Download or read book Migration Law in Montenegro written by Miloš Vukčević and published by Kluwer Law International B.V.. This book was released on 2022-03-21 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph on the rules on immigration and right of residence of non-nationals in Montenegro examines the legal and administrative conditions for persons not having the citizenship of a State to enter the country and to stay and reside there. It provides a survey of the subject that is both usefully brief and sufficiently detailed to answer most questions likely to arise in any pertinent legal setting. It follows the common structure of all monographs appearing in the International Encyclopaedia for Migration Law, thus allowing easy comparison between the country studies. As migration and economic activities are often interlinked, the analysis pays particular attention to labour market access and regulation of self-employed activities for non-nationals. The book describes the status of such specific categories of persons as students, researchers, temporary workers, and asylum seekers, as well as the position of family members, detailing applicable legislation and providing practical information on administrative procedures, sanctions, and legal remedies and guarantees. The impact of international human rights law and various bilateral and multilateral agreements is considered, along with the broader application of national and local law to non-citizens in such areas as family relations, labour, social security, and education. Lawyers, scholars, practitioners, policymakers, government administrations, and non governmental organizations involved in the development, practice and study of migration law will find this book indispensable. It will be welcomed by lawyers representing parties with interests in Montenegro and immigration specialists in both public and private organizations. Academics and researchers also will appreciate its value in the study of comparative trends and harmonization initiatives affecting migrants.
Download or read book Europeanizing Montenegro written by Vladimir Vuckovic and published by Rowman & Littlefield. This book was released on 2021-06-24 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: The volume aims to examine Europeanization of Montenegro, a regional frontrunner among all Western Balkans in the EU integration process, through EU impact on domestic governmental changes by focusing on three political membership conditions of the EU: judicial reform, fight against the corruption, and development of regional cooperation and good neighbourly relations. This book is based on the argument of the EU transformative power having produced negatively reinforcing effects in key accession criteria in the candidate country within the ten years of integration period. The given deficiency of fulfilment of political conditions in Montenegro is, on the one hand, primarily the result of an inconsistent and inefficient EU conditional policy, and unfavourable domestic factors to appropriately conduct reform activities, thus resulting in generally weak and mitigating reform progress. In addition, the book has claimed that the effective adoption and alignment with the EU accession demands does not solely depend on interdependency of the EU and domestic factors (as it was explained by the Schimmelfennig and Sedelmeier theory of Europeanization), but rather it also substantially depends on influence of other international factors, namely the influence of Russia and China in the Western Balkan region. The state’s possibility to choose the policies of alternatives instead of opportunities i.e. to cooperate with other international factors which do not question political legitimacy of the domestic ruling elites nor do they interfere into internal political affairs, has significantly affected reduction of euphoria for the advance in the EU accession process with the domestic political leaders. The current EU foreign policy in the form of the enlargement process more likely contains characteristics of charade in the process of European integration of Montenegro. This particular point may be witnessed not only when the case of Montenegro is taken into consideration, but also when the rest of the Balkans is, in terms of the EU enlargement policy that is, analysed.

Available in PDF, EPUB and Kindle. Book excerpt: The Constitutional Courts of Small Jurisdictions identifies features and challenges common to the constitutional courts of small state jurisdictions in Europe. For each country’s constitutional court, the following matters are examined: the history of the court; its composition; its standing and the types of proceedings; jurisdiction of the court; procedural steps and rules; the nature and effect of the decisions rendered; relations with other courts (CJEU, ECHR, etc.); and current issues and future developments. The book concludes by identifying some common features and challenges that constitutional courts of small states are confronted with, formulating recommendations for other small state jurisdictions across the world. This book will be of great interest and use to practitioners and scholars working in and researching constitutional law in general, and constitutional courts in particular. It will be invaluable for those dealing with small states, as it pays attention to an often forgotten - but important - aspect of the rule of law, and thus also of democracy.

Download or read book Integrating the Western Balkans into the EU written by Milica Uvalić and published by Springer Nature. This book was released on 2023-07-25 with total page 462 pages. Available in PDF, EPUB and Kindle. Book excerpt: Among the main stumbling blocks of European Union-Western Balkan integration are the differences in perceptions on both sides. Today, the gap between what the Western Balkan politicians and citizens think about the European Union and what the politicians and citizens in the EU member states think about the Western Balkans is probably wider than ever. This volume offers fresh insights about these misperceptions and how to possibly bridge the gap. It examines perceptions about the region’s “European perspectives” both on the side of the six Western Balkan countries - Albania, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia and Serbia – and the key European Union member states (Italy, Germany, Croatia), international donors, USA. An analysis of the diverse views regarding the prospects of EU – Western Balkan integration is today highly relevant, in view of the current uncertainties regarding European Union’s enlargement policy, particularly after the attack of Russia on Ukraine and candidate status granted to Ukraine and Moldova.

Download or read book Responding to Imperfection written by Sanford Levinson and published by Princeton University Press. This book was released on 1995-01-24 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: An increasing number of constitutional theorists, within both the legal academy and university departments of government, are focusing on the conceptual and political problems attached to the notion of constitutional amendment. Amendments are, among other things, recognitions of the imperfection of existing schemes of government. The relative ease or difficulty of amendment has significant implications for the ways that governments respond to problems that call either for new structures of governance or new powers for already established structures. This book brings together essays by leading legal authorities and political scientists on a range of questions from whether the U.S. Constitution is subject to amendment by procedures other than those authorized by Article V to how significant change is conceptualized within classical rabbinic Judaism. Though the essays are concerned for the most part with the American experience, other constitutional traditions are considered as well. The contributors include Bruce Ackerman, Akhil Reed Amar, Mark E. Brandon, David R. Dow, Stephen M. Griffin, Stephen Holmes and Cass R. Sunstein, Sanford Levinson, Donald Lutz, Walter Murphy, Frederick Schauer, John R. Vile, and Noam J. Zohar.

Download or read book A History of Yugoslavia written by Marie-Janine Calic and published by Purdue University Press. This book was released on 2019-02-15 with total page 443 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why did Yugoslavia fall apart? Was its violent demise inevitable? Did its population simply fall victim to the lure of nationalism? How did this multinational state survive for so long, and where do we situate the short life of Yugoslavia in the long history of Europe in the twentieth century? A History of Yugoslavia provides a concise, accessible, comprehensive synthesis of the political, cultural, social, and economic life of Yugoslavia—from its nineteenth-century South Slavic origins to the bloody demise of the multinational state of Yugoslavia in the 1990s. Calic takes a fresh and innovative look at the colorful, multifaceted, and complex history of Yugoslavia, emphasizing major social, economic, and intellectual changes from the turn of the twentieth century and the transition to modern industrialized mass society. She traces the origins of ethnic, religious, and cultural divisions, applying the latest social science approaches, and drawing on the breadth of recent state-of-the-art literature, to present a balanced interpretation of events that takes into account the differing perceptions and interests of the actors involved. Uniquely, Calic frames the history of Yugoslavia for readers as an essentially open-ended process, undertaken from a variety of different regional perspectives with varied composite agenda. She shuns traditional, deterministic explanations that notorious Balkan hatreds or any other kind of exceptionalism are to blame for Yugoslavia’s demise, and along the way she highlights the agency of twentieth-century modern mass society in the politicization of differences. While analyzing nuanced political and social-economic processes, Calic describes the experiences and emotions of ordinary people in a vivid way. As a result, her groundbreaking work provides scholars and learned readers alike with an accessible, trenchant, and authoritative introduction to Yugoslavia's complex history.
Download or read book Montenegro in Transition written by Florian Bieber and published by . This book was released on 2003 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Now that the third Yugoslavia has ended and the new union of Serbia and Montenegro emerged, Montenegro still remains largely unknown. The path of this smallest republic of former Yugoslavia has differed from the rest of the country during the past decade. Montenegro emerged as the only republic not to be engulfed in armed conflict. At the same time, it remained together with Serbia part of the Federal Republic of Yugoslavia and will continue to form a loose union with Serbia for the coming three years. This book seeks to close an important gap in the literature on the former Yugoslavia. As the first overview over political, historical, and economic developments in Montenegro during the past decade in English, it seeks to offer a nuanced assessment of the difficulties encountered by Montenegro during the violent disintegration of Yugoslavia. The articles cover all major aspects for understanding contemporary Montenegro; from its historical origins and the identity of Montenegrin to political, economic developments and an overview of minority-majority relations. In addition, the book surveys the dispute over Montenegrin independence and the Belgrade agreement of March 2002. The book is not only of interest for those seeking to understand contemporary Montenegro, but also for scholars and students interested in the dissolution of Yugoslavia and the conflicts and post-war transition in which the former Yugoslav space is engaged.
