Book excerpt: Excerpt from An Examination of the Mosaic Laws of Servitude It is obviously important that in all discussions involving emphatic words, having a direct bearing on the issue in question, the ideas intended to be represented by those words should be distinctly stated and clearly comprehended. In the following examination, the word slave will be frequently used, not incidentally nor figuratively, but as expressing a definite idea, and one necessarily connected with the very purpose of the investigation. Hence, unless the idea represented by a Save, and by Slaver, as his legal condition, be understood by the reader, the examination must prove to him vague, confused, and unsatisfactory. These words are often used in a figurative rhetorical sense, as a man is said to be the slave of sin, of passion, of his party, or of his business; and we often hear of political, military, and ecclesiastical Slavery. In such cases, a comparison more or less close is intended to be made with a species of servitude to which these words are legally and technically applied. As we shall use these words only in their strict legal sense, it is necessary that this sense should be unequivocally understood by the reader. For this purpose, it will be sufficient to cite two legal definitions of the word slave, taken from American statutes, viz.: "Slaves shall be deemed chattels personal in the hands of their owners and possessors, and their executors, administrators, and assigns, to all intents, constructions, and purposes, whatever." - 2 Brevard's Digest, 229, S. Carolina. "A slave is one who is in the power of a master to whom he belongs. The master may sell him, dispose of his person, his industry, and his labor. He can do nothing, possess nothing, nor acquire anything, but what must belong to his master." - Civil Code, art. 35, Louisiana. Book excerpt: Excerpt from A Practical Treatise on the Law of Slavery The court observed that the term mulatto, as used in this state, was vague, and signified, in general, a person of mixed white and negro blood, in whatever proportions it might be mingled. The various distinctions which have obtained in the French and Spanish American colonies has not been adopted in this state. Harper J in delivering the opinion of the court, observed, that it seemed to be an error in the judge's charge to the jury, in stating, that a mulatto was the offspring of parents, one of whom was white, and the other black, and that he was disposed to think, that where the White blood predominated, the disqualifica tion ought not to attach. According to this instruction, we understand, that the child of a quadroon and a mulatto, according to the distinction in Louisiana, must be accounted white. Yet, I suppose, that even in Louisiana such a person would be called a mulatto It is certainly true, as laid down by the presiding judge, that every admixture of African blood with the European, or white, is not to be referred to the degraded class. It would be dan gerous and cruel to subject to this disqualification a person hearing all the features of a white, on account of some remote admixture of negro blood nor has the term mulatto, or person of color, I believe. I consulted no books, besides those mentioned in the text, and even those I had not always before me; but quoted perhaps as often from memory, as from actual inspection. Be that as it may, I can assure the public that I have advanced neither argument nor assertion, which I did not subject to frequent examinations, and have asserted nothing which I in conscience did not believe founded in fact to the best of my knowledge. Theologians believed that when God first created man he made a covenant with him: all Adam had to do was obey God's command to not eat from the tree of knowledge and obey God's command to be fruitful, multiply, and subdue the earth. The reward for Adam's obedience was profound: eternal life for him and his offspring. The consequences of his disobedience were dire: God would visit death upon Adam and his descendants. In the covenant of works, Adam was not merely an individual but served as a public person, the federal head of the human race. The Covenant of Works explores the origins of the doctrine of God's covenant with Adam and traces it back to the inter-testamental period, through the patristic and middle ages, and to the Reformation. The doctrine has an ancient pedigree and was not solely advocated by Reformed theologians. The book traces the doctrine's development in the seventeenth century and its reception in the eighteenth, nineteenth, and twentieth centuries. Fesko explores the reasons why the doctrine came to be rejected by some, even in the Reformed tradition, arguing that interpretive methods influenced by Enlightenment thought caused theologians to question the doctrine's scriptural legitimacy.

To attempt to understand Western civilization apart from the impact of Biblical law within it and upon it is to seek a fictitious history and to reject twenty centuries and their progress. The Institutes of Biblical Law has as its purpose a reversal of the present trend. it is called "Institutes" in the older meaning of the that word, i.e., fundamental principles, here of law, because it is intended as a beginning, as an instituting consideration of that law which must govern society, and which shall govern society under God. To understand Biblical law, it is necessary to understand also certain basic characteristics of that law. In it, certain broad premises or principles are declared. These are declarations of basic law. The Ten Commandments give us such declarations. A second characteristics of Biblical law, is that the major portion of the law is case law, i.e., the illustration of the basic principle in terms of specific cases. These specific cases are often illustrations of the extent of the application of the law; that is, by citing a minimal type of case, the necessary jurisdictions of the law are revealed. The law, then, asserts principles and cites cases to develop the implications of those principles, with is purpose and direction the restitution of God's order.
