Book Encyclopedia of Forms and Precedents for Pleading and Practice at Common Law in Equity and Under the Various Codes and Practice Acts Vol 1 Classic Reprint

Download or read book Encyclopedia of Forms and Precedents for Pleading and Practice at Common Law in Equity and Under the Various Codes and Practice Acts Vol 1 Classic Reprint written by William Henry Michael and published by Forgotten Books. This book was released on 2017-11-02 with total page 1178 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Encyclopedia of Forms and Precedents for Pleading and Practice, at Common Law, in Equity, and Under the Various Codes and Practice Acts, Vol. 1 The encyclopedia OF forms completes the encyclopaedic arrangement of the law as originated by mr. James cockcroft, under whose supervision the development of the scheme has been attended by unprecedented success. His first undertaking, the American and English Encyclopaedia of Law, which covered the field of substantive law and Evidence, has won a position never before occupied by a work upon the law and is looked upon to-day as authority in all English-speaking countries. His next work, the Encyclopaedia of Pleading and Practice, is rapidly approaching a distinction equal to that of the American and English Encyclopaedia of Law. And the editors of his latest and final undertaking, the encyclopedia OF forms, feel assured that it will be a worthy companion to its two great predecessors. The purpose of this work is to supply, in a convenient and easily accessible arrangement, a complete collection of the forms which are necessary to the lawyer in the practice of his profession. Many books of forms have been published, but heretofore no attempt has been made to give to the profession a collection so complete and accurate that. The lawyer can, at a moment's notice, find a form or precedent of almost any conceivable pleading or paper that he is called upon to draw. Investigation will show that the corresponding forms under the various systems of pleading and practice bear such intimate relation one to the other as to make it obligatory in a good form book to treat them all impartially. The forms used under the various codes are often identical in substance; or, if not, are SO alike in principle and mechanism that an approved precedent or adjudicated form in one jurisdiction is of incalculable value in other jurisdictions where no such approval or adjudication has been had. Book Pleading and Forms Adapted to the New Revised Code of Indiana Vol 1

Download or read book Pleading and Forms Adapted to the New Revised Code of Indiana Vol 1 written by John D. Works and published by . This book was released on 2015-07-09 with total page 764 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Pleading and Forms Adapted to the New Revised Code of Indiana, Vol. 1: With a Full Citation of All the Latest Adjudicated Cases in Indiana, and Numerous Authorities Under the Practice at Common Law and in Equity, and Under the Codes of Other States In the preparation of this book I have endeavored to make it sufficiently full in its statement to render it useful to the younger members of the profession who need something more than a mere digest of decided cases. To those of the profession who care but little for general discussion or the reasoning or opinions of the author, a full citation of authorities will be found in the book, the subjects being so classified, and indicated by head lines, as to render it one of easy reference, and make it a digest of the decided cases as well as a work on Practice and Pleading. A very careful and thorough study of the code, and of the decisions rendered before and after its adoption, has been made, with an earnest effort to arrive at its true intent and meaning, as well as the effect of the adjudicated cases, and furnish to the profession a thorough and complete work on Practice and Pleading in this State. Without the aid of a reliable digest this has been a task involving much labor. I found it absolutely necessary, in the investigation of each subject, to examine and make a digest for my own use of the decided cases on that subject. This required much time and patience. The work was partially completed when the new code was enacted, and a considerable portion of the first volume had to be rewritten. Where changes have been made by the revision of the code, they have been carefully noted. These changes will be found to be numerous and, in some instances, important. The change made in the manner of trying causes requiring that all suits in equity shall hereafter be tried by the court, is the most radical. This innovation may be found to be beneficial in practice, but I can not but regard it as a mistake brought about by the necessity for limiting the number of jury trials.
