Book excerpt: A l'instar de nombreuses autres réglementations, le droit civil immobilier subit actuellement, sous de nombreux aspects, des modifications importantes. Le ministre de la Justice est à l'origine d'une refonte complète du Code civil à laquelle le droit des biens n'échappe pas. Un projet portant insertion d'un Livre 3 relatif aux biens devrait être adopté avant la fin de la législature par le Parlement fédéral. Les législateurs régionaux ont fait usage des nouvelles compétences qui leur sont dévolues en matière de bail. Le Parlement bruxellois a adopté une ordonnance le 27 juillet 2017 "visant la régionalisation du bail d'habitation" et le Parlement wallon un décret du 15 mars 2018 "relatif au bail d'habitation" entré en vigueur ce 1er septembre 2018 qui modifient, sous divers aspects, la réglementation en matière de bail dans ces deux régions du pays. Ces textes, outre qu'ils modifient sans toutefois le remettre en cause le régime actuel du bail de résidence, introduisent des régimes locatifs nouveaux (bail de colocation, bail étudiant, bail glissant). Le récent Code de droit économique, par les règles d'ordre public ou impératives qu'il contient, impacte concrètement la conclusion de certains contrats immobiliers. Enfin, la loi du 11 mai 2017 "relative à l'assurance obligatoire de la responsabilité civile décennale des entrepreneurs, architectes et autres prestataires du secteur de la construction de travaux immobiliers" , entrée en vigueur pour une bonne partie le 1er juillet 2018, a également des implications d'importance dans le cadre de nombreux contrats de construction. Les droits des biens, du bail et de la construction sont source d'importants contentieux. Ceux-ci sont le quotidien de l'avocat. Par conséquent, il est apparu important de permettre au praticien de disposer rapidement de commentaires sur les réformes dans ces matières où les litiges sont légion. Cet ouvrage contient les exposés approfondis présentés lors de la journée d'étude organisée sous l'égide de la Conférence du jeune barreau du Brabant wallon le 18 décembre 2018. Chacun des acteurs présents a pour objectif d'informer, de manière concrète, du droit sur ces modifications et de leurs implications.

The model was initially developed in the early 2000 by Professor Pesaran and co-authors, for the main purpose of analysing credit risk in a globalised economy. Starting from mid-2000 the model was substantially enlarged in the context of a project financed by the ECB, to comprise all major economies and the Euro area as a whole. The purpose of this version was to exploit the rich modelisation of international linkages in order to simulate and analyse global macro scenarios of high policy interest. The rich, yet manageable, specification of international linkages has stimulated a vast literature on the GVAR. Since early 2011, the basic model - and its data base - has also available on a dedicated GVAR-Toolbox website with an easy-to-use interface allowing practical applications by an extended audience, as well as more complex analysis by the expert public. The book provides an overview of the extensions and applications of the GVAR which have been developed in recent years. Such applications are grouped in three main categories: 1) International transmission and forecasting; 2) Finance applications; and 3) Regional applications. By using a language which is accessible to not econometricians, the book reaches out to the extended audience of practitioners and policy makers interested in understanding channels and impacts of international linkages.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Officially recorded remittance flows to developing countries exceeded US$125 billion in 2004, making them the second largest source of development finance after foreign direct investment.
