Book Actualization Taf il of the Higher Purposes Maqasid of Shari ah

Download or read book Actualization Taf il of the Higher Purposes Maqasid of Shari ah written by Mohammad Hashim Kamali and published by International Institute of Islamic Thought (IIIT). This book was released on 2020-10-15 with total page 44 pages. Available in PDF, EPUB and Kindle. Book excerpt: The higher purposes, or maqasid, of Shariah are applied and actualized (taf`il) through their means (wasa’il). This paper begins with the definition and meaning of maqasid and proceeds to ascertain three discernible tendencies regarding their scope: reductionist, expansionist, and the moderate approach of wasatiyyah/i’tidal. It addresses the question as to whether the maqasid may be recognized as a proof or source of Shariah in its own right. Can one, in other words, extract a ruling (hukm) of Shariah directly from the maqasid, or should one always follow the usul al-fiqh approach? Responding to these questions would help the reader to know more clearly what to expect of the maqasid. We often speak of the maqasid but when it comes to actual practice, we apply the fiqh rules. Can one just ignore the latter and refer directly to maqasid? The work explores the relationship of maqasid to the Qur’an and hadith, and to usul al-fiqh respectively. It also ascertains the roles respectively of the human intellect (‘aql) and innate human nature (fitrah) in the identification of maqasid. The author reviews the means and actualization of maqasid and elucidates this subject through several illustrations and a set of actionable recommendations.

Available in PDF, EPUB and Kindle. Book excerpt: The ongoing digital transformation is shaping the Islamic mode of financial intermediation and the impact on the faith-based financial mode has been multifaceted. This has raised a host of interesting questions: what is the degree of penetration of Islamic finance in the fintech industry? Are Islamic financial institutions (IFIs) or banks ready to embrace fintech? Is fintech an enabler or barrier to achieve the intended purpose of Islamic finance? Will technology narrow the division between Islamic and conventional finance in the future? These are existential questions for Islamic finance and the book endeavors to examine the impact of financial technology on the industry. The book assesses various fintech business models and how they could be a threat or an opportunity. It also examines whether fintech provides IFIs an edge to serve clients following the Shariah norms and how the adoption of fintech in the Islamic mode is required for meeting the maqasid Al Shariah. The book discusses applicability of fintech like blockchain, digital currency, big data, and AI to different branches of Islamic finance. This book will interest students, analysts, policymakers, and regulators who are working on Islamic finance, financial economics, Islamic economics, and development finance.

  • ISBN : 1565645510
  • Pages : 29 pages

Download or read book Books in Brief Ibn Ashur written by Muhammad Al-Tahir Ibn Ashur and published by International Institute of Islamic Thought (IIIT). This book was released on 2013-01-01 with total page 29 pages. Available in PDF, EPUB and Kindle. Book excerpt: Shaikh Muhammad al-Tahir ibn Ashur is the most renowned Zaytuna Imam and one of the great Islamic scholars of the 20th century. The publication of this translation of Shaikh Ibn Ashur’s Treatise on Maqasid al-Shari’ah is a breakthrough in studies on Islamic law in the English language. In this book, Ibn Ashur proposed Maqasid as a methodology for the renewal of the theory of Islamic law, which has not undergone any serious development since the era of the great imams. Ibn Ashur – quite courageously – also addressed the sensitive topic of the intents/Maqasid of Prophet Muhammad (SAAS) behind his actions and decisions. He introduced criteria to differentiate between the Prophetic traditions that were meant to be part of Islamic law and the Prophetic actions/ sayings that were meant to be for the sake of specific purposes such as political leadership, court judgment, friendly advice, and conflict resolution. But Ibn Ashur’s most significant contribution in this book has been the development of new Maqasid by coining new, contemporary, terminology that were never formulated in traditional usul al-fiqh. For example, Ibn Ashur developed the theory of the ‘preservation of lineage’ into ‘the preservation of the family system’, the ‘protection of true belief’ into ‘freedom of beliefs’, etc. He also introduced the concepts of ‘orderliness’, ‘natural disposition’, ‘freedom’, ‘rights’, ‘civility’, and ‘equality’ as Maqasid in their own right, and upon which the whole Islamic law is based. This development opens great opportunities for Islamic law to address current and real challenges for Muslim societies and Muslim minorities.

Book Blockchain Fintech and Islamic Finance

Download or read book Blockchain Fintech and Islamic Finance written by Hazik Mohamed and published by Walter de Gruyter GmbH & Co KG. This book was released on 2022-09-05 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: Following the success of the first edition that brought attention to the digital revolution in Islamic financial services, comes this revised and updated second edition of Blockchain, Fintech and Islamic Finance. The authors reiterate the potential of digital disruption to shrink the role and relevance of today’s banks, while simultaneously creating better, faster, cheaper services that will be an essential part of everyday life. Digital transformation will also offer the ability to create new ways to better comply to Islamic values in order to rebuild trust and confidence in the current financial system. In this new edition, they explore current concepts of decentralized finance (DeFi), distributed intelligence, stablecoins, and the integration of AI, blockchain, data analytics and IoT devices for a holistic solution to ensure technology adoption in a prudent and sustainable manner. The book discusses crucial innovation, structural and institutional developments for financial technologies including two fast-growing trends that merge and complement each other: tokenization, where all illiquid assets in the world, from private equity to real estate and luxury goods, become liquid and can be traded more efficiently, and second, the rise of a new tokenized economy where inevitably new rules and ways to enforce them will develop to fully unleash their capabilities. These complementary and oft-correlated trends will complete the decentralization of finance and will influence the way future financial services will be implemented. This book provides insights into the shift in processes, as well as the challenges that need to be overcome for practical applications for AI and blockchain and how to approach such innovations. It also covers new technological risks that are the consequence of utilizing frontier technologies such as AI, blockchain and IoT. Industry leaders, Islamic finance professionals, along with students and academics in the fields of Islamic finance and economics will benefit immensely from this book.

Book Muslim Societies in Postnormal Times

Download or read book Muslim Societies in Postnormal Times written by Ziauddin Sardar and published by International Institute of Islamic Thought (IIIT). This book was released on 2019-12-01 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: Where will Muslim societies be tomorrow? The world is increasingly and constantly changing, making it hard to keep up. This makes the state much more dire and troublesome for those already marginalised – particularly Muslim societies. Normal is no longer capable of upholding the promise of tomorrow’s certainty. These are postnormal times. In this storm of ignorance and uncertainty, Muslim societies stand to lose the most. But this is not destiny. In the cultivation of a new type of literacy – futures literacy – there resides a hope. Muslim Societies in Postnormal Times offers an alternative where we can ‘rescue’ and decolonise our futures. Sardar, Serra, and Jordan take an open and plural approach to the future revealing the true potentials that lie before us. Through detailed analysis of contemporary trends, the road to destruction is revealed. Through identifying and exploring emerging issues, agency through options can allow for positive change. And in the extrapolation of these ideas into scenarios, the authors pave the way for us to navigate our own preferred futures. Their study challenges the reader to think about the future in a new way, redefining the monolithic future as three tomorrows (Extended Present, Familiar Futures, and Unthought Futures), along the way ever watchful for Black Swans, Black Elephants, and the illustrious Black Jellyfish that could disrupt the path ahead. The authors pull no punches in critically evaluating the possibilities and nightmares that could potentially befall Muslim societies. Through a display of creativity and imagination, this book looks beyond the conventional to illuminate impacts in the context of the complex, interconnected world we find ourselves in. This informative and enlightening text will push readers to see beyond popular, yet native notions of present and future. In the exposition of the reader’s ignorance and uncertainty, they will begin to look for the unthought and take agency in recolonising and navigating their preferred tomorrow.

Book Knowledge in Later Islamic Philosophy

Download or read book Knowledge in Later Islamic Philosophy written by Ibrahim Kalin and published by Oxford University Press. This book was released on 2010-04-01 with total page 338 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study looks at how the seventeenth-century philosopher Sadr al-Din al-Shirazi, known as Mulla Sadra, attempted to reconcile the three major forms of knowledge in Islamic philosophical discourses: revelation (Qur'an), demonstration (burhan), and gnosis or intuitive knowledge ('irfan). In his grand synthesis, which he calls the 'Transcendent Wisdom', Mulla Sadra bases his epistemological considerations on a robust analysis of existence and its modalities. His key claim that knowledge is a mode of existence rejects and revises the Kalam definitions of knowledge as relation and as a property of the knower on the one hand, and the Avicennan notions of knowledge as abstraction and representation on the other. For Sadra, all these theories land us in a subjectivist theory of knowledge where the knowing subject is defined as the primary locus of all epistemic claims. To explore the possibilities of a 'non-subjectivist' epistemology, Sadra seeks to shift the focus from knowledge as a mental act of representation to knowledge as presence and unveiling. The concept of knowledge has occupied a central place in the Islamic intellectual tradition. While Muslim philosophers have adopted the Greek ideas of knowledge, they have also developed new approaches and broadened the study of knowledge. The challenge of reconciling revealed knowledge with unaided reason and intuitive knowledge has led to an extremely productive debate among Muslims intellectuals in the classical period. In a culture where knowledge has provided both spiritual perfection and social status, Muslim scholars have created a remarkable discourse of knowledge and vastly widened the scope of what it means to know. For Sadra, in knowing things, we unveil an aspect of existence and thus engage with the countless modalities and colours of the all-inclusive reality of existence. In such a framework, we give up the subjectivist claims of ownership of meaning. The intrinsic intelligibility of existence, an argument Sadra establishes through his elaborate ontology, strips the knowing subject of its privileged position of being the sole creator of meaning. Instead, meaning and intelligibility are defined as functions of existence to be deciphered and unveiled by the knowing subject. This leads to a redefinition of the relationship between subject and object or what Muslim philosophers call the knower and the known.
