Book The American Convention on Human Rights

Download or read book The American Convention on Human Rights written by Thomas M. Antkowiak and published by Oxford University Press. This book was released on 2017-03-24 with total page 656 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers a thorough, critical, and accessible analysis of the American Convention on Human Rights which is the main human rights treaty of the Americas. The authors closely review the jurisprudence and the binding judgments of the two institutions charged with interpreting the Convention: The Inter-American Court of Human Rights and The Inter-American Commission on Human Rights. They focus on the rights most developed by the Court and Commission, namely the rights to equality, life, humane treatment, personal liberty, property, due process and judicial protection, as well as the freedom of expression and reparations. They examine the case law with a victim-centered lens while identifying key jurisprudential developments, discussing critical areas that lack consistency and rigor, and proposing alternative conceptual approaches. Each chapter contains an Introduction to compare the Convention right's formulation with equivalent rights in other major international and regional treaties; a background section to consider the right's negotiation history; a Scope of Protection section to analyze the right's provisions (paragraph-by-paragraph or topic-by-topic); and lastly, a Limitations section, if applicable, to study any limitations to the right. In addition, the book's Introduction presents an up-to-date overview of the dynamic Inter-American Human Rights System, discussing the System's legal instruments, major institutions, significant impact, key developments, and current challenges.

Book The American Convention on Human Rights

Download or read book The American Convention on Human Rights written by Cecilia Medina Quiroga and published by . This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study contains in-depth analyses and commentary on five basic rights protected under the Inter-American Convention of Human Rights in the light of the decisions of the Inter-American Court of Human Rights - namely the rights to life, to personal freedom, to personal integrity, to due process of law, and to a judicial remedy. Violations of these basic rights formed the majority of complaints before the Court at a time when many of the contracting States had either just left, or were still immersed in a dictatorship. In addition to the analysis of the Inter-American Court's judgments on these rights, the European and the universal jurisprudence have also been taken into consideration (both the European Court of Human Rights and the Human Rights Committee of the United Nations started their activities much earlier). In the analysis and interpretation of the five basic rights, use has been made of the travaux preparatoires of the Inter-American Convention, mainly to show the lack of professionalism shown by the drafters during the debates and the lack of information in the minutes of the Specialized Convention. The book presents the beginnings of the Inter-American Court and its hesitant steps in developing its position on the five basic rights that constituted the subject of the majority of the cases that reached the Court, along with States in the background attempting to introduce the idea of human rights in a democratic society into their own legal systems. It poses many questions upon which the Court should reflect in future cases and criticizes some of the Court's judgments for their shortcomings and lack of consistency. This is a scholarly yet practical book on a relatively new system for the protection of human rights. It will be a useful tool for practitioners to support their work in this field of law. It is also a valuable resource for scholars, inviting them to engage in a valuable, intellectual, but by all means practical, discussion.

Book Monitoring State Compliance with the UN Convention on the Rights of the Child

Download or read book Monitoring State Compliance with the UN Convention on the Rights of the Child written by Ziba Vaghri and published by Springer Nature. This book was released on 2022-01-03 with total page 429 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book presents a discussion on human rights-based attributes for each article pertinent to the substantive rights of children, as defined in the United Nations Convention on the Rights of the Child (UNCRC). It provides the reader with a unique and clear overview of the scope and core content of the articles, together with an analysis of the latest jurisprudence of the UN Committee on the Rights of the Child. For each article of the UNCRC, the authors explore the nature and scope of corresponding State obligations, and identify the main features that need to be taken into consideration when assessing a State’s progressive implementation of the UNCRC. This analysis considers which aspects of a given right are most important to track, in order to monitor States' implementation of any given right, and whether there is any resultant change in the lives of children. This approach transforms the narrative of legal international standards concerning a given right into a set of characteristics that ensure no aspect of said right is overlooked. The book develops a clear and comprehensive understanding of the UNCRC that can be used as an introduction to the rights and principles it contains, and to identify directions for future policy and strategy development in compliance with the UNCRC. As such, it offers an invaluable reference guide for researchers and students in the field of childhood and children’s rights studies, as well as a wide range of professionals and organisations concerned with the subject.

Book The Inter American System of Human Rights

Download or read book The Inter American System of Human Rights written by David John Harris and published by Oxford University Press on Demand. This book was released on 1998 with total page 588 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book, which can be used as a text for teaching purposes, gives a fascinating, and authoritative treatment both the rights protected by the Inter-American system and of the way in which its institutions work. An important part of the book is a thorough, article by article account of the guarantee in the American Declaration of the Rights and Duties of Man and in the American Convention on Human Rights of civil, political, economic, social and cultural rights in the light of the jurisprudence of the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights, and of the Commission's many country reports on the human rights situation in particular states. There are also chapters on the rights of indigenous peoples, amnesty laws and states of emergencies. The evolution and current methods of work of the Commission and the Court are set out at length and their achievements are critically assessed. The role of non-governmental organisations is also examined in this context. The book will be invaluable to all those interested in the protection of human rights in the Americas and international human rights law generally.
