Book excerpt: Excerpt from An Introduction to the History of Jurisprudence Bolingbroke has observed, that to enable one to take a commanding view of the field of Law and Legislation there are two principal vantage grounds on which it is necessary to mount - History and Metaphysics. The road is smooth and flowery to that vantage ground offered by History. There has been no want of those who have ascended to it, and taken post upon it. To that which belongs to the region of Metaphysics, the road is rugged and full of thorns. Few have attempted to gain it fewer have succeeded in placing themselves in a position whence a View at once clear and extensive could be obtained. Book excerpt: Excerpt from Historical Jurisprudence: An Introduction to the Systematic Study of the Development of Law The study of Historical Jurisprudence possesses a complex attractiveness. It has a value that is at once theoretical and practical, an interest that arises from the ease of acquiring, as well as from the difficulty of comprehending, its principles. The student finds in jurisprudence a mental training that calls into fullest activity all the forces which years devoted to the study of the humanities have placed at his disposal. Languages, history, philosophy, - all these combined are insufficient to unlock every barrier to the complete knowledge of this most far-reaching science. Yet the man devoid of college education, - without any education, indeed, beyond that sufficient to enable him to pass the usual bar examination, - finds in Historical Jurisprudence matters not only of deepest interest, but of highest value. The lawyer finds therein the solid foundation upon which rests modern law; the vital force of that law, which to him is too often a thing to be merely memorized; and understanding of those principles which are not seldom by him only dimly discerned in enactment and precedent. The student of the liberal arts finds in jurisprudence the record of national development, the key to the great movements which have made and unmade dynasties, the explanation of that which would without it be so obscure as to defy understanding. The study of jurisprudence is as profitable for him who has but little time to devote to the pursuit of culture as for him whose whole life is devoted to such pursuit. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Studies in History and Jurisprudence The longer one lives the more is one impressed by the close connexion between the old greco-italian world and our own. We are still very near the ancients; and have still much to learn from their writings and their institutions. The current of study and education is at present setting so strongly towards the sciences of nature that it becomes all the more needful for those who value historical inquiry and the literature of the past to do what they can to bring that old world into a definite and tangible relation with the modern time. Book excerpt: Excerpt from Jurisprudence It must not be supposed that the Object of this branch of legal science is an elementary outline of the concrete legal system. It deals not with the outlines of the law, but with its social context and its ultimate conceptions. Theoretical jurisprudence is not elementary law, any more than metaphysics is elementary science. Book Inquiries Elementary and Historical in the Science of Law Classic Reprint

Download or read book Inquiries Elementary and Historical in the Science of Law Classic Reprint written by James Reddie and published by . This book was released on 2015-07-08 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Inquiries Elementary and Historical in the Science of Law Some apology may, perhaps, seem requisite, for a practical lawyer allotting any portion of his time to studies so much apart from the routine and technicalities of ordinary business, as those, which form the subject of the following inquiries. The author's original design was the composition of practical treatises on the principles of maritime and commercial law, national and international. But from his having devoted himself to the discharge of the duties of a provincial semi-judicial office, and from his consequent want of leisure, he was, in the former of those projects, fortunately for the public, anticipated by his friend, the present learned Professor of the Law of Scotland in the University of Edinburgh, enlarging his excellent treatise on Bankruptcy, into his still more valuable commentaries on the principles of Mercantile Jurisprudence. Book excerpt: Excerpt from The Elements of Jurisprudence The legal systems of the continent owe to their common derivation from the law of Rome, not only a uniform legal nomenclature, but also a generally accepted method, which at once assigns any newly developed principle to its proper place, and has greatly facilitated the orderly exposition of those systems in the form of codes. Book A Critical History of Modern English Jurisprudence

Download or read book A Critical History of Modern English Jurisprudence written by George H. Smith and published by Forgotten Books. This book was released on 2018-03-23 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Critical History of Modern English Jurisprudence: A Study in Logic, Politics, and Morality A limited edition of this little work has been printed, with a view of submitting it to friends of the author, and others, who, he may have reason to suppose, are inter ested in political science. But in submitting it even to this limited class of readers, the author is painfully con scious, from experience, that both the subject of the work, and the method in which it is treated stand in need of apology. In regard to the subject, - which is Jurisprudence, its study in England and this country, within the last fifty years, has fallen into almost entire neglect; and there is now no subject more generally unpopular. The general reader regards it as belonging peculiarly to the province of the lawyer, and the lawyer, in general, as a study of no practical utility, and, with which, consequently, he has no concern. And the few who are addicted to philoso phy, turning to the works of the modern English jurists, find there something which bears no resemblance to real Jurisprudence, but which has usurped its place, and even its name.
