Book excerpt: America is highly polarized around elections, but unelected actors make many of the decisions that affect our lives. In this lucid history, James R. Copland explains how unaccountable agents have taken over much of the U.S. government apparatus. Congress has largely abdicated its authority. “Independent” administrative agencies churn out thousands of new regulations every year. Courts have enabled these rulemakers to expand their powers beyond those authorized by law—and have constrained executive efforts to rein in the bureaucratic behemoth. No ordinary citizen can know what is legal and what is not. There are some 300,000 federal crimes, 98 percent of which were created by administrative action. The proliferation of rules gives enormous discretion to unelected enforcers, and the severity of sanctions can be ruinous to citizens who unwittingly violate a regulation. Outside the bureaucracy, private attorneys regulate our conduct through lawsuits. Most of the legal theories underlying these suits were never voted upon by our elected representatives. A combination of historical accident, decisions by judges and law professors, and self-interested advocacy by litigators has built an onerous and expensive legal regime. Finally, state and local officials may be accountable to their own voters, but some reach further afield, pursuing agendas to dictate the terms of national commerce. These new antifederalists are subjecting the citizens of Wyoming and Mississippi to the whims of the electorates of New York and San Francisco—contrary to the constitutional design. In these ways, the unelected have assumed substantial control of the American republic, upended the rule of law, given the United States the world’s costliest legal system, and inverted the Constitution’s federalism. Copland caps off his account with ideas for charting a corrective course back to democratic accountability.

There is no such thing as brute factuality, but rather only interpreted factuality. The historian's report is always the report of a perspective, a context, a framework; man is not, like God, beyond time and circumstance, condition and place. Man is neither a prime mover nor a prime viewer, but, to deny to man the status of a first cause and a first view is by no means to deny the validity or function of secondary causes and secondary viewers. The writing of history is always in terms of a framework, a philosophical and ultimately religious conceptual structure in the mind of the historian. To the orthodox Christian, the shabby incarnations of the reigning historiographies are both absurd and offensive. They are idols, and he is forbidden to bow down to them and must indeed wage war against them. A Christian historiography and a Christian revisionism are thus for him moral imperatives. For Christian revisionism, there is thus an incarnation that stands as the central point in history, Jesus Christ, and, this incarnation was without confusion of the eternal and the temporal, the divine and the human. This requires a denial of any coming, continuing, or possible incarnation in any historical order or institution. The divinization of church, state, school, or any other institution, or its absorption into the incarnation, is thus a sign of paganism. These essays are studies in Christian revisionism. There purpose is to call attention those aspects of American history currently neglected. Originally published in 1965, these essays were a continuation of the author's previous work, This Independent Republic.

If I am right, then no war against terrorism can be effectively fought using the left-wing premises that are now accepted doctrine among mainstream liberals and Democrats.” Whenever Muslims charge that the war on terror is really a war against Islam, Americans hasten to assure them they are wrong. Yet as Dinesh D’Souza argues in this powerful and timely polemic, there really is a war against Islam. Only this war is not being waged by Christian conservatives bent on a moral crusade to impose democracy abroad but by the American cultural left, which for years has been vigorously exporting its domestic war against religion and traditional morality to the rest of the world. D’Souza contends that the cultural left is responsible for 9/11 in two ways: by fostering a decadent and depraved American culture that angers and repulses other societies—especially traditional and religious ones— and by promoting, at home and abroad, an anti-American attitude that blames America for all the problems of the world. Islamic anti-Americanism is not merely a reaction to U.S. foreign policy but is also rooted in a revulsion against what Muslims perceive to be the atheism and moral depravity of American popular culture. Muslims and other traditional people around the world allege that secular American values are being imposed on their societies and that these values undermine religious belief, weaken the traditional family, and corrupt the innocence of children. But it is not “America” that is doing this to them, it is the American cultural left. What traditional societies consider repulsive and immoral, the cultural left considers progressive and liberating. Taking issue with those on the right who speak of a “clash of civilizations,” D’Souza argues that the war on terror is really a war for the hearts and minds of traditional Muslims—and traditional peoples everywhere. The only way to win the struggle with radical Islam is to convince traditional Muslims that America is on their side. We are accustomed to thinking of the war on terror and the culture war as two distinct and separate struggles. D’Souza shows that they are really one and the same. Conservatives must recognize that the left is now allied with the Islamic radicals in a combined effort to defeat Bush’s war on terror. A whole new strategy is therefore needed to fight both wars. “In order to defeat the Islamic radicals abroad,” D’Souza writes, “we must defeat the enemy at home.”
