Book excerpt: In 1990, John Kincaid outlined a fundamental shift in American federalism from a consensus upon cooperation, and an emphasis on fiscal policy tools, to coercion, and an emphasis on regulation (Kincaid 1990). This new emphasis on coercion has substituted federal preemption of state and local authority accompanied by unfunded federal mandates. It is perhaps ironic, and significant, that this shift has occurred across several Republican administrations. But consider an amendment offered on the Senate floor July 22, 2009 that would have permitted gun owners to carry their weapons across state lines (regardless of that state's conceal-carry restrictions). In this instance, normally “states rights” conservatives supported the amendment while anti-gun Democrats opposed it on the grounds that it was an unwarranted intrusion by the national government on state's rights.
