Book excerpt: In the present report, the Special Rapporteur on extreme poverty and human rights presents fiscal policy, and particularly taxation policies, as a major determinant in the enjoyment of human rights. Taxation is a key tool when tackling inequality and for generating the resources necessary for poverty reduction and the realization of human rights, and can also be used to foster stronger governance, accountability and participation in public affairs. She outlines relevant human rights obligations to guide and inform State revenue-raising practices, including the duty to use the maximum available resources for the realization of economic, social and cultural rights. She also analyses the questions of how the principles of non-discrimination and equality and the duty of international cooperation and assistance should inform taxation policies at the global and national levels. After assessing how revenue-raising policies and practices can be strengthened through a human rights-based approach, she makes recommendations for fiscal and tax policies that are grounded in human rights and can lead to poverty reduction, sustainable development and the realization of transformative rights.

Discrimination against people living in poverty is widespread and widely tolerated.The Guiding Principles on Extreme Poverty and Human Rights are the first global policy parameters focused specifically on the human rights of people living in poverty. They are intended for use by governments to ensure public policies, including poverty eradication efforts, reach the poorest members of society, that they respect and uphold the rights of the poor, and take into account the significant social, cultural, economic and structural obstacles to human rights enjoyment faced by them.The Human Rights Council adopted the “Guiding Principles on Extreme Poverty and Human Rights” by consensus through its resolution 21/11, in September 2012. The process for the development of the Guiding Principles had been initiated by the former Commission on Human Rights in 2001, and their content refined over more than a decade of consultations with States, civil society organisations, United Nations agencies and communities living in poverty. This final draft was written by the United Nations Special Rapporteur on extreme poverty and human rights, Magdalena Sepúlveda Carmona, and presented in her report to the Human Rights Council 21st session (A/HRC/21/39).

To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights.
