Book excerpt: The federal government is the largest buyer of goods and services in the world, and executive branch agencies—particularly the Department of Defense—make most of these purchases. Many (although not all) acquisitions by executive branch agencies are subject to the Federal Acquisition Regulation (FAR), which can make the FAR a topic of interest to Members and committees of Congress and their staff. In particular, Members, committees, and staff may find themselves (1) considering or drafting legislation that would amend the FAR to save money, promote transparency, or further other public policies; (2) conducting oversight of executive agencies' performance in procuring goods and services; and (3) responding to questions from constituents regarding executive branch procurement activities. In addition, certain commentators have recently suggested that some or all FAR provisions should be withdrawn. The FAR is a regulation, codified in Parts 1 through 53 of Title 48 of the Code of Federal Regulations, which generally governs acquisitions of goods and services by executive branch agencies. It addresses various aspects of the acquisition process, from acquisition planning to contract formation, to contract management. Depending upon the topic, the FAR may provide contracting officers with (1) the government's basic policy (e.g., small businesses are to be given the “maximum practicable opportunity” to participate in acquisitions); (2) any requirements agencies must meet (e.g., obtain full and open competition through the use of competitive procedures); (3) any exceptions to the requirements (e.g., when and how agencies may waive a contractor's exclusion); and (4) any required or optional clauses to be included, or incorporated by reference, in the solicitation or contract (e.g., termination for convenience). The FAR also articulates the guiding principles for the federal acquisition system, which include satisfying the customer in terms of cost, quality, and timeliness of the delivered goods and services; minimizing operating costs; conducting business with integrity, fairness, and openness; and fulfilling public policy objectives. In addition, the FAR identifies members and roles of the “acquisition team.” The FAR is the result of a 1979 statute directing the Office of Federal Procurement Policy (OFPP) within the Office of Management and Budget (OMB) to “issue polic[ies] … for the purpose of promoting the development and implementation of [a] uniform procurement system.” Partly in response to this directive, the FAR was issued in 1983, and took effect in 1984. It has been revised frequently since then, in response to legislation, executive orders, litigation, and policy considerations. These revisions are generally made by the Administrator of General Services, the Secretary of Defense, and the Administrator of National Aeronautics and Space, acting on behalf of the Federal Acquisition Regulatory Council. However, the Administrator of OFPP also has the authority to amend the FAR in certain circumstances. FAR amendments generally apply only to contracts awarded after the effective date of the amendment. While the FAR contains the principal rules of the federal acquisition system, it is not the only authority governing acquisitions of goods and services by executive branch agencies. Statutes, agency FAR supplements, other agency regulations, and guidance documents may also apply. In some cases, these sources cover topics not covered in the FAR, and sometimes the FAR addresses topics not expressly addressed in statute or elsewhere. In addition, it is the contract (not the FAR) that binds the contractor, although judicial and other tribunals may read terms required by the FAR into contracts which lack them. Agencies subject to the FAR may deviate from it in certain circumstances, and agencies or transactions not subject to the FAR may be subject to similar requirements under other authority.

Land acquisition is one of the most important issues besetting India’s political economy today. There have been many conflicts surrounding acquisitions; but there have been ample peaceful acquisitions, too. Growth in any economy requires more land. Hence in India too, in the future more and more land will be required for the purposes of infrastructure expansion, industrialization, urbanization etc. The book also examines a number of broader policy issues in the context of land reforms and shows how a successful resolution of the land acquisition matter is vital to attaining a high rate of growth. Using a case study method, the book examines the process of land acquisition in detail and its implications for farmers. It finds that the development of acquired land leads to higher growth and higher employment; and it also leads to improvements for the dalits (the backward class p eople). Benefits in terms of higher revenues for the government are also observed. It argues that, if the acquisition process is properly executed, those farmers who lose land will not oppose acquisition but will instead become partners in the process of growth.

We show that, in spite of countervailing incentives on incumbents and entrants, prohibiting acquisitions has a weakly negative overall innovation effect. We provide conditions determining the size of the effect and, in particular, conditions under which it is zero. We further analyze the effects of less restrictive policies, including merger remedies and the tax treatment of acquisitions and initial public offerings. Such interventions tend to prevent acquisitions only if the entrant has sufficiently high stand-alone profits.

Book excerpt: This study examines the role that value engineering (VE) clauses may be expected to play in design-to-cost contracting. Encouraged by Armed Services Procurement Regulations incentives, contractor VE efforts are supposed to result in proposals for contract changes that reduce some aspects of the cost associated with developing, producing, or operating a particular item. While VE clauses have produced some savings, there have also been certain costs associated with the use of a complex contractual device. This report suggests that cost saving will be much more likely to occur with increased use of fixed-price contracting for discrete phases of development and production, along with more competition. Based on an analysis of past experience with VE clauses, the central conclusion of this study is that while the cost-saving intent of value engineering should be an essential ingredient in design-to-cost strategy, the contractual clauses themselves will at best be marginally effective and may even hinder implementation of design-to-cost programs.

There is also a chapter in which the results for Sweden are discussed in the wider context of advanced public procurement in Europe. The text has been organized such that the main chapters have been written for academic readers. Two supplements include the technical details of data collection, mathematical models, and calculation methods. The first chapter is brief and focused on the results. It has the character of an extended executive summary. The second chapter summarizes the entire story; problems, results, and methods. This project would not have been possible without the generous support of a number of people. First of all great thanks go to all those people with crowded calendars in Swedish industrial firms that have set aside time to respond to my questions. Most of them have been listed at the end of the book.

Book excerpt: Pursuant to a congressional request, GAO reviewed a consultant's study on the financial and operating impact of selected changes in procurement and tax policies on the defense industry. GAO found that the consultant used financial data from nine defense programs to compare program performance under prior acquisition and tax policies, and the profits and cash flows that would occur if tax law changes, new profit policies, lower progress payment rates, and lower cost recovery rates were in effect when each program began. The consultant reported that policy changes would effectively cause: (1) a 23-percent reduction in profits; (2) additional financing for nine contractors, totalling $8.5 billion; and (3) a low return on investment necessary to preserve shareholder value. GAO found that: (1) the study did not show the level of contractor profitability before or after policy changes or support the impact of the policies on the financial condition of government contractors; (2) the study did not recognize the Department of Defense's new profit policy which compensated contractors for financing contract costs; (3) the consultant's use of accrual data overstated cash outflows and produced incorrect conclusions concerning the return on investment; and (4) adequate data was not available to measure the impact that selected changes in procurement and tax policies had on the defense industry as a whole.
