Book excerpt: Spanish Abstract: La aprobación el 28 de julio 1994 y 3 de agosto de 1995, respectivamente, del Acuerdo relativo a la aplicación de la Parte XI de la Convención de las Naciones Unidas sobre el Derecho del Mar de 10 de diciembre, 1982 y el Acuerdo sobre la Aplicación de las Disposiciones de la misma Convención sobre la conservación y ordenación de poblaciones de peces transzonales y las poblaciones de peces altamente migratorios ha servido no sólo para despejar el camino para la participación universal tan deseada en la Convención de Jamaica, pero sobre todo para llevar una interesante redistribución de poderes en relación con la gestión de lo que la doctrina llamada anglosajona comunes internacionales o comunes de la humanidad. En este sentido, como es bien sabido, las principales opciones teóricas abrazaron dos categorías de Derecho Romano: la res communis y la res publica. Aunque tradicionalmente las normas aplicables a los recursos pesqueros de alta mar parecían coincidir en gran medida, con el contenido de la primera, la regulación de la ZFMO, a través del concepto de patrimonio común de la humanidad, parece reflejar la aspiración de la Comunidad Internacional a proporcionar a este recurso de un régimen de gestión verdaderamente comunal. Los cambios introducidos por los dos convenios demuestran la fragilidad de ambas categorías cuando los intereses económicos en juego superan un determinado umbral. Por otra parte, el análisis de los argumentos discursivos utilizados por algunos Estados cuando se habla de la reorganización de algunos de los recursos pesqueros de alta mar demuestra una característica del derecho internacional ampliamente destacado por los autores de los Critical Legal Studies, una característica que tiene profundas implicaciones prácticas a la hora de elegir una opción metodológica para estudiarlo: su carácter indeterminado que lo convierte en un arma en el juego diplomático de poder entre estados.

Book excerpt: Until recently, the international community failed to adopt either an agreed limit for the breadth of the territorial sea or a satisfactory regime of fisheries in the waters adjacent to the territorial sea. This provoked an eruption of unilateral acts by which coastal states extended their jurisdiction towards the high seas. The Third U.N. Conference on the Law of the Sea accepted the establishment of a 12-mile territorial sea and a 200-mile exclusive economic zone. While taking into account the non-existent rights and interests of the so-called geographically disadvantaged states and of states with broad continental shelves, the 1982 Convention on the Law of the Sea practically ignored existing rights and interests of habitual fishing states. It maintained the well-established principle of freedom of fishing on the high seas but with specific conditions. Dissatisfied with the Convention's regulation of fishing on the high seas, a few states elected to hold a U.N. Conference on Straddling and Highly Migratory Fish Stocks which adopted the 1995 Agreement for the implementation of the provisions of the Convention relating to the conservation and management of such stocks. Similarly, some of these states, like Chile, Argentina, and Canada, adopted legislation extending their jurisdiction beyond their respective 200-mile fishing or exclusive economic zones. This book explores these events in the historical development of the international regulations of fisheries and concludes with a look into recent developments in the area.
