Book excerpt: This book offers a radical new understanding of law, beyond the confines of its formalization by the state. The book takes off from the late work of Gilles Deleuze and Michel Foucault, for whom law and its institutions came to be liberated from an ideological perspective that had treated them as sterile instruments for the reproduction of domination. Engaging its continental history, it addresses the concept of law, not merely as a ‘command’, but as the result of a much more complex legal operation aimed at dynamically stabilizing the social relations of a community. The book thus sidesteps the usual legal-political focus on those – from Hobbes to Schmitt – who have contributed to the categorical scheme of the modern state, and with it questions of political representation, sovereignty, the rigid distinction between public law and private law, and so on, as it pursues an alternative theoretical trajectory through Ravaisson, Tarde, and Hauriou. Politics, the book maintains, can be no longer be treated simply through the state form. And, relatedly, the law must be seen as a living law: a law that cannot be treated exclusively in formal terms, but must be taken as a grammar capable of articulating a politics of process, relationality, and innovation. Reconceived as such, law can then circumvent the aporias that arise when society is viewed as a private company, and the state seen as the bearer of the only possible means of formalizing its relationships. At the intersection of law and political theory, this book will speak to scholars and others with interests in both these areas, and especially those concerned with the limits of both conventional and critical approaches to law.

Book excerpt: The hypothesis from which this book starts is that the twentieth century has broken the link between time and history, thus producing a twofold consequence. On the one hand, time definitively loses the characteristics of linearity and coherence that it still had in Hegel, and will be conceived in terms of a multiplicity of heterogeneous temporal lines; on the other hand, and consequently, history tends to disappear from the philosophical horizon to give way to theses on a post-historical time, whose main characteristics are stasis, the inability to synthesize incoherent temporalities, the impossibility of producing openings towards the future. However, precisely within the short century – the one in which time has supposedly contracted to the point of expunging history from itself – critical reflections were produced, which, despite the acquisition of scientific and philosophical lessons about the multi- form and reversible nature of time, have recovered a fruitful relation with history in a cumulative and teleological sense.

Book excerpt: In the 1930s translation became a key issue in the cultural politics of the Fascist regime due to the fact that Italy was publishing more translations than any other country in the world. Making use of extensive archival research, the author of this new study examines this 'invasion of translations' through a detailed statistical analysis of the translation market. The book shows how translations appeared to challenge official claims about the birth of a Fascist culture and cast Italy in a receptive role that did not tally with Fascist notions of a dominant culture extending its influence abroad. The author shows further that the commercial impact of this invasion provoked a sustained reaction against translated popular literature on the part of those writers and intellectuals who felt threatened by its success. He examines the aggressive campaign that was conducted against the Italian Publishers Federation by the Authors and Writers Union (led by the Futurist poet F. T. Marinetti), accusing them of favouring their private profit over the national interest. Finally, the author traces the evolution of Fascist censorship, showing how the regime developed a gradually more repressive policy towards translations as notions of cultural purity began to influence the perception of imported literature.

Two approaches have been particularly influential – one indebted to the thought of Martin Heidegger, the other indebted to Gilles Deleuze. While opposed in their political thrust and orientation, both approaches remain trapped within the political ontology that has framed our conceptual language for some time. In order to move beyond this political ontology, Esposito turns to a third approach that he characterizes as ‘instituting thought’. Indebted to the work of the French political philosopher Claude Lefort, this third approach recognizes that the road to reconstructing a productive relation between ontology and politics, one that is both realistic and innovative, lies in instituting praxis. Building on this insight, Esposito conceptualizes social being as neither univocal nor plurivocal but as cross-cut by the dual semantics of political conflict. Taking Homer’s Iliad—that “great prism through which every gesture has the possibility of becoming public, precisely by being observed by others”— as the common origin and point of departure for our understanding of Western philosophical and political traditions, Esposito examines the foundational relation between war and the political. Drawing actively and extensively on Arendt’s and Weil’s voluminous writings, but also sparring with thinkers from Marx to Heidegger, The Origin of the Political traverses the relation between polemos and polis, between Greece, Rome, God, force, technicity, evil, and the extension of the Christian imperial tradition, while at the same time delineating the conceptual and hermeneutic ground for the development of Esposito’s notion and practice of “the impolitical.” In Esposito’s account Arendt and Weil emerge “in the inverse of the other’s thought, in the shadow of the other’s light,” to “think what the thought of the other excludes not as something that is foreign, but rather as something that appears unthinkable and, for that very reason, remains to be thought.” Moving slowly toward their conceptualizations of love and heroism, Esposito unravels the West’s illusory metaphysical dream of peace, obliging us to reevaluate ceaselessly what it means to be responsible in the wake of past and contemporary forms of war.
