They settled on the name Ratel, which means honey badger in Afrikaans. But how could a creature no bigger than a dog be the fiercest animal in a land full of lions, leopards, and rhinos? If you had ever seen a honey badger fight, however, you would understand their decision. Honey badgers are known across Africa and parts of Asia as animals that no one wants to mess with. Their powerful jaws, sharp claws, and courageous spirit have earned them the distinction of “world’s most fearless animal” from Guinness World Records. Honey badgers are fearless because they have to be. Their fast metabolisms force them to hunt constantly to keep their energy levels up, so they eat almost anything regardless of the danger. They will put up with hundreds of bee stings, for example, because they love honey and bee larvae. Not only that, but they regularly make a meal of poisonous snakes—including ones with venom strong enough to melt human skin. It turns out that the secret to honey badgers’ exceptional toughness is their skin. A honey badger’s skin is so thick that it can resist knives, spears, and arrows. At the same time, it’s also very loose, which allows them to twist around and attack any animals that manage to get hold of them. The only safe place to grab a honey badger is at the back of its neck, but you probably wouldn’t want to get that close. Similar to skunks, honey badgers are able to send enemies running by releasing a foul-smelling substance when they are in danger. Some people believe that this substance also has a calming effect on bees, allowing the badgers to more easily gain access to their favorite treats. When strength and skills aren’t enough to get the honey badger what it wants, it uses its brains. Amazingly, honey badgers have been seen using tools to get to prey beyond their reach. So, if you ever run across one of these creatures, step back and give it some respect. At its ninth session (7 December 2018), the Committee adopted a set of amendments to the sixth revised edition of the Manual as amended by Amendment 1. This seventh revised edition takes account of these amendments. In addition, noting that the work to facilitate the use of the Manual in the context of the GHS had been completed, the Committee considered that the reference to the "Recommendations on the Transport of Dangerous Goods" in the title of the Manual was no longer appropriate, and decided that from now on, the Manual should be entitled "Manual of Tests and Criteria".

This failure is explained by exploring the changing character of conflict in current and emergent global circumstances, such as asymmetrical conflicts, insurgencies, and terrorism. Fry argues that this pluralisation of war has broken the binary relation between war and peace: conflict is no longer self-evident, and consequentially the changes in the conditions, nature, systems, philosophies and technologies of war must be addressed. Through a deep understanding of contemporary war, Fry explains why peace fails as both idea and process, before presenting ‘Unstaging War’ as a concept and nascent practice that acknowledges conflict as structurally present, and so is not able to be dealt with by attempts to create peace. Against a backdrop of increasingly tense relations between global power blocs, the beginnings of a new nuclear arms race, and the ever-increasing human and environmental impacts of climate change, a more viable alternative to war is urgently needed. Unstaging War is not claimed as a solution, but rather as an exploration of critical problems and an opening into the means of engaging with them.

However, in seeking to strike a balance between national and international interests, its application differs in the two areas of practice. This deeply researched and authoritative work, which explains the policy issues and how non-discrimination analysis works, provides a comprehensive review of non-discrimination rules in WTO and tax treaty law, combining a critical commentary on case law with proposals for an innovative concept for solving cases of discrimination in tax treaty law. Among the practical issues affecting non-discrimination examined in detail are the following: implications that can be drawn from the concepts of non-discrimination under WTO law and Article 24 of the OECD Model; direct and indirect discrimination and analysis of comparability in WTO law and tax treaty law; the MFN and NT rules under the GATT and GATS; the meaning of ‘likeness’ and ‘less favourable treatment’; claiming non-discriminatory tax treatment before tax administrations and courts under a tax treaty; justification of measures against harmful tax competition, low taxation and hybrid mismatch arrangements; thin capitalisation rules, progressive tax rates, foreign losses, group taxation and relief from juridical and economic double taxation under Article 24 of the OECD Model; and integrating a justification defence into any stage of a non-discrimination analysis. The author establishes to what extent formal, substantive and subjective approaches may be applied in a non-discrimination analysis, providing the reasons for the approaches taken. A two-step comparability procedure is applied to selected cases of potential tax discrimination, demonstrating how policy arguments can be addressed under Article 24 of the OECD Model. Drawing on over a half-century of case law in both areas of practice, this comprehensive study of the non-discrimination rules under WTO law and international tax law will be invaluable in systematically solving cases of tax discrimination under Article 24 of the OECD Model and putting forward arguments at any stage of a WTO analysis. Policymakers will benefit from the author’s clear explanation of how national law should comply with international obligations. Also, taxpayers’ advisers will proceed confidently in claims of tax treaty discrimination, and academics will discover an incomparable overview and analysis of anti-discrimination rules in international trade law and double taxation conventions.
