Book excerpt: A wide selection of contract types is available to the Government and contractors in order to provide needed flexibility in acquiring the large variety and volume of supplies and services required by agencies. Contract types vary according to (1) the degree and timing of the responsibility assumed by the contractor for the costs of performance and (2) the amount and nature of the profit incentive offered to the contractor for achieving or exceeding specified standards or goals. The two broad categories of contract types available for use in Government contracting are fixed-price and cost-reimbursement. The objective of selecting a contract type is to reasonably allocate performance risk between the contractor and Government while providing incentive to the contractor to perform efficiently and economically. It is important to select the contract type that places the appropriate level of responsibility on the contractor to successfully perform and that is commensurate with the technical and cost uncertainties. Contract types range from Firm-Fixed-Price (FFP) which places maximum risk on the contractor and minimum risk and administrative burden on the Government to Cost-Plus-Fixed-Fee (CPFF) which places minimum risk on the contractor and maximum risk on the Government. The Defense budget for cost-reimbursement and service contracts was $23.5 billion and $11.7 billion, respectively, for FY 1989. We identified 14 test ranges that had cost-plus-award-fee service contracts that were effective during FY's 1988 through 1990. The total value of the contracts was $3.7 billion. The Government has the flexibility to use various types of contracts to acquire the large variety and volume of materiel and services that it requires. One type of contract is a cost- reimbursement contract, which provides payment of allowable incurred costs. An example of a cost-reimbursement contract is a cost-plus-award-fee contract. Cost-plus-award-fee contracts provide a fee consisting of a base amount, which may be zero, that is established at the contract's inception and an award amount, which is based on a subjective evaluation by the Government, that is sufficient to maximize the contractor's performance.

The approach involves allowing employee participation in the receipt of award fee dollars thru a concept called Cost Plus Award Fee, Employee Participation, CPAF (EP). An example of an unsuccessful attempt to use CPAF (EP) is presented and a possible solution to problems associated with the use of EP on support service contracts is introduced. The recommended solution is centered around the use of a criteria oriented EP system, similar to criteria developed for Cost/Schedule Criteria System. A major element in the EP system presented is simplicity, in that any EP system must be easy for a contractor to administer. The article concludes with a structured recommendation that CPAF (EP) criteria be developed and tested. (Author).
