ASEAN has made efforts to fight human trafficking through inter alia the establishment of regional counter-human trafficking laws and human rights bodies to establish best norms and practices for its member countries. Nevertheless, the International Labour Organization (ILO) recently declared that there are more than 11.7 million forced labor victims in the Asia-Pacific region encompassing the biggest concentration of forced labour victims in the world. This volume reviews the achievements and the deficiencies of ASEAN’s counter-human strategies at the national and regional level. It offers suggestions for the reform of ASEAN's anti-trafficking laws and for the creation of a regional anti-trafficking human rights body specialized in preventing human trafficking, promoting equal protection of all trafficking victims, and prosecuting human traffickers.

Book excerpt: Concern over the issue of human trafficking in Southeast Asia has grown steadily over the past several years with recent events elevating this pernicious problem to crisis levels in the public consciousness. The unearthing of mass graves in trafficking camps in both Thailand and Malaysia, the discovery of hundreds of fishermen enslaved in Indonesia, and the steady stream of vulnerable Bangladeshi and Burmese Rohingya populations seeking refuge across the Andaman Sea have left many people speculating about the scale of the problem and struggling to find solutions. It is impossible to know definitively the scale or scope of human trafficking. This unsettling uncertainty arises, in part, from the lack of robust, accurate, and standardized data related to human trafficking--information that is critical to devising and implementing better policies to combat it. Policies and programs based on poor data will be equally poor in their effectiveness. The corrective impulse should focus not only on collecting more data, but better data. This data scarcity arises, in part, from the fact that those involved in human trafficking are inherently a hidden population. It is further challenged by insufficient institutionalization of the definition of human trafficking, corrupt practices linked to trafficking, and--whether owing to a lack of resources or an unawareness of proper research methodologies--the inability to properly gather and analyze such information. Though progress has been made, these challenges continue to confront ASEAN member states as they move later this year toward further economic consolidation and the adoption of the ASEAN Convention on Trafficking in Persons--events that make regional collaboration and standardization on the issue of human trafficking all the more critical. In support of this process, this report is intended as a resource for both ASEAN and the international anti-trafficking community in aiming to (1) establish a foundation of approaches to estimating hidden populations, (2) survey the field of current global and local prevalence measure methods, (3) outline normative and technical achievements and challenges that may guide future data collection and analysis in Southeast Asia, and (4) offer policy recommendations to advance understanding of the scale and scope of human trafficking.

The first two concern movement between the countries of the region, one for general labour and one for sexual exploitation. The third concerns the smuggling of migrants from the region to the rich countries of the West, and the last focuses on migrants smuggled through the region from the poor and conflicted countries of South and Southwest Asia. Drug trafficking: The production and use of opiates has a long history in the region, but the main opiate problem in the 21st century involves the more refined form of the drug: heroin. In addition, methamphetamine has been a threat in parts of East Asia for decades (in the form of yaba tablets), but crystal methamphetamine has recently grown greatly in popularity. Virtually every country in the region has some crystal methamphetamine users, and some populations consume at very high levels.Resources: Resource-related crimes include those related to both extractive industries, such as the illegal harvesting of wildlife and timber, and other crimes that have a negative impact on the environment, such as the dumping of e-waste and the trade in ozone-depleting substances. In all cases, the threat goes beyond borders, jeopardizing the global environmental heritage. These are therefore crimes of inherent international significance, though they are frequently dealt with lightly under local legislation.Counterfeit goods: The trade in counterfeit goods is often perceived as a "soft" form of crime, but can have dangerous consequences for public health and safety. Fraudulent medicines in particular pose a threat to public health, and their use can foster the growth of treatment resistant pathogens.

Research in the book adds to the significant amount of work documenting human trafficking in Asia, by offering a critical academic perspective on the rise of the anti-trafficking movement. Readers will gain an understanding of how anti-trafficking operates as a new social movement and state practice, and how anti-trafficking often sits at odds with the experiences of trafficked and exploited persons themselves. Sallie Yea gained her PhD in Human Geography in 2000 from Monash University, Australia. She has held teaching and research positions at universities in New Zealand, Australia, South Korea and Singapore. Currently she is an Honorary Fellow in the Department of Social Inquiry, La Trobe University, Australia. She primarily teaches Human Geography and related Social Science subjects, including race/migration, international development, population geography and political geography. It draws upon qualitative and quantitative methods, case studies, interviews and survey data from criminal investigation police and drug-related crimes officers (CIPDRC) from six border provinces which are directly and indirectly involved in investigating these cross-border cases. The author demonstrates that drug markets in Vietnam are not controlled by monopolistic, hierarchical organizations or ‘cartels’ but small structures, based on family ties and fellow-countrymen relations, which are fluid and loosely organized. They are very adaptable and sophisticated with diverse modus operandi and multiple divisions of labour which present particular challenges to law enforcement agencies, which the author discusses.
