Book Contracting States

Download or read book Contracting States written by Alexander Cooley and published by Princeton University Press. This book was released on 2009-04-20 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: Increasingly today nation-states are entering into agreements that involve the sharing or surrendering of parts of their sovereign powers and often leave the cession of authority incomplete or vague. But until now, we have known surprisingly little about how international actors design and implement these mixed-sovereignty arrangements. Contracting States uses the concept of "incomplete contracts"--agreements that are intentionally ambiguous and subject to future renegotiation--to explain how states divide and transfer their sovereign territory and functions, and demonstrate why some of these arrangements offer stable and lasting solutions while others ultimately collapse. Building on important advances in economics and law, Alexander Cooley and Hendrik Spruyt develop a highly original, interdisciplinary approach and apply it to a broad range of cases involving international sovereign political integration and disintegration. The authors reveal the importance of incomplete contracting in the decolonization of territories once held by Europe and the Soviet Union; U.S. overseas military basing agreements with host countries; and in regional economic-integration agreements such as the European Union. Cooley and Spruyt examine contemporary problems such as the Arab-Israeli dispute over water resources, and show why the international community inadequately prepared for Kosovo's independence. Contracting States provides guidance to international policymakers about how states with equally legitimate claims on the same territory or asset can create flexible, durable solutions and avoid violent conflict.

Book Alternative Contracting Methods in the U S Army Corps of Engineers

Download or read book Alternative Contracting Methods in the U S Army Corps of Engineers written by Craig Lance Simoneau and published by . This book was released on 1992 with total page 108 pages. Available in PDF, EPUB and Kindle. Book excerpt: This thesis examines the contracting methods used by the United States Army Corps of Engineers (USACE). While USACE typically uses the traditional approach to construction contracting, they have recently begun using two forms of a design/build method. The traditional method uses separate design and construction firms. The construction contract is generally a firm fixed-price contract awarded in open competition to the lowest responsible bidder. This study found that there are many disadvantages to using this method, especially when it is used almost exclusively. The design/build approach employs a single organization to perform both the design and construction of a project. The two variations used by the Corps, the One-Step Negotiated process and the Two-Step Sealed Bidding process provide flexibility to USACE in their construction contracting. The primary advantages of the design/build methods are a savings of time, a reduction in costs, a reduction in time-consuming and costly disputes, allowing competition between designs, and the ability to award contracts based on quality as well as price. The environmental area, mobilization requirements, and base closure projects were all found to be particularly suitable for design/build use.

Book Understanding Capital Improvements

Download or read book Understanding Capital Improvements written by W.A. Flickinger and published by Page Publishing Inc. This book was released on 2024-06-25 with total page 218 pages. Available in PDF, EPUB and Kindle. Book excerpt: All townships, cities, counties, and states perform capital improvements using public funds and, often, additional funding from other governmental agencies. All expenditures are regulated by city or county codification of ordinances, state statutes, or Federal Acquisition Regulations. All capital improvements are subject to audit by the institutions providing the funding. All ordinances, state statutes, and the Federal Acquisition Regulations provide regulations or laws that require specific adherence to many issues in order to maintain funding or be eligible for future funding. Under audit, the governmental agency performing or that has performed the capital improvements must show documentation that exhibits adherence to all the requirements. Unfortunately, the various regulations and laws do not provide the means or methods to document the required compliance. This book provides an understanding of the capital improvement process and various methods of documentation, including specific language within supplied forms and contract front-end documents that will support and provide the necessary documentation showing adherence to the regulations and laws. The proper understanding of the process and documentation may be the difference between a successful audit or a failure and possibly the loss of current or future funding.
