Book Redefining Federalism

Download or read book Redefining Federalism written by Douglas T. Kendall and published by Environmental Law Institute. This book was released on 2004 with total page 175 pages. Available in PDF, EPUB and Kindle. Book excerpt: If federalism is about protecting the states, why not listen to them? In the last decade, the Supreme Court has reworked significant areas of constitutional law with the professed purpose of protecting the dignity and authority of the states, while frequently disregarding the states'' views as to what federalism is all about. The Court, according to the states, is protecting federalism too much and too little. Too much, in striking down federal law where even the states recognize that a federal role is necessary to address a national problem. Too little, in inappropriately limiting state experimentation. By listening more carefully to the States, the Supreme Court could transform its federalism jurisprudence from a source of criticism and polarization to a doctrine that should win broad support from across the political spectrum. In this important book, six distinguished authors redefine federalism and reaffirm Justice Louis Brandeis's vision of states and localities as the laboratories of democracy.

Book The Environmental Case

Download or read book The Environmental Case written by Judith A. Layzer and published by CQ Press. This book was released on 2023-06-05 with total page 518 pages. Available in PDF, EPUB and Kindle. Book excerpt: Answers to environmental issues are not black and white. Debates around policy are often among those with fundamentally different values, and the way that problems and solutions are defined plays a central role in shaping how those values are translated into policy. The Environmental Case captures the real-world complexity of creating environmental policy, and this much-anticipated Sixth Edition contains 14 carefully constructed cases, including a new study of the Salton Sea crisis. Through her analysis, Sara Rinfret continues the work of Judith Layzer and explores the background, players, contributing factors, and outcomes of each case, and gives readers insight into some of the most interesting and controversial issues in U.S. environmental policymaking.

Book Sustaining the World s Wetlands

Download or read book Sustaining the World s Wetlands written by Richard Smardon and published by Springer Science & Business Media. This book was released on 2009-06-13 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: Wetlands throughout the world, including those described in this book are among the most sensitive and vulnerable ecosystems. They are critical habitats to the world’s migratory birds and a broad range of endangered mammal, reptile, amphibian, and plant species. They provide a broad range of flood storage, pollution control, water supply, ecotourism functions to indigenous peoples and country populations as a whole. They are also at the center of severe land and water use conflicts. These are conflicts between counties where wetland resources or the water supplies required for such resources involve more than one country. These are conflicts in use such as conflicts between habitat protection and charcoal production in mangroves. These are conflicts between groups of peoples such as indigenous peoples and hydropower advocates. Many wetlands have already been destroyed by water extractions, dams, levees, channelization, and fills. Others have been degraded by water pollution, overfishing and overhunting, timber harvest, and a host of other activities. This book describes these conflicts and international policies and institutions developed to protect and manage wetland resources. Most of the broader literature and other books on wetlands focuses on wildlife. Wildlife is described in the case studies, which follow. But, Richard Smardon provides us with more. He traces the history of conflicts and the development of policies and insti- tions to protect and manage wetland resources.

Book The Takings Issue

    Book Details:
  • Author : Robert Meltz
  • Publisher : Island Press
  • Release : 1998-12
  • ISBN : 9781597263283
  • Pages : 626 pages

Download or read book The Takings Issue written by Robert Meltz and published by Island Press. This book was released on 1998-12 with total page 626 pages. Available in PDF, EPUB and Kindle. Book excerpt: As challenges to land use and environmental controls by landowners and the property-rights movement have become more frequent, the concept of "takings" -- government action that excessively limits a property-owner's use of private land -- has become both increasingly familiar to the public, and increasingly problematic for planners, local officials, and anyone involved with making day-to-day decisions about land use. A vast and diverse body of case law has come into existence over the past several decades, and the controversy generated by recent legal decisions has resulted in a significant level of ideological bias in much of what has been written on the topic. This volume is an objective and authoritative examination that considers all aspects of the takings issue. It is a much-needed guide and overview that introduces and explains issues surrounding regulatory takings on the local, state, and federal level for anyone involved with private land and government limitation of its permissible use. The authors describe where the law is now, predict where it might go in the future, and review conflict-reducing solutions to a variety of situations. They condense an immense amount of information into a clear and accesible format, making the book equally valuable for lawyers and non-lawyers alike. The Takings Issue addresses procedural hurdles involved in getting a takings issue heard by a court, examines what does and does not constitute a taking, and considers the remedies available to landowners involved in takings actions. It treats concerns such as zoning, dedications and exactions, subdivision platting, and other local issues in some detail, and also considers state and federal issues involving industrial site approval, endangered species and wetlands protection, restrictions on access to resources on federal lands, and other topics. The book is an essential reference for planners, land use lawyers, developers, and students of planning and law, as well as for policymakers and citizens involved with takings issues.

Book Doing Business in 2005

Download or read book Doing Business in 2005 written by and published by World Bank Publications. This book was released on 2005 with total page 164 pages. Available in PDF, EPUB and Kindle. Book excerpt: Doing Business in 2005: Obstacles to Growth is the second in a series of annual reports investigating the scope and manner of regulations that enhance business activity and those that constrain it. New quantitative indicators on business regulations and their enforcement can be compared across more than 130 countries, and over time. The indicators are used to analyze economic outcomes and identify what reforms have worked, where and why. Topics in Doing Business in 2005 include: Licensing and Inspections: Having registered a business, now what? In most countries, firms face a myriad of sector specific licenses as well as inspections to enforce compliance. The Doing Business database constructs two sets of indicators on the regulation of operations. One measures the steps, time and costs of complying with licensing and permit requirements for ongoing. The other assesses the enforcement of regulations through two of the most common types of inspections-labor and tax. Registering Property: Property registries were first developed to help raise tax revenue. What was good for the tax authorities has since proven to be good for strengthening property rights-the registries strengthen incentives to invest, facilitate trade, and expand access to credit. New indicators cover the steps, time and cost to register property. Measures of the legal provisions that strengthen property rights and the efficiency of property registries are also developed. Protecting Investors: Corporate governance issues are often thought to affect only publicly listed companies in developed countries. In fact, corporate governance is relevant for every large privately held company that has more than one owner. New indicators examine several possible types of shareholder expropriation, including related-party transactions, guarantees and loans to company managers and directors, mergers and acquisitions, disclosure of ownership information, and treatment of conflicts of interest. Including a new emphasis on gender, Doing Business not only provides insights into business constraints throughout the world but highlights particular barriers faced by women. Doing Business is a comprehensive resource that no investor, economic adviser, business developer, or economic policymaker should be without.

This book was released on 2011-05-17 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Water has had an immeasurable impact on the history and growth of the United States. As an essential element of life water has been and remains a constant source of conflict and controversy as different constituencies fight for limited resources. The Encyclopedia of Water Politics and Policy in the United States is the most comprehensive reference source available that analyzes water-related issues in America. A diverse group of over 100 scholars have provided their research and analysis of why water is so significant by tracing its impact on issues like national and state boundaries, western migration, urbanization, and the economy. This volume chronicles the origins of present-day water problems, political conflicts, the impact of legislation and court decisions on the use of water resources, the major projects undertaken across the country, and what experts are proposing be done to preserve this basic component of the environment. Going back some 150 years, the Encyclopedia provides an overview of approximately 280 pieces of water-related legislation, legal cases, people, projects, and organizations that have shaped the history of the United States. In addition to historical coverage, the volume also addresses many current environmental issues including acid rain, agriculture, climate change, mining, erosion, levees and dams, pollution, urbanization, and wastewater treatment. The volume’s A to Z entries are divided into four sections: Regional Water Politics and Policy: Essays providing a narrative background and overview Major Issues in Water Politics and Policy: A comprehensive list of issues from colonial times to the present Law and Government: The people and legislation that have shaped water policy in the United States Places and Projects: Extensive coverage of the projects (including dams and aqueducts) the government has undertaken to develop the nation’s waterways Throughout the volume, concise text features highlight important events, advocacy groups, people, books, and sites important to water politics and policy. A thematic table of contents allows users to easily locate reclamation projects geographically, biographies of important figures, current issues by subject area, government agencies, and legal cases.
