Book Standard of Care

    Book Details:
  • Author : George J. Annas
  • Publisher : Law of American Bioethics
  • Release : 1997
  • ISBN : 9780195120066
  • Pages : 308 pages

Download or read book Standard of Care written by George J. Annas and published by Law of American Bioethics. This book was released on 1997 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: American law, not philosophy or medicine, is the major force shaping American bioethics. This is both because law at its best fosters individual rights, equality, and justice, and because violation of the legal duty or "standard of care" a physician owes a patient can lead to a malpractice suit. The law has therefore had two conflicting impacts on medical ethics: the positive effect of eroding paternalism and replacing it with a patient-centered ethic; and the negative effect of encouraging physicians to be more concerned with avoiding litigation than doing the "right" thing. Standard of Care explores the fundamental value conflicts confronting medicine and society by examining courtroom resolutions of real bioethical disputes, often of constitutional dimension. This case-based approach, which ranges from abortion to euthanasia, from AIDS to organ transplantation, from genetic research to the artificial heart and rationing, illuminates the value choices with which the power (and impotence) of medicine confronts us. George Annas urges health care professionals to go beyond the minimalist legal "standard of care" by promoting a vigorous, patient-centered medical ethics based on respect for human rights and responsibility to both patients and society. If modern medicine is to enhance human life, a reconceptualization of law as the beginning of ethical discourse, rather than as an instrument to end it, is essential. Such a discourse could enrich all our lives by helping us to articulate both a national and international agenda for human rights in health.

Download or read book Our Hands Are Tied written by Marshall Kapp and published by Bloomsbury Publishing USA. This book was released on 1998-05-12 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: As a critical examination of the pervasive tension existing between defensive medicine and good, ethical patient care, this book investigates the impact of legalities on medical treatment. Physicians today are apprehensive about the threat of malpractice suits. Kapp explores the extent to which this fear is justified. He examines where physicians get their ideas about what the law forbids and requires, how physicians' perceptions of the law and medicine affect medical care, and whether these behavioral manifestations benefit or hurt a physician's ability to practice ethically. Kapp then suggests ways medical professionals can resolve tension caused by conflicting demands and encourage more ethical care.

Available in PDF, EPUB and Kindle. Book excerpt: The international community has made great progress in improving global health. But staggering health inequalities between rich and poor still remain, raising fundamental questions of social justice. In a book that systematically defines the burgeoning field of global health law, Lawrence Gostin drives home the need for effective global governance for health and offers a blueprint for reform, based on the principle that the opportunity to live a healthy life is a basic human right. Gostin shows how critical it is for institutions and international agreements to focus not only on illness but also on the essential conditions that enable people to stay healthy throughout their lifespan: nutrition, clean water, mosquito control, and tobacco reduction. Policies that shape agriculture, trade, and the environment have long-term impacts on health, and Gostin proposes major reforms of global health institutions and governments to ensure better coordination, more transparency, and accountability. He illustrates the power of global health law with case studies on AIDS, influenza, tobacco, and health worker migration. Today's pressing health needs worldwide are a problem not only for the medical profession but also for all concerned citizens. Designed with the beginning student, advanced researcher, and informed public in mind, Global Health Law will be a foundational resource for teaching, advocacy, and public discourse in global health.

The Code speaks to the enduring values of medicine as a profession. As a statement of the values to which physicians commit themselves individually and collectively, the Code is the standard for medicine as a professional community. Addressing the professional challenges faced by physicians today, the Code of Medical Ethics presents guidance through more than 200 ethical opinions on topics ranging from physician obligation in disaster preparedness and response, to physician participation in interrogations, to genetic testing and counseling, to use of electronic mail and health-related online sites. In addition to containing the nine Principles of Medical Ethics, this resource incorporates new and updated opinions, such as quality and access to care, decision making for minor patients, breach of security in electronic health records, respecting civil rights in intra-professional relationships, and more. An essential companion for physicians and other medical professionals, attorneys, and patients who contend with the challenging issues and choices inherent in modern medicine, this resource has been increasingly looked to for legal advocacy, decision making in matters of health care law and litigation, and development of health care policy.
