Book excerpt: "This document serves as Final Amendment 3 to the Skate FMP, the Final Environmental Impact Statement (FEIS) which updates and supplements the original EIS for the skate fishery (available at http://www.nefmc.org/skates/fmp/fmp.htm), and a Stock Assessment and Fishery Evaluation (SAFE) Report (Section 7.0 of this document). The purpose of the amendment is to propose and consider modifications of existing management measures or new skate fishery management measures to address the following issues: Overfished status of thorny skates; Overfishing of thorny skate; Implementation of annual catch limits (ACLs) and accountability measures (AMs), a new mandate of the reauthorized Magnuson-Stevens Act; and A baseline review process that has become obsolete and less meaningful. The amendment also includes a new discussion and quantification of maximum sustainable yield (MSY; Section 4.1.2) and optimum yield (OY; Section 4.3). Quantification of these variables was not previously possible in the Skate FMP, due to problems with catch data and missing life history information about skates. Some of these issues have been resolved, but others have not. However the analysis of rebuilding potential in Section 8.3.1.1 has implications for sustainable catches. The estimated values at the biomass targets can serve as interim estimates or proxy values for MSY and OY, at least until better information comes forth about the population dynamics of skate species and catch reporting improves"--Executive summary (p. 3).

Book excerpt: "Framework Adjustment I to the Northeast Skate Complex Fishery Management Plan (Skate FMP) implements several measures affecting the skate wing fishery. Framework Adjustment I was developed by the New England Fishery Management Council (Council) to adjust the possession limits for the skate wing fishery in order to slow the rate of skate wing landings, so that the available Total Allowable Landings limit (TAL) is taken by the fishery over a longer duration in the fishing year (FY) than occurred in FY 2010, thus ensuring a steady market supply. The action would also allow vessels that process skate wings at sea to land skate carcasses for sale into the bait market, without counting the carcass landings against the TAL (skate wings are already converted to live weight for monitoring). Although recommended by the Council as part of Framework I, NMFS has disapproved a proposal to increase the incidental possession limit for skate wings that would apply after the skate wing possession limit trigger is reached. Book excerpt: "New England, the New England Fishery Management Council (NEFMC) is charged with developing management plans that meet the requirements of the Magnuson-Stevens Act (M-S Act). The Northeast Skate Complex Fishery Management Plan (FMP) specifies the management measures for seven skate species (barndoor, clearnose, little, rosette, smooth, thorny and winter skates) off the New England and Mid-Atlantic coasts. The FMP has been updated through a series of amendments, framework adjustments and specification packages. Amendment 3 to the FMP established a control rule for setting the Skate Allowable Biological Catch (ABC) based on survey biomass indices and median exploitation ratios; the ABC was set to equal the Annual Catch Limit (ACL). This framework action would implement changes to specifications based on updated data and research and would revise the Vessel Trip Report (VTR) and seafood dealer reporting requirements. The need for this action is to set the annual catch limit specifications for FY 2014 and FY 2015 to maintain the skate fisheries while adequately minimizing the risk of overfishing the seven skate stocks. A revised ACL is needed to address overfishing of winter skate. This action also proposes to change the skate wing VTR and dealer reporting requirements by removing the unclassified code and the codes for species not landed in the fishery --little, little/winter, rosette and smooth skate. It also proposes to remove the unclassified code for the bait fishery. This is expected to improve fishery-dependent data on skate landings by species, which is a requirement of the FMP. There are several purposes: to adopt specifications, to adopt possession limits and to modify the VTR and dealer reporting requirements"--Executive summary.

The DEIS and proposed rule considered measures to reduce fishing mortality and effort in order to rebuild overfished Atlantic shark species while ensuring that a limited shark fishery could be maintained. Additionally, NMFS proposed adding smooth dogfish under NMFS management due to growing concerns regarding the status of this unmanaged species. The Final Environmental Impact Statement (FEIS) describes a range of alternatives that could impact shark fishermen and dealers including modifying commercial quotas, modifying commercial gear restrictions, establishing a rebuilding plan for overfished stocks, establishing measures to prevent overfishing, modifying recreational measures, and establishing management measures for smooth dogfish"--Abstract.
