Airport Property, which contains best practices for lease and use agreements of airport property.

Book excerpt: This book is concerned with property rights in airspace, a subject which has increasing importance in the urban setting. This is a book not only on the law which affects the utilization of airspace, but also on the methods and instruments employed in airspace transactions as such. In terms of the law involved, as revealed in applicable cases and statutes, the historical background and the basis of the legal siutation as it exists today are discussed. A major part of this discussion involes aviation and the problem of the airport and the landowners who surround it. Similarly, the modern-day condominium, as provided for in recent statutory enactments, and its common law analogy, the 'upper chamber', are examined. Consideration is given in one chapter to some of the particular legal problems which may affect airspace utilization in certain jurisdictions. Also, the socio-economic trends and tendencies which affect law generally and the law of airspace in particular are considred at one one point. The discussion and the materials on airspace transactions are found in the latter part of the book. Since the economics of a particular situation are vital in determining whether airspace utilization is feasible, this aspect is also considered in a chapter dealing with the valuation of airspace. How airspace utilization meshes with the goals of city planners is also briefly discussed.

Book excerpt: Regulatory agencies such as the Federal Aviation Administration (FAA) must balance the need to expand airport capacity with concerns about environmental impact. This balance is governed by the National Environmental Policy Act (“NEPA”), which establishes the environmental review procedures governing airport development activities that receive federal funding. This paper presents a comprehensive empirical study of legal challenges to airport expansion, focusing on the influence of environmental procedural statutes such as NEPA, as well as substantive environmental law including requirements in the federal airport funding statutes to minimize adverse environmental impacts. All known reported court opinions since the enactment of NEPA involving environmental challenges to airport construction and physical expansion were reviewed and characterized with respect to the factual background of the case, the form of the legal challenge, and the disposition of the reviewing court. A statistical regression analysis was performed to determine which factors significantly influence a court's decision to approve the environmental review or to enjoin airport expansion pending further environmental review. The analysis demonstrates that environmental challenges to airport expansion have become significantly less likely to succeed over time, due in part to 2003 legislative changes requiring a coordinated environmental review process coordinated by the FAA, and granting exclusive jurisdiction to the U.S. Courts of Appeals for review of FAA final decisions. Environmental plaintiffs facing such a difficult judicial forum should focus their legal challenges on the most statistically effective arguments: that the FAA failed to adequately consider cumulative environmental impacts, and to a lesser degree, that the FAA or airport proprietor has failed to take every reasonable step to minimize the adverse environmental impact of airport expansion.
