Available in PDF, EPUB and Kindle. Book excerpt: A Community Benefits Agreement (CBA) is a private contract negotiated between a prospective developer and community representatives. In essence, the CBA specifies the benefits that the developer will provide to the community in exchange for the community's support of its proposed development. The validity and enforceability of CBAs has yet to be tested in court, but some have expressed concerns that the agreements will not hold up. Chief among the questions as to the validity of CBAs is whether community groups provide any real consideration for these contracts. Questions have also been raised as to who can enforce a CBA's provisions. Enforceability questions may also concern which parties are bound by developers' promises. Because the process of negotiating CBAs often involves local governments or elected officials, CBAs may also raise legal issues related to the propriety of planning process. While CBAs represent an opportunity to accomplish redevelopment projects in a manner that achieves social equity and engages all community stakeholders in the project with an eye towards designing a process and product that can be win-win for communities, myriad legal issues are present for all involved participants. This paper provides an overview of legal and policy implications of CBAs, highlighting how this new tool is currently utilized in a number of communities across the country.

Rosen explores a new pattern in urban development: local residents and community representatives leveraging large-scale development projects for agreements that promise dedicated local benefits, such as parks and jobs. In general, such development projects have not produced impactful benefits for local residents, and often have contributed to significant community harm, including gentrification and displacement. In response, community activists have launched a fight to control development, using benefits-sharing agreements to ensure that projects produced better outcomes for local residents. While such agreements now exist across the nation, the process of negotiating and enforcing them remains challenging. This book dives deep into four case studies--in Los Angeles, Atlanta, Seattle, and Milwaukee--to answer the following questions: Who ultimately benefits from both the agreements and the projects in question? How do benefits get delivered, and who controls this process? What works for these agreements to successfully produce community outcomes? Rosen shows that, without agreements that promote accountability, developers and other project proponents can walk away from the negotiating table once the agreement is signed and the development moves forward. This disregard for community benefits and priorities can leave community residents solely responsible for benefits delivery during implementation, but with few viable avenues to ensure that outcomes materialize. The cases reveal specific elements that agreements require to achieve success during implementation: community participation, managerial connections, effective partnerships, responsiveness, and vigorous oversight with accountability mechanisms. Although creating these conditions is difficult, sometimes impossible, and contingent on fragile processes, Rosen concludes the book with recommendations for both the agreement negotiation and implementation phases to ensure success.

In its report, the CLG Committee concludes that a number of significant barriers must be removed. Advice - Government and local government itself should provide "off-the-shelf" models and guidance to reduce confusion and risks that deter local authorities currently from considering using mutual or co-operative models for service delivery. Leadership - co-ordination between the Government's Mutuals Support Programme, the DCLG and the Local Government Association must be improved to gather and disseminate evidence on the operation of mutuals and co-operatives in delivering local services. Financing - Government must do more to inform and educate financial institutions about lending to mutuals and co-operatives and it must examine tax support for mutuals and co-operatives. Accountability - all new organisations must remain accountable to the local Council (usually through a contract) and be transparent in their operations. Through commissioning and oversight processes authorities must prevent services from fragmenting and protect the operation and ownership of local public assets. Procurement - rules must be drafted to confer maximum flexibility in tendering for services so that mutuals and co-operatives can compete fairly with large companies and in-house providers.

Book excerpt: Community Benefits Agreement (CBA) campaigns and public discussions about community benefits are becoming the norm in deciding how large urban projects are built outside of formal public land use approvals. CBAs have revolutionized land use approvals for large, public-private economic development projects: now developers and coalitions representing low-income communities can settle their disputes before formal project approval. As a result, CBAs are now commonplace nationwide.Legal scholarship, however, has failed to keep up with these important developments. This Article aims to do just that by examining how CBAs, when properly negotiated, lower transaction costs, enhance civic participation, and protect taxpayers. It argues that CBAs achieve all these outcomes well, and more efficiently than existing government processes. Indeed, this Article's central argument is that to the extent that scholars have analyzed CBAs, their analyses have gone astray by either dismissing CBAs as harmful to communities or by focusing on the role of the state in negotiating what really should be a private contract between a coalition of community groups and a developer. It is a mistake to give the state's role in CBAs primacy over the community coalition because the inclusion of government in the CBA bargaining process creates a host of constitutional protections for developers -- namely that the community benefits must be connected to and proportional with the instant government approval.This Article places focus back on CBAs as private contracts enforceable by inclusive and representative community coalitions. It presents a case study of a successful CBA negotiated for the development of the Kingsbridge National Ice Center in the Bronx. This Article proposes a framework for assessing the impact of CBAs in economic development -- one that recognizes the nuanced role that states and municipalities play in the formation and enforcement of CBAs. The framework focuses on the extent to which CBAs (1) lower transaction costs by effectively resolving disputes among developers and community groups, (2) increase civic participation in public processes, (3) protect taxpayers, and (4) avoid government intervention and constitutional protections for developers. This Article concludes with recommendations for the appropriate, limited role of government in CBA negotiations.

A systematic, interdisciplinary examination of public value is necessary to establish an essential definition and up-to-date picture of the field. In reflecting on the ‘public value project’, this book points to how the field has broadened well beyond its original focus on public sector management; has deepened in terms of the development of the analytical concepts and frameworks that linked the concepts together; and has been applied increasingly in concrete circumstances by academics, consultants, and practitioners. This book covers three main topics; deepening and enriching the theory of creating public value, broadening the theory and practice of creating public value to voluntary and commercial organisations and collaborative networks, and the challenge and opportunity that the concept of public value poses to social science and universities.
