Book The WTO and Technical Barriers to Trade

Download or read book The WTO and Technical Barriers to Trade written by Spencer Henson and published by Edward Elgar Publishing. This book was released on 2005 with total page 568 pages. Available in PDF, EPUB and Kindle. Book excerpt: This authoritative volume brings together for the first time the foremost research and commentary on technical barriers to trade. It explores the major theoretical issues associated with analysis of the impact of technical measures on trade in goods and the challenges associated with attempts to quantify impacts on trade flows. Previous empirical analyses of the impact of technical barriers on trade in goods in general are then presented. This is followed by in-depth coverage of the trade effects of sanitary and phytosanitary (SPS) measures, an area where analysis is particularly challenging. Finally, the volume concludes by exploring institutional efforts to overcome the impact of technical barriers, including harmonization of standards and the role of the WTO. The WTO and Technical Barriers to Trade will be an invaluable source of reference for academics, students and policymakers alike.

Book Environmental Process and Production Methods PPMs in WTO Law

Download or read book Environmental Process and Production Methods PPMs in WTO Law written by David Sifonios and published by Springer. This book was released on 2018-01-30 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the conditions under which PPM measures may be adopted under WTO law de lege lata and de lege ferenda. It analyses in detail the complex case law in this field and its evolution in the last 25 years, as well as the many doctrinal debates around PPM measures and their relevance in the light of the evolution of case law, both under the GATT and the TBT Agreement. Further, it also suggests an original approach to the interpretation of the relevant provisions of the GATT and the TBT Agreement in the context of PPM measures. The PPM issue has been one of the most debated topics in the trade and environment debate. Even though the US–Shrimp case showed that PPM measures are not prohibited per se under the GATT, many questions remain unanswered when it comes to the precise conditions under which environmental PPM measures are justifiable under WTO law, for example in the field of trade measures relating to climate change mitigation efforts, natural resources management policies and biodiversity conservation measures.

Book 2014 Report on Technical Barriers to Trade

Download or read book 2014 Report on Technical Barriers to Trade written by United States United States Trade Representative and published by CreateSpace. This book was released on 2015-03-28 with total page 102 pages. Available in PDF, EPUB and Kindle. Book excerpt: This year the USTR publishes its fifth annual Report on Technical Barriers to Trade (TBT Report). This report was created to respond to the concerns of U.S. companies, farmers, ranchers, and manufacturers, which increasingly encounter nontariff trade barriers in the form of product standards, testing requirements, and other technical requirements as they seek to sell products and services around the world. As tariff barriers to industrial and agricultural trade have fallen, some standards-related measures have emerged as a key concern. Governments, market participants, and other entities can use standards-related measures as an effective and efficient means of achieving legitimate commercial and policy objectives, such as protection of the environment, human health and safety. But when standards-related measures are outdated, overly burdensome, discriminatory, or otherwise inappropriate, these measures can reduce competition, stifle innovation, and create unnecessary technical barriers to trade. These kinds of measures can pose a particular problem for small and medium sized enterprises (SMEs), which often do not have the resources to address these problems on their own. USTR is committed to identifying and combating unwarranted technical barriers to U.S. exports, many of which are detailed in this report. Since the last TBT Report was released, the United States has significantly advanced its efforts to resolve concerns with standards-related measures that act as unjustifiable barriers to trade and to prevent their emergence. USTR will continue its work to resolve and prevent standards-related trade concerns through new and existing cooperative initiatives in the World Trade Organization (WTO), Asia Pacific Economic Cooperation Forum (APEC), U.S. free trade agreements (FTAs), and other fora. In addition USTR will continue working to conclude on the negotiation of a modernized Technical Barriers to Trade (TBT) chapter in the Trans-Pacific Partnership (TPP) that builds on and strengthens TBT disciplines contained in the WTO Agreement on Technical Barriers to Trade (TBT Agreement). In addition, in June 2013, President Obama and European Union (EU) leaders launched negotiations on a comprehensive trade and investment agreement, the Transatlantic Trade and Investment Partnership (T-TIP). As conveyed in the February 2013 United States-European Union High Level Working Group on Jobs and Growth (HLWG) Final Report, the United States and the EU are committed to working together to open markets in goods, services and investment, reduce nontariff barriers, and address global trade issues of common concern. Both parties seek to build on the horizontal disciplines of the WTO TBT Agreement, establish ongoing mechanisms for improved dialogue and cooperation for addressing bilateral technical barriers to trade (TBT) issues, and pursue opportunities for greater regulatory compatibility with the objective of reducing unnecessary costs stemming from regulatory differences in specific sectors. Again in 2014, USTR will engage vigorously with other agencies of the U.S. Government, as well as interested stakeholders, to press for tangible progress by U.S. trading partners in removing unwarranted or overly burdensome technical barriers. We will fully utilize our toolkit of bilateral, regional and multilateral agreements and mechanisms in order to dismantle unjustifiable barriers to safe, high quality U.S. industrial, consumer, and agricultural exports and strengthen the rules-based trading system. Recognizing that U.S. economic and employment recovery and growth continue to rely importantly on the strength of U.S. exports of goods, services, and agricultural products; we will be redoubling our efforts to ensure that the technical barriers that inhibit those exports are steadily diminished.

Book Harmonization Equivalence and Mutual Recognition of Standards in WTO Law

Download or read book Harmonization Equivalence and Mutual Recognition of Standards in WTO Law written by Humberto Zúñiga Schroder and published by Kluwer Law International B.V.. This book was released on 2011-07-01 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Standards are a feature of virtually all areas of trade in products and services. Yet, although standards may achieve an efficient economic exchange, they have discriminatory consequences for trading partners when governments formulate or apply them in such a way as to cause obstacles to trade, thus enrolling standards among the increasingly significant ‘non-tariff barriers’ regulated by the WTO. This unique and original study analyses the functions that standards fulfil in the market, their effect on trade, and the legal regime based on harmonization, equivalence and mutual recognition developed by the WTO to deal with standards. The author investigates the way in which both the WTO Technical Barriers to Trade (TBT) and the Sanitary and Phytosanitary (SPS) Measures Agreements regulate these three tools, and discusses key topics including: The definition of the concept ‘International Standard’ in the TBT Agreement. Guidelines on equivalence issued by organizations such as the Codex Alimentarius Commission, the World Organization for Animal Health and the International Plant Protection Convention. Parallels between the EC mutual recognition regime and the WTO system. This is the first work on its subject. With its detailed and practical analysis of WTO law on standards, the book is a fundamental reference for practitioners, academics and policy makers in international trade law.
