Book Democracy by Decree

Download or read book Democracy by Decree written by Adis Merdzanovic and published by Columbia University Press. This book was released on 2015-08-01 with total page 437 pages. Available in PDF, EPUB and Kindle. Book excerpt: The introduction of consociational power sharing as a post-war political system has become one of the international community's preferred post-conflict devices. In situations where warring polities are internally divided by ethnic, religious, linguistic, or national identity, consociationalism guarantees the inclusion of all groups in the political process and prevents a ‘tyranny' of the majority over one or more minorities. However, if international actors keep intervening in the political process, the advantages of consociationalism are turned upside down.In this exceptional book, Adis Merdzanovic develops a theoretical and empirical approach to understanding consociational democracies that include external intervention. Using the case of Bosnia and Herzegovina, where the consociational Dayton Peace Agreement ended the three-year war between Serbs, Croats, and Bosniaks twenty years ago, it elaborates on the different approaches used in the past and gives practical recommendations for future state-building exercises by the international community.

Book Unconstitutional Constitutional Amendments

Download or read book Unconstitutional Constitutional Amendments written by Yaniv Roznai and published by Oxford University Press. This book was released on 2017-02-23 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can constitutional amendments be unconstitutional? The problem of 'unconstitutional constitutional amendments' has become one of the most widely debated issues in comparative constitutional theory, constitutional design, and constitutional adjudication. This book describes and analyses the increasing tendency in global constitutionalism to substantively limit formal changes to constitutions. The challenges of constitutional unamendability to constitutional theory become even more complex when constitutional courts enforce such limitations through substantive judicial review of amendments, often resulting in the declaration that these constitutional amendments are 'unconstitutional'. Combining historical comparisons, constitutional theory, and a wide comparative study, Yaniv Roznai sets out to explain what the nature of amendment power is, what its limitations are, and what the role of constitutional courts is and should be when enforcing limitations on constitutional amendments.

Book Dismembering the State

    Book Details:
  • Author : P. H. Liotta
  • Publisher : Lexington Books
  • Release : 2001
  • ISBN : 9780739102121
  • Pages : 654 pages

Download or read book Dismembering the State written by P. H. Liotta and published by Lexington Books. This book was released on 2001 with total page 654 pages. Available in PDF, EPUB and Kindle. Book excerpt: P. H. Liotta's previous book, The Wreckage Reconsidered, was acclaimed as a tour de force of scholarship. In Dismembering the State, Liotta continues to challenge numerous assumptions about the disintegration of Yugoslavia. His research uses an "ecological," or holistic, perspective to address interwoven questions such as the role of military intervention as coercive diplomacy, the use of chaos as a strategy against America's and NATO's technological military predominance, and the influence of post-Cold War European democratic and economic reforms. This book considers how a host of factors, from 1991 to 1999, combined to contribute significantly to both the disintegration of the nation-state and to the continued instability of the present states of the former Yugoslavia. Of interest to both scholars and sophisticated lay readers, Liotta has fashioned a scholarly assessment of this timely and complex topic that promises to be as innovative as it is erudite.

Book A Constitution of the People and How to Achieve It

Download or read book A Constitution of the People and How to Achieve It written by Aarif Abraham and published by BoD – Books on Demand. This book was released on 2021-04-30 with total page 382 pages. Available in PDF, EPUB and Kindle. Book excerpt: Britain does not have a written constitution. It has rather, over centuries, developed a set of miscellaneous conventions, rules, and norms that govern political behavior. By contrast, Bosnia’s constitution was written, quite literally, overnight in a military hanger in Dayton, USA, to conclude a devastating war. By most standards it does not work and is seen to have merely frozen a conflict and all development with it. What might these seemingly unrelated countries be able to teach each other? Britain, racked by recent crises from Brexit to national separatism, may be able to avert long-term political conflict by understanding the pitfalls of writing rigid constitutional rules without popular participation or the cultivation of good political culture. Bosnia, in turn, may be able to thaw its frozen conflict by subjecting parts of its written constitution to amendment, with civic involvement, on a fixed and regular basis; a ’revolving constitution’ to replicate some of that flexibility inherent in the British system. A book not just about Bosnia and Britain; a standard may be set for other plural, multi-ethnic polities to follow.

Book Former Yugoslavia Through Documents

Download or read book Former Yugoslavia Through Documents written by Snezana Trifunovska and published by Martinus Nijhoff Publishers. This book was released on 1999-05 with total page 1394 pages. Available in PDF, EPUB and Kindle. Book excerpt: From the end of the 1980s and beginning of the 1990s onwards, the world's attention has been occupied with the events which eventually led to the dissolution of the Socialist Federal Republic of Yugoslavia and to the creation of five independent and sovereign states. Apart from the humanitarian disaster and the devastated economies of the countries created on the territory of the former Yugoslavia, it brought some important issues of international law to the forefront, and provided the impetus for some new and rapid developments. The book is an epilogue to the first, very successful, collection Yugoslavia through Documents: from its creation to its dissolution, published by Martinus Nijhoff Publishers in 1994. However, because of the complexity of the issues in the political, military, humanitarian and legal fields, its structure is different. The book is divided into an Introduction and nine Parts, each of them dealing with specific issues and containing, where appropriate, the Editor's note, comment or additional information. These two volumes constitute an absolutely essential collection for all research libraries.
