The EPA accepted the computer output as near sacred, while they mocked real-life, raw data. This resulted in declaring a phony health hazard, followed by the labeling of properties with the death kiss of Superfund. Complaints ensued, with the most legitimate protests coming from innocent victims. Congress had created this legal mutant but could not or would not fix it. Meanwhile, the courts were of little remedy since judges jumped from their lonely, intellectual orientation onto the chummy, buffoonery, chessboard of Democrats and Republicans. That platform that has lost its own moral up and down, all the while the courts get to dissect laws so far beyond sunlight that the consideration of common sense is beyond the pale. This is the story of several communities' battle with an immoral, misguided law.

Book excerpt: The Superfund program of the US Environmental Protection Agency (EPA) was created in the 1980s to address human-health and environmental risks posed by abandoned or uncontrolled hazardous-waste sites. Identification of Superfund sites and their remediation is an expensive multistep process. As part of this process, EPA attempts to identify parties that are responsible for the contamination and thus financially responsible for remediation. Identification of potentially responsible parties is complicated because Superfund sites can have a long history of use and involve contaminants that can have many sources. Such is often the case for mining sites that involve metal contamination; metals occur naturally in the environment, they can be contaminants in the wastes generated at or released from the sites, and they can be used in consumer products, which can degrade and release the metals back to the environment. This report examines the extent to which various sources contribute to environmental lead contamination at Superfund sites that are near lead-mining areas and focuses on sources that contribute to lead contamination at sites near the Southeast Missouri Lead Mining District. It recommends potential improvements in approaches used for assessing sources of lead contamination at or near Superfund sites.

Book excerpt: GAO reviewed operations and maintenance (O&M) activities at former or current National Priorities List (NPL) Superfund sites where remediation construction has been completed, focusing on the: (1) extent to which O&M activities are necessary at Superfund sites; (2) costs to the federal government, states, and responsible parties to perform these activities now and in the future; and (3) Environmental Protection Agency's (EPA) actions to help ensure that O&M activities continue to protect human health and the environment. GAO found that: (1) the federal government, states, and responsible parties must perform long-term O&M activities at almost two-thirds of the 275 NPL sites reviewed; (2) these O&M activities include controlling erosion of landfill covers, treating contaminated groundwater, and implementing and enforcing land and water use restrictions; (3) the nationwide cost of current and future O&M activities will be about $32 billion through fiscal year 2040, much of which will be borne by the states and responsible parties; (4) the cost of a given site remedy will depend mainly on what remedy type EPA selects and the duration of the O&M activities; (5) until recently, EPA has focused on the evaluation and cleanup of Superfund sites, but EPA monitoring of O&M activities is crucial because states and responsible parties do not always follow their O&M plans and site conditions can deteriorate; (6) EPA is just now developing guidance for site project managers on monitoring O&M activities to ensure that O&M plans are followed; and (7) EPA has a significant backlog of 5-year reviews and may not be aware of deteriorating conditions at some sites.

Book excerpt: Pursuant to a congressional request, GAO reviewed the Environmental Protection Agency's (EPA) Superfund Program, focusing on: (1) responsible parties' cleanup and legal costs at Superfund sites; and (2) the factors that have increased or decreased their legal costs. GAO found that: (1) about one-half of the firms responding to the GAO survey spent a median of $1.5 million in cleanup and legal costs since January 1987; (2) the firms spent about two-thirds of their total expenses on site cleanups and one-third on legal costs; (3) the firms' cleanup and legal expenses varied widely; (4) in general, the firms that spent more on site cleanups also spent more on legal costs, however, responsible parties with minor shares of cleanup costs paid proportionally higher legal expenses than did major contaminators; (5) most of the firms incurred legal costs in allocating cleanup costs among responsible parties, negotiating with EPA over responsibility and cleanup remedies, and pursuing or defending third-party legal actions; (6) EPA failure to identify and enforce the cleanup obligations of potentially responsible parties, the lack of data on all parties' waste contributions, and the pursuit of other responsible parties for cleanup contributions also increased legal costs; and (7) some firms formed negotiating groups with other responsible parties and used alternative dispute resolution techniques to decrease their legal costs.

To clean up these highly contaminated sites, the Congress established the Superfund program under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) in 1980. EPA, the principal agency responsible for administering the Superfund program, has since identified more than 47,000 hazardous waste sites potentially requiring cleanup actions and has placed some of the most seriously contaminated sites on its National Priorities List (NPL). Through the end of fiscal year 2007, EPA had classified 1,569 sites as NPL sites. Cleanup efforts at NPL sites are typically expensive and can take many years. There are two basic types of cleanup actions: (1) removal actions--generally short-term or emergency cleanups to mitigate threats--and (2) remedial actions--generally long-term cleanup activities. Among other efforts, EPA may respond to and provide technical support for emergency actions, collect and analyze site data, and design and construct remedies, or oversee the work of others. However, the parties responsible for contributing to the contamination of a hazardous waste site are also primarily responsible for conducting or paying for the cleanup of the site. Responsible parties include current or former owners or operators of a site or the generators and transporters of the hazardous substances. CERCLA authorizes EPA to compel the responsible parties to clean up contaminated sites and also allows EPA to conduct cleanups and then seek reimbursement from the responsible parties. One of EPA's goals is ensuring that, to the extent possible, parties who are responsible for the contamination perform or pay for cleanup actions. In some cases, however, parties cannot be identified or may be unwilling or financially unable to perform the cleanup; we previously found that the number of NPL sites without viable responsible parties may be increasing. In these cases, EPA can assume responsibility for site cleanup and seek reimbursement from any responsible parties that can be identified. The states may also play a significant role in cleaning up hazardous waste sites. Most states have established programs to help address hazardous waste sites, although many states have limited capacity to address costly and complex sites. To fund program activities, CERCLA established a trust fund that was financed primarily by taxes on crude oil and certain chemicals, as well as an environmental tax assessed on corporations based upon their taxable income. Although the authority for these taxes expired in 1995, some tax revenues have continued to accrue to the fund as audits of past years' tax returns have led to the recovery of Superfund taxes previously owed by companies. In addition, the trust fund continued to receive revenue--also referred to as receipts--from various other sources, including appropriations from the general fund. EPA receives annual appropriations from the trust fund for program activities; since 1981, Superfund appropriations have totaled over $32 billion in nominal dollars, or about $1.2 billion annually. CERCLA authorizes EPA to use its Superfund appropriation to conduct cleanup actions, and the agency's Office of Solid Waste and Emergency Response (OSWER) is accountable for achieving Superfund's cleanup goals. In this context, Congress asked us to examine the (1) sources of funding for the Superfund trust fund and (2) allocation of these resources to Superfund program activities, particularly enforcement and administration.

He shares his personal feelings with others and they with him. Over the course of the investigation, strong friendships develop between him and other members of his staff and local residents. The adventure concludes with the start of ground-water remediation program and the return of the principal character to his home office.
