Book excerpt: Le présent document juridique vise principalement à aider les décideurs et les praticiens à concevoir des mesures législatives propres à améliorer les moyens de subsistance des agriculteurs familiaux, en mettant en relief combien il est important de définir l’agriculture familiale et certaines de ses caractéristiques les plus courantes et en donnant des exemples provenant de différentes parties du monde. Bien que chaque contexte donne lieu à une définition spécifique de l’agriculture familiale, certaines définitions étant, de par ce qu’elles englobent, plus larges ou plus étroites que d’autres, les multiples définitions font apparaître des éléments récurrents qui laissent entrevoir des points communs à travers les régions et les langues. Les auteurs ont cherché à apporter des éléments de réponse à trois questions: 1) en quoi une définition juridique de l’agriculture familiale peut-elle aider à mener des interventions législatives propres à améliorer les moyens de subsistance des agriculteurs familiaux, 2) comment mettre en place des mesures législatives spécifiques pour appuyer l’agriculture familiale, et 3) quelles sont les principales caractéristiques des législations qui définissent l’agriculture familiale; à cet effet, ils ont examiné 22 cas concrets et précis qui, issus de l’expérience de 21 pays et d’une région, dépeignent une grande diversité géographique, socioéconomique et culturelle.Dans ce contexte, le présent document analyse principalement les mesures législatives favorables à l’agriculture familiale au moyen de définitions claires et adaptées tout en présentant des exemples, les points communs et les différences de pratique législative qui existent entre différentes parties du monde, ainsi que diverses questions inhérentes aux moyens de subsistance des personnes pratiquant l’agriculture familiale. Après avoir établi le contexte juridique sur lequel se fondent, principalement, les interventions législatives favorables à l’agriculture familiale, il aborde les caractéristiques spécifiques des définitions à travers divers exemples avant d’examiner ce qui lie étroitement les processus législatifs et politiques, présentés à travers divers exemples de mesures législatives multisectorielles prises pour améliorer les moyens de subsistance des agriculteurs familiaux.
