Ante la omisión de normativa específica al respecto, cabe acometer la interpretación que el Tribunal Constitucional ha presentado. En un principio se analizarán los conceptos de forma genérica, para posteriormente analizar la legislación, la doctrina y la jurisprudencia, es decir, la regulación de estos derechos fundamentales, como es el derecho a la intimidad, dentro del marco de las relaciones laborales. De igual forma, merece cierta mención de cuáles son los métodos de vigilancia empresarial y qué garantías debe tener en cuenta el empresario para no vulnerar estos derechos.
