Book excerpt: The purpose of this MBA report is to determine how the Department of Defense (DoD) manages and oversees medical services acquisition. In April 2009, the Market Research Analyst reported that the DoD is set to spend $47 billion in health care in 2010. Our analysis delves into the medical services procurement practices as well as the surveillance and training measures for the Army, Navy, and Air Force. To accomplish this objective, an online pilot survey was developed to address the current state of medical services acquisition management. The pilot survey gathered empirical data from military organizations responsible for the management and oversight of Federal Service Code Q, medical services. The pilot survey was conducted from October 26 to November 6, 2009 and obtained an 85% response rate. The results show that the services all use personal and non-personal medical services contracts, and the majority of the contracts are fixed-price. Additionally, the majority of Medical Contracting Commands identified manning shortfalls, health care provider salary cap issues, and a shortage of trained and experienced contracting personnel as challenges in contracting for medical services. The findings of this MBA report will support on-going research in the area of services acquisition management.

Book excerpt: Recent events in the Air Force surrounding the illegal actions of former Principal Deputy Assistant Secretary Darleen Druyun highlighted the need to review the management and oversight structure of acquisition activities in the Department of Defense (DoD). DoD, through the Undersecretary of Defense for Acquisition, Technology, and Logistics USD(AT AND L), established the Defense Science Board (DSB) Task Force on Management Oversight of Acquisition Organizations to examine its acquisition structures and processes; survey and assess best practices; and recommend changes to improve checks and balances to better ensure acquisition integrity. The Task Force was also asked to consider whether: (1) structural problems exist that place too much decision authority in one individual or at a level without adequate oversight; and (2) a simplified acquisition structure could improve both efficiency and oversight. The Task Force was co-chaired by two members of the Defense Science Board. Task Force members and key contributors included former Defense Department and other Federal Government officials, as well as members of industry and academia. During the course of its work, the Task Force reviewed a wide array of written materials and heard from experts in the fields of acquisition, procurement, ethics and integrity, human resources, leadership, organization, oversight, and best practices.

Book excerpt: Managers of weapon system acquisition programs and their staffs have often voiced concerns about the burden of complying with federal statutes or regulations requiring certain business and oversight processes. The essence of the concerns is that program offices spend an inordinate amount of time complying with statutes and regulations that add little value, and that the regulatory burden translates into cost increases, schedule delays, and adverse effects on system performance. While many other studies have addressed this topic, few have succeeded in generating the empirical evidence needed to inform the policy debate. To fill this gap, NDRI developed a Web-based data collection tool to capture the program staff's estimates of hours spent on compliance efforts. A total of 316 individuals in seven DoD program offices were recruited to use the web tool to estimate biweekly the time they spent on regulatory compliance-related activities over the course of a year. While statutes and regulations do place constraints on program execution, the study found that program office staffs do not appear to spend a significant amount of their time complying with those statutes and regulations. Further, there is little evidence that program office compliance activities have adverse consequences for program outcomes.

Acquisition process reforms often require changes in the body of statutes and regulations governing the acquisition process. Prior research has observed a regulatory pendulum in which statutes and regulations seem to move back and forth from relative flexibility to relative rigidity in response to perceived problems in the acquisition process generally, or in specific weapon system programs. Increased flexibility enables program managers to tailor their program's acquisition strategy to the unique features of its environment and to reduce the costs of oversight. Rigidity in statutes and regulations mandates specific management approaches and oversight procedures.

In this empirical study we developed and used a web-based survey to collect data on the acquisition strategy, procurement methods, and contract types used at Air Force and Navy installations. Specifically, we studied the current management practices in such areas as life cycle approach, project management, organization/management structure, and training provided to services acquisition personnel. We find that the majority of the services contracts awarded and administered conformed to our expectation. For example, most service contracts are competitively bid, fixed-priced awards without any type of contract incentive. However, we found that the Air Force and Navy use different contracting approaches--specifically in the areas of organizational level of acquisition offices (regional versus installation), the use of project teams, leaders of the acquisition effort (program personnel versus contracting officers), and managers of the services requirement (program personnel, contracting officers, and customer organizations). We analyzed the implications and impact of different approaches on the effectiveness of the contract management process and make recommendations on improving the management of services acquisition in the Department of Defense.

Book excerpt: Market research is a critical step in the acquisition process and requires due diligence; however, in October 2014, the Government Accountability Office identified limitations in market research performed on Department of Defense (DoD) procurements. To address these limitations, the authors evaluated issues that DoD acquisition professionals face in completing market research. They reviewed current federal literature pertaining to market research and analyzed data received from a questionnaire sent to more than 75 contracting and acquisition personnel, ranging from GS-09 contract specialists to Senior Executive Service-level assistant secretaries of the Navy. Different tools for market research were analyzed and benefits of a command-level staffed Market Research Center of Excellence were explored. Finally, the authors presented seven recommendations to improve market research effectiveness.This compilation includes a reproduction of the 2019 Worldwide Threat Assessment of the U.S. Intelligence Community.Market research (MR) is the process of collecting and analyzing information, making a decision, and then documenting the results (PCADD), as defined in the Market Research Gathering Information About Commercial Products and Services (SD-5) published by the Defense Standardization Program Office. Additionally, the Federal Acquisition Regulation (FAR) devotes an entire chapter (Part 10) to MR, which "prescribes policies and procedures for conducting market research to arrive at the most suitable approach to acquiring, distributing, and supporting supplies and services" (FAR 10.000). It is based on statutory requirements found in 41 United States Code (USC) 3306(a)(1), 41 USC 3307, 10 USC 2377, and 6 USC 796. Obviously, MR is a critical step in the acquisition process and requires due diligence. However, in October 2014, the General Accounting Office (GAO) identified limitations in the MR performed on Department of Defense (DoD) procurements. This finding validated the work of Dr. Aruna Apte, Dr. Uday Apte and Dr. Rene Rendon of the Naval Postgraduate School (NPS) in their 2010 article "Contracting for Services in the U.S. Army: An Empirical Study of Current Management Practices" published in the Journal of Contract Management. The article cited recent GAO and DoD Inspector General reports that "have shown that [DoD] has not conducted adequate market research during procurement planning of services contracts" (Apte, Apte & Rendon, 2010, p.10). Additionally, improving MR was a constant theme in the Better Buying Power (BBP) trilogy under the last presidential administration. Our team investigated current MR literature, MR training and MR practices, specifically including communicating with industry. Communicating with industry is embedded in four of the eight MR techniques prescribed in FAR Part 10 and communicating with industry is also one of the seven MR guiding principles prescribed in the SD-5, clearly illustrating that communicating with industry is a key element of the overall MR process. We also developed and issued a MR survey to contracting and acquisition personnel. Finally, based on our investigation and analysis we then developed requirements for a notional Market Research Center of Excellence (MaRCOE) to help DoD agencies and major buying commands improve MR.

To accomplish this objective, the authors deployed a survey to 81 separate contracting centers to collect empirical data. The survey, created by Meinshausen & Compton as part of a prior NPS MBA project, was designed to collect data on contract characteristics, life-cycle approach, project management, organization structure, and training provided to acquisition personnel. The survey was available for two full weeks in early March 2009. During this period, 61 respondents completed the survey, representing a 75% response rate. The results show that the vast majority of contracting centers are using competitively bid, fixed-price contracts without any type of incentives. This research also shows that a project team approach often is utilized; however, the contracting officer routinely leads the acquisition effort. Additionally, the respondents indicated that there are not enough acquisition workforce billets, the current billets are not adequately filled, and that training resources are lacking. The results of this project will be used for further research in a DoD wide analysis of lifecycle management of service acquisitions.

It also highlights relevant reforms in each area.

DOD and Air Force acquisitions programs often experience large cost overruns and schedule delays leading to a loss in confidence in the defense acquisition system and the people who work in it. Part of the DOD and Air Force response to these problems has been to increase the number of program and technical reviews that acquisition programs must undergo. This book looks specifically at the reviews that U.S. Air Force acquisition programs are required to undergo and poses a key question: Can changes in the number, content, or sequence of reviews help Air Force program managers more successfully execute their programs? This book concludes that, unless they do it better than they are now, Air Force and DOD attempts to address poor acquisition program performance with additional reviews will fail. This book makes five recommendations that together form a gold standard for conduct of reviews and if implemented and rigorously managed by Air Force and DOD acquisition executives can increase review effectiveness and efficiency. The bottom line is to help program managers successfully execute their programs.

Book excerpt: The purpose of this MBA project is to determine how best to collect empirical data regarding the current state of services acquisition management at the installation level within the Department of Defense and conduct an initial analysis of collected data. The project designed a web-based, self-administered, cross-sectional survey using SurveyMonkey, a web-based survey engine. The survey's pilot test was conducted between mid-October and early November 2007 and obtained a 50 percent response rate. Of the respondents, 60 percent was Army, 20 percent was Marine Corps and 20 percent was Air Force. The pilot test captured valuable data which was analyzed; however improvements to the core survey may generate a higher response rate and provide a clearer picture of the current state of services acquisition management at the installation level within the Department of Defense. The results of this project will support on-going research in the area of services acquisition management.
