This book was released on 2015-07-07 with total page 670 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from An Exposition of the Principles of Pleading Under the Codes of Civil Procedure The plan and purpose of this book are stated in the introduction. I shall here state the reasons for its preparation and publication. My study of procedure, and my experience, at the Bar and upon the Bench, have satisfied me that a complete exposition, analytic and synthetic, in brief and convenient compass, of the basis, the philosophy, and the application, of the principles of pleading under the Reformed American Procedure, is a desideratum in the literature of the law. The science of pleading has been neglected in legal literature, in legal instruction, and in the practice. Its neglect in the schools, and in the practice, is largely due to the want of a well-adapted text-book. The result is, that young men, upon their entrance into the profession, have not learned, and do not understand, the principles upon which the substantive law is to be applied to operative facts; and in practice, the tendency has been to follow distinct provisions of the codes, literally, rather than to interpret and apply them as parts of an entire and scientific system. The over-fullness and prolixity of pleadings under the codes is proverbial; it is a needless hindrance in judicial procedure, and is as reprehensible as it is needless. Excessive statement in pleading comes from conscious uncertainty as to what is requisite, and what is sufficient. The ideal code pleading is brief and simple; but its brevity and simplicity come only from adherence to the scientific principles of the system. This needless fullness and prolixity can be avoided, and this characteristic simplicity, terseness, and brevity can be secured, only by an intelligent understanding of the true philosophy of the new procedure. Book The Rules of Pleading Under the New York Code and the Codes of Other States and the Practice Relating to Pleading

Download or read book The Rules of Pleading Under the New York Code and the Codes of Other States and the Practice Relating to Pleading written by Edwin Baylies and published by Forgotten Books. This book was released on 2017-10-11 with total page 824 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Rules of Pleading Under the New York Code and the Codes of Other States, and the Practice Relating to Pleading: With an Appendix of Forms New York Code of Civil Procedure, would be found of use to the practitioner in other Code States. In addition to the statement of the rules of pleading, a few chapters of the book have been devoted to the practice relating to pleading, and an appendix of forms is given. These forms are intended rather as suggestions than as precedents, for under the present system, precedents of pleadings are of doubtful value. Each cause of action set forth in a pleading must stand or fall upon the facts of that particular case; and no collection of forms can furnish a system of ready-made pleadings, though it may serve as a reminder of a necessary allegation that other wise would have been omitted. The general plan of the work appears in the table of contents, and the matters of detail in the index. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book The Native American Renaissance

Download or read book The Native American Renaissance written by Alan R. Velie and published by University of Oklahoma Press. This book was released on 2013-11-11 with total page 561 pages. Available in PDF, EPUB and Kindle. Book excerpt: The outpouring of Native American literature that followed the publication of N. Scott Momaday’s Pulitzer Prize–winning House Made of Dawn in 1968 continues unabated. Fiction and poetry, autobiography and discursive writing from such writers as James Welch, Gerald Vizenor, and Leslie Marmon Silko constitute what critic Kenneth Lincoln in 1983 termed the Native American Renaissance. This collection of essays takes the measure of that efflorescence. The contributors scrutinize writers from Momaday to Sherman Alexie, analyzing works by Native women, First Nations Canadian writers, postmodernists, and such theorists as Robert Warrior, Jace Weaver, and Craig Womack. Weaver’s own examination of the development of Native literary criticism since 1968 focuses on Native American literary nationalism. Alan R. Velie turns to the achievement of Momaday to examine the ways Native novelists have influenced one another. Post-renaissance and postmodern writers are discussed in company with newer writers such as Gordon Henry, Jr., and D. L. Birchfield. Critical essays discuss the poetry of Simon Ortiz, Kimberly Blaeser, Diane Glancy, Luci Tapahonso, and Ray A. Young Bear, as well as the life writings of Janet Campbell Hale, Carter Revard, and Jim Barnes. An essay on Native drama examines the work of Hanay Geiogamah, the Native American Theater Ensemble, and Spider Woman Theatre. In the volume’s concluding essay, Kenneth Lincoln reflects on the history of the Native American Renaissance up to and beyond his seminal work, and discusses Native literature’s legacy and future. The essays collected here underscore the vitality of Native American literature and the need for debate on theory and ideology.

Book excerpt: In civil cases, the facts of the case are often decisive. This book provides a comparative analysis of the process of fact-finding in the litigation process. It offers theoretical insights on the distinctive features of the fact-finding arrangements in civil cases in Austria, the Netherlands, and the United States. It also examines the empirical data that sheds light on the operation of procedural rules in legal practice. The book studies specific fact-finding regulations as components of an entire system and places them in a broader context. It analyzes the history of fact-finding arrangements to elucidate the legal tradition that has shaped the mindset of practitioners and legislators. In addition, the relationship between procedural rules and the prevailing constitutional and political theory is discussed. Rules are commonly designed and adopted to promote procedural values, such as efficiency, legitimacy, accuracy, and fairness. Fact-Finding in Civil Litigation discusses the values
