Book excerpt: The signing of the Uruguay Round Agreements of the World Trade Organization (WTO) and the ever-increasing products and people movements between countries will put governments under increasing pressure to maintain effective and scientifically justified quarantine and food safety policies to protect their citizens, animals, plants and natural environments from the importation of pests and disease. But those policies can be abused, with governments at times adopting excessive restrictions so as also to offer domestic industries economic protection from import competition. The WTO Agreement on the Application of Sanitary and hytosanitary Measures (the SPS Agreement) was designed to prevent human, animal and plant health policies from becoming disguised restrictions on international agricultural trade. The Agreement provides clear guidelines as to acceptable bases for SPS restrictions. In general, it is admissible under the terms of the SPS Agreement for a Member to restrict imports to protect human, animal and/or plant life or health, so long as those restrictions are transparent, consistent and based on international standards (where they exist) or a scientific assessment of risks. Through legal and economic analysis of specific cases we can, to some extent, measure the Agreement?s success. The long-running feud between the US and the EU about the use of hormonal growth-promotants in beef (the Hormones dispute) was the first to be disputed formally at the WTO. It provides a classic example of how cultural differences with respect to food attributes have the potential to hamper trade and to challenge WTO agreements designed to limit the disruptions, especially when scientific evidence is limited or spurious. The paper begins by outlining the legal arguments used by the parties to the Hormones dispute, and a simple analysis of the outcome. The Panel and the Appellate Body, which heard the dispute, found that the EC violated its obligations under the SPS Agreement. Beneath the surface of broad agreement, however, lie some differences in interpretation of WTO rules that could potentially weaken the ability of the SPS Agreement to achieve the objectives for which it was designed. A simple economic model is used in section 3 to represent the EU beef market and effects of the hormone-treated beef ban and its removal under certain conditions. The model demonstrates that lifting the current prohibition of hormone-treated beef cannot reduce the net economic welfare of the EU. Qualifications, such as how the analysis would change if the market for beef were to segment after the ban was lifted, are discussed in section 4. The implications for the practical implementation of the SPS Agreement, with particular reference to how it might be improved in light of the outcome of the Hormones case and the analysis of its economic effects, are then explored in sections 6 and 7. The paper concludes by suggesting that, legal issues notwithstanding, using economic analysis can shed light on the efficiency of SPS policies, and promote the balance between achieving gains from trade reform and protecting human, animal and plant health and the environment.

Book excerpt: The Uruguay Round of multilateral trade negotiations, culminating in the GATT Secretariat being transformed into the World Trade Organization (WTO) on 1 January 1995, has altered forever the process of quarantine policymaking by national governments. On the one hand, WTO member countries retain the right to protect the life and health of their people, plants and animals from the risks of hazards such as pests and diseases arising from the importation of goods. On the other hand, the WTO's Agreement on Sanitary and Phytosanitary Measures (the SPS Agreement) requires that quarantine measures be determined in a manner that is transparent, consistent, scientifically based, and the least trade-restrictive. This collection resulted from an international workshop funded and organised by Biosecurity Australia, the agency of government responsible for analysing Australia's quarantine import risks and for negotiating multilateral SPS rules and less restrictive access to overseas markets for Australian produce. The workshop, which was held at the Melbourne Business School on 24-25 October 2000, brought together a distinguished group of applied economists and quarantine policy analysts whose focus involves regions as disparate as Europe, North America, Africa, Asia and New Zealand, in addition to Australia.

Book excerpt: The rapid expansion of international trade has brought to the fore issues of conflicting national regulations in the area of plant, animal, and human health. These problems include the concern that regulations designed to protect health can also be used for protection of domestic producers against international competition. At a time when progressive tariff reform has opened up markets and facilitated trade, in part responding to consumer demands for access to a wide choice of products and services at reasonable prices, closer scrutiny of regulatory measures has become increasingly important. At the same time, there are clear differences among countries and cultures as to the types of risk citizens are willing to accept. The activities of this conference were based on the premise that risk analyses (i.e., risk assessment, management, and communication) are not exclusively the domain of the biological and natural sciences; the social sciences play a prominent role in describing how people in different contexts perceive and respond to risks. Any effort to manage sanitary and phytosanitary (SPS) issues in international trade must integrate all the sciences to develop practices for risk assessment, management, and communication that recognize international diversity in culture, experience, and institutions. Uniform international standards can help, but no such norms are likely to be acceptable to all countries. Political and administrative structures also differ, causing differences in approaches and outcomes even when basic aims are compatible. Clearly there is considerable room for confusion and mistrust. The issue is how to balance the individual regulatory needs and approaches of countries with the goal of promoting freer trade. This issue arises not only for SPS standards but also in regard to regulations that affect other areas such as environmental quality, working conditions, and the exercise of intellectual property rights. This conference focused on these issues in the specific area of SPS measures. This area includes provisions to protect plant and animal health and life and, more generally, the environment, and regulations that protect humans from foodborne risks. The Society for Risk Analysis defines a risk as the potential for realization of unwanted, adverse consequences to human life, health, property, or the environment; estimation of risk is usually based on the expected value of the conditional probability of the event occurring times the consequence of the event given that it has occurred. The task of this conference and of this report was to elucidate the place of science, culture, politics, and economics in the design and implementation of SPS measures and in their international management. The goal was to explore the critical roles and the limitations of the biological and natural sciences and the social sciences, such as economics, sociology, anthropology, philosophy, and political science in the management of SPS issues and in judging whether particular SPS measures create unacceptable barriers to international trade. The conference's objective also was to consider the elements that would compose a multidisciplinary analytical framework for SPS decision making and needs for future research.

Book excerpt: To mitigate the risks posed by microbial threats of public health significance originating abroad, the Centers for Disease Control and Prevention (CDC) places small groups of staff at major U.S. airports. These staff, their offices, and their patient isolation rooms constitute quarantine stations, which are run by CDC's Division of Global Migration and Quarantine (DGMQ). Congress began to allocate funds in fiscal 2003 for the establishment of new quarantine stations at 17 major U.S. ports of entry that comprise airports, seaports, and land-border crossings. In a significant departure from the recent past, both the preexisting 8 quarantine stations and the new 17 are expected to play an active, anticipatory role in nationwide biosurveillance. Consequently, DGMQ asked the Institute of Medicine (IOM) to convene an expert committee to assess the present CDC quarantine stations and recommend how they should evolve to meet the challenges posed by microbial threats at the nation's gateways. DGMQ specifically requested "an assessment of the role of the federal quarantine stations, given the changes in the global environment including large increases in international travel, threats posed by bioterrorism and emerging infections, and the movement of animals and cargo." To conduct this assessment and provide recommendations, IOM convened, in October 2004, the Committee on Measures to Enhance the Effectiveness of the CDC Quarantine Station Expansion Plan for U.S. Ports of Entry. At the sponsor's request, the committee released the interim letter report Human Resources at U.S. Ports of Entry to Protect the Public's Health in January 2005 to provide preliminary suggestions for the priority functions of a modern quarantine station, the competences necessary to carry out those functions, and the types of health professionals who have the requisite competences (Appendix A). This, the committee's final report, assesses the present role of the CDC quarantine stations and articulates a vision of their future role as a public health intervention.
